Dear Mr. McConkey:
On March 16,2005, the Division of Water Quality (DWQ) issued yC?ur Buffer Approval for the Widewater Section
of the Knightdale Greenway. Within the approval letter that you received there is a condition that reads:
Notification of Construction
The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the
letterhead address within 10 days of the commencement of construction.
This is a part of the Express Review Program that is required to ensure compliance during construction and post
construction. Therefore, if you have begun construction of these phases of your subdivision, you are required to
notify this office in writing by July 23, 2006. If you do not notify this office in writing and construction has started,
you are in violation of the Water Quality Certification Rules as required by 15A NCAC 2H .0507(c).
This letter is to notify you and make you aware of this new condition that has been written into the Water Quality

EXPRESS REVIEW PROGRAM
Dear Ms. Cheek:
You have our approval, in accordance with 15A NCAC 02'13 .0233 and any conditions listed
below, to impact approximately 692 ft? of Zone 1 and 4,64Sfl? of Zone 2 of the protected
riparian buffers for the purpose of constructing the Widewater Section of the Knightdale
Greenway System at the subject property as described within your application dated March 14,
2005 and received by the DWQ on March 14,2005. In addition, you should obtain or otherwise
comply with any other required federal, state or local permits before you go ahead with your
project including (but not limited to) Erosion and Sediment Control and Non-discharge
regulations.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. lithe
property is sold, the new owner must be given a copy of this authorization and approval letter
and is thereby responsible for complying with all conditions. This approval requires you to
follow the conditions listed below.
The Additional Conditions of the Certification are:

2. Diffuse Flow
An additional condition is that 'all stormwater shall be directed as diffuse flow at non-
erosive velocities through the protected stream buffers and will not re-concentrate before
discharging into the stream as identified within 15A NCAC 2B .0233(5).
3. Protective Fencing
The outside buffer boundary along the construction corridor within these boundaries
approved under this authorization shall be clearly marked with or~ge warning fencing
(or similar high visibility material) for the areas that have been approved to infringe
within the buffer prior to any land disturbing activities to ensure compliance with 15A
NCAC 2B .0233.
4. No Impacts to Zone 1
No impacts shall occur to Zone 1 ofthe protected riparian buffers (except for uses and
activities designated as "exempt" within 15A NCAC 02B .0233), unless otherwise
approved by the DWQ.
5. Construction Stormwater Permit NCGOlOOOO
Upon the approval of an Erosion and Sedimentation 'Control Plan issued by the Division
of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control
program, an NPDES General stormwater permit (NCGOlOOOO) administered by DWQ is
automatically issued to the project. This General Permit allows stormwater to be
discharged during land disturbing construction activities as stipulated by conditions in the
permit. If your project is covered by this permit [applicable to construction projects that
disturb one (1) or more acres], full compliance with permit conditions including the
sedimentation control plan, self-monitoring, record keeping and reporting requirements
are required. A copy of this permit and monitoring report forms may be found at

6. Certificate of Completion
Upon completion of all work approved within this authorization, and any subsequent
modifications, the applicant is required to return the attached certificate of completion to
the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
7. Notification of Construction
The applicant and/or authorized agent shall contact the DWQ Express Review Program in
writing at the letterhead address within 10 days of the commencement of construction.

Any disputes over determinations regarding this Authorization Certificate (associated with the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 ofG.S. 150B. This
Authorization Certificate shall expire five (5) years from the date ofthis letter.
This letter completes the review of the ''No Practical Alternatives" determination under 15A
NCAC 2B .0233. If you have any questions or would like a copy ofthe buffer rules, please call

Widewaters Subdivision section ,of the Town of Knight dale Greenway system complies with the
Neuse River Basin Riparian Buffer Rule (15ANCAC 02B.0233). A Pre-construction Notification
Application (PCN) is attached, which includes an Agent Authorization Form. i
, Site Location
The project is located north of Lauren's Way and south of Highway 64 in Knightdale, North
Carolina. Please refer to the attached Figures I and 2 for the project's location on a USGS
topographic quadrangle and the Wake County Soil Survey maps, respectively:
Proiect History
Action ill #200021150 refers to the jurisdictional detennination made on the surrounding
property that this portion of the greenway runs through. NBRRO #00-125 refers to the buffer
determination made on that property. A PCN application was previously submitted to the
NCDWQ and USACE on May 23,2003. The USACE issued NWP 14 on July 11,2003 to cover
the requested impacts to 21 linear feet of stream. In response to the PCN, theNC-DWQ issued a
letter stating that the application was incomplete and was being placed on hold (see attached
letter). The required information was not submitted within three weeks ofthe date of the NC-
DWQ's response letter and the project was therefore considered withdrawn according to the NC-
'DWQ. DUring the lapse of the past two years the project engineer has changed. The current
engineer has designed the required stream crossings using bridges instead of culverts and there
fore has avoided stream impacts and the need for 40 I or 404 permits. j

The proposed project is the construction of a section of the Town's greenway trail through the
Widewaters Subdivision. The 5-foot wide greenway trail is part of the Town of Knightdale's

existing greenway network (see the attached greenway network map from the Town). The
greenway will be cleared and paved using heavy machinery. The proposed greenway will not
impact any wetlands or other jurisdictional waters. The original submittal of two years ago
proposed that the greenway be entirely in Zone2 ofthe riparian buffers even in locations where
open area outside of the buffers existed. The current plan is stilI confined by existing lots to the
west of the greenway trail and the riparian buffer to the east of the trail but avoids buffer impacts
where possible. The Neuse Buffer Rules designate parallel impacts resulting from greenway
paths in Zone 2 as "allowable." Although substantial efforts have been made to avoid buffer
impacts, given the constraints mentioned above, the proposed greenway will impact 4,648 sq ft of
Neuse Riparian Buffer.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The applicant has redesigned the greenway so that bridges are being utilized as opposed to
culverts thereby avoiding unnecessary stream impacts. The proposed corridor has minimized
crossings of the creeks to three locations and will cross at perpendicular angles to further
minimize impacts to Zone 1 of the buffers and streams. The original submittal of two years ago
proposed that the greenway be almost entirely in Zone 2 of the riparian buffers even in locations
where open area outside of the buffers existed. The current plan is still confined by existing lots
to the west of the greenway trail and the riparian buffer to the east of the trail but avoids buffer
impacts where possible. The Neuse Buffer Rules designate parallel impacts resulting from
greenway paths in Zone 2 as "allowable." Although substantial efforts have been made to avoid
buffer impacts. given the constraints mentioned above. the proposed greenway will impact

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc. us/ncwetlands/strmgide.html.

On May 23,2003, the Division of Water Quality (DWQ) received your application dated May 23, 2003 to impact 21 feet of
perennial stream and 11,765 square feet (ff) of protected riparian buffers to construct the proposed green way trail. The
DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to impact protected wetland, streams
and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will
have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this
project on hold as incomplete until we receive this additional information. Please provide the following information so that
we may continue to review your project.
Additional Information:
1. , Impact Map - The impact map needs to be greater detail ("blow-ups") to determine where the proposed impacts are
located and if there is a practical alternative to avoid them.
2. Stormwater - Please descr" w you intend to handle the stormwater runoff from the trail and comply with the diffuse

Soil & Environmental Consultants, P A regarding a project kno~ as "Town of Knightdale Greenway" for
acceptance into the Express Review Program. This letter advises you that your project will be accepted into the
Express Review Program once the following items are received: 1) a fee of $2,000.00 made payable to the North
Carolina Division of Water Quality, 2) seven complete and collated copies of the application and 3) seven copies
of all additional information pertaining to this project. Thank you for your attention to this matter.
Please keep in mind that the clock for this project will not start until receipt of the completed application package
and required fee are received.
