Use of native vegetation and other soft streambank stabilization techniques must be used where practicable instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be placed in the stream bed, unless approved by the DWQ. 4. Stormwater discharge structures at this site shall be constructed in a manner such that the potential receiving streams (of the discharge) will not be impacted by sediment accumulations, scouring or erosion of the stream banks. 5. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notification application. All construction activities associated with this project shall meet, and/or exceed, those requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual and shall be conducted so that no violations of state water quality standards, statutes, or rules occur. 6.. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within two months of the date the Division of Land Resources has released the project. 7. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of Completion" form to the 401NVetlands Unit of the NC Division of Water Quality. Please send photographs of the upstream and downstream sides of each culvert site to document correct installation, along with the Certificate of Completion form. 8. Continuing Compliance. The applicant (Parker and Orleans Homebuilders) shall conduct all activities in a manner so as not to contravene any state water quality standard (including any requirements for compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines that such standards or laws are not being met (including the failure to sustain a designated or achieved use) or that state or federal law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify the applicant and the US Army Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided to the applicant in writing, shall be provided to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The purpose of this proje t is to develop approximately 260 acres of land for residential use, allowing for the maximum amount of housing units with proper utilities and access from N.C. HWY 84 and S.R. 1343, whi e minimizing impacts to jurisdictional streams and wetlands. Environmental Services, Inc. (ESI) has been contracted by Parker & Orleans Homebuilders to provide permitting services for this Dr i ect. The result's of an on-site field investigation conducted by WPC indicate that there are two jurisdictional stream channels, ten jurisdictional wetlands, and three surface water areas within the project 1m? its. Only one jurisdictional stream channel, an unnamed tributary (UT) to Culvert Branch located in the central portion of the project study area, and one jurisdictional wetland, located in the southern portion of the project study area, will be impacted by this project (Attachment B). Proposed activities include the installation of culverts and rip-rap aprons at two separate road crossings of UT to Culvert Branch, the installation of underground sewer lines at two separate sewer easement crossings of UT to Culvert Branch, and the grading of a residential lot. Each of these activities qualifies under the Nationwide Permit (NWP) program as promulgated by the US Army Corps of Engineers (33 CFR 330). Impacts will consist of 219 linear feet of UT to Culvert Branch, resulting from the installation of 173 linear feet of culvert pipe, thirty linear feet of class 1 rip-Tap, and sixteen linear feet of sewer line (NWP 39). Additional impacts will include approximately 0.04 acre of jurisdictional wetland, resulting from the grading of a residential lot. On behalf Of Parker & Orleans Homebuilders, ESI is submitting a Pre-Construction Notification application in accordance with Nationwide Permit (NWT) Number 39 (Attachment C). ESI has recommended purchasing wetland and stream credits from the Ecological Enhancement Program (EEP) to mitigate for the 219 linear feet of impacted perennial stream and 0.04 acre of wetland (Attachment D). Current !Land Use The project study area and surrounding vicinity is comprised of residential/agricultural land use, and is currently a combination of forested and. pasture land. According to the USDA Soil Survey for Union County, on-site soils consist of Cecil, Chewacla, Helena, Tatum, and Secrest-Cid mapping units (Attachment A - Figure 2a). Cecil and Tatum soils are well drained and exhibit moderate permeability and water capacity. Chewacla soils are somewhat poorly drained and exhibit moderate permeability and high water capacity. Helena soils are moderately well drained and exhibi slow permeability and moderate water capacity. Secrest-Cid soils may be either moderately well drained or somewhat poorly drained and exhibit slow permeability and moderate water capacity. Jurisdictional Determination On-site jurisdictional waters of the U.S., as defined by the U.S. Army Corps of Engineers (USACE), ere evaluated utilizing the Routine On-Site Determination Method. This method is defined in tie 1987 Corps of Engineers Wetlands Delineation Manual (Environmental Laboratory 1987). Based on this approach, there are ten jurisdictional wetland areas and three open water areas within the project limits. These features were reviewed and signed off on by USACE representative Steve Chapin on March 17, 2004 (Action ID: 200430391 - ±235 acre tract) and Amanda Jones on December 22, 2004 (Action ID: 200530676 - ±25 acre tract). One of the wetlands, located in the southern portion of the site, will be impacted by this project. Jurisdictiondl waters of the U.S. were classified according to recent North Carolina Division of Water Qual ty (NCDWQ) and USACE guidance. The results of the on-site field investigation indicated th t there are two jurisdictional stream channels within the project limits. One of the streams, an UT to Culvert Branch located in the central portion of the site, will be impacted by this project (Attachment B). This stream is part of the Catawba River basin (HU# 03050103) (USGS 1974), and is classified as "Class C" waters by the NCDWQ (NCDWQ 2004). 1 The UT to ?ulvert Branch begins at an open water feature off Cox Road (S.R. 1343) and flows southeast to its confluence with Culvert Branch. It drains approximately seventy-five acres and exhibits a five-foot bankfull width with moderate flow and sinuosity. Purpose and Need for the Project The purpose of this project is to develop approximately 260 acres of land for residential use, allowing or the maximum amount of housing units with proper utilities and access from N.C. HWY 84 and S.R. 1343, while minimizing impacts to jurisdictional streams and wetlands. Avoidance and Minimization The proposed design of this project minimizes stream and wetland impacts to the maximum amount possible. The road crossings in this project are necessary to provide adequate access from N.C. HW 84 and S.R. 1343, while ensuring smooth traffic flow for safety purposes.
