Stallings Route 4, Box 226 Louisburg, NC 27549 Subject: Designation of Concentrated Animal Feeding Operation Sa lane _F ms,Inc. fauisburg, N.C. 27 49 Franklin County Dear Mr. Stallings: This letter is to notify you that the Saralane Farms Swine Operation located off Hwy. 56 is hereby designated a concentrated animal feeding operation in accordance with Title 15, North Carolina Administrative Code 2H .0123, and adopted Federal Regulations 40 CFR 122.23. The designation of your swine operation was based on an inspection conducted on May 4, 1990 by Mr. Ed Williams of the Raleigh Regional Office. This inspection showed that you had established a concentrated animal feeding operation requiring such designation based on the following facts: 1. A direct discharge from Lagoon J#2 by way of a breach in the lagoon. The animal waste discharges from the breach in the lagoon into an unnamed tributary to Cypress Creek (Class B) which is located in the Tar -Pamlico River Basin. 2. The swine operation houses approximately 300 sows. 3. The present system in inadequate as the facility has no equipment for the purpose of pumping the lagoon and spray irrigation. However, if you can permanently eliminate the discharge by implementing changes within sixty (60) days of your receipt of this notice, including, but not limited to, modifications to lagoons and the implementation of a final waste disposal plan, a permit application will not be required. If compliance has been achieved, you must notify us in writing within sixty (60) days describing, in detail, the changes or modifications you made. If the discharge of waste to the surface waters of the State is not permanently eliminated within sixty (60) days of receipt of this notice, an NPDES permit application must be submitted within that time. Permit applications should be submitted, in duplicate, to the Director, Division of Environmental Management, P.O. Box 27687, Raleigh, NC 27611. Assistance, if desired, can be obtained by contacting Mr. Timothy L. Donnelly, Regional Water Quality Supervisor, 3800 Barrett Drive, Raleigh, N.C. 27609, telephone number 919/733-2314. The applications should be accompanied by construction plans for the non -discharging animal waste management system. For your information, the following items are enclosed: 1. One copy of the Federal Register - Concentrated Animal Feeding Operations, 40 CFR 122.23. 2. Three copies of NPDES Discharge Permit application - Short Form B. If you need advice or technical assistance with regard to managing animal waste, you should contact your county extension chairman or North Carolina State University's Department of Biological and Agricultural Engineering at (919)- 737-2675. If you wish to contest this Designation, you must request an administrative hearing within thirty (30) days of your receipt of this Notice. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. This inspection is a part of the Division's effort to determine compliance with the State's Animal Waste Management Regulations. Mr. Towell's site visit determined that wastewater from your facility was not actively discharging to the surface waters of the State, nor were any manmade pipes, ditches, or other prohibited conveyances (for the purpose of willfully discharging wastewater) observed. However, as a result of the inspection, the following deficiency was observed: One of the three waste lagoons on the facility had only 14 inches of freeboard which is less than the amount required. Animal waste lagoons are required to maintain enough freeboard so that no discharge of wastewater will occur to waters of the State during any rainfall event less severe than a 25 year\24 hour storm. There was evidence of a recent past discharge of animal waste from,the smallest lagoon due to what appeared to be ground hog activity. A hole was 'observed in the dike wall -that may cause illegal discharges of waste into surface waters if the lagoon level is allowed to rise. The above matters should be addressed to prevent the possibility of an illegal discharge. Please respond to this Notice within 30 days of receipt. The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain a certified animal waste management plan and contact the Division of Water Quality prior to stocking animals. This letter is to advise you that this office has no record of having received the required Certification for the subject facility. Please provide this office with an explanation as to why this Certification was not submitted as required. This explanation must be received within 30 days following the receipt of this letter. Any existing facility owner which did not submit the required certification by the deadline is no longer deemed per to operate their animal waste management system. Therefore, if the certification was not submitted as required and the facility is still in operation, this facility is being operated without a valid permit. N.C.G.S. 143-215.6(b) allows the Secretary of the Department of Environment and Natural Resources to take appropriate enforcement actions for this violation for as long as the violation continues. As per Senate Bill 1217, which was ratified on June 21, 1996, the Environmental Management Conunission (EMC) may enter into a special agreement with facilities that did not meet the December 31, 1997 deadline. These special agreements can only be issued to facility owners which signed up for assistance with their local Soil and Water Conservation District Office by September 1, 1996 and which can demonstrate that they made a good faith effort to meet the December 31, 1997 deadline. The special agreement, if issued, would contain a specific schedule for the facility to follow to develop and/or implement an approved animal waste management plan. Attached is an application for a special agreement between the EMC and the subject facility. If you can demonstrate that this facility can meet the conditions for a special agreement, you may send this request along with your explanation as to why the plan has not been developed and implemented. This bill requires that a certified operator be designated as the Operator in Charge (01C) by January 1, 1997, for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. Our records indicate that your facility is registered with the Division of Water Quality and meets the requirements for designating an O1C. A training and certification program is available for animal waste management system operators. For information on the training programs please contact your local Cooperative Extension Agent. Operator certifications are issued by the Water Pollution Control Systems Operators Certification Commission (WPCSOCC). For information on the certification process, please contact the Technical Assistance and Certification Unit at (919) 733-0026. The type of training and certification required for the operator of each system is based on the nature of the wastes to be treated and the treatment process(es) primarily used to treat the animal waste. There are two types of animal waste management systems, type A and type B. Type A animal waste management systems are generally used to treat waste generated by monogastric animals which produce a low -fiber waste. Type B animal waste management systems are generally used to treat waste generated by ruminants and other animals which produce a high -fiber waste. The type of training and certification an operator receives should correspond with the type of system(s) they intend to operate. For more information on the classification of your system please contact the Technical Assistance and Certification Unit. As the owner of an animal operation with an animal waste management system, you must designate an Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend to operate your animal waste management system yourself, you must designate an employee or engage a contract operator to be the Operator in Charge. The following specifics were observed and determined: 1. Mr. Stallings leases the operation. 2. The operation is a 500 Sow, Farrow to Wean operation. 3. The lagoon was constructed in the 1970's, but there is no plans or records on the lagoon in the Louisburg Field Office. 4. The lagoon was constructed originally for chickens and later converted to a swine operation. 5, There is approximately 4.3 feet of depth available in the lagoon from the top of the embankment to where sludge has accumulated. Therefor the lagoon does not have adequate depth to get anaerobic action and is serving only for storage of waste. 6. According to survey data obtained on October 29, the top of the embankment is at elevation 45.3, the liquid level was elevation 43.0, and the top of sludge was elevation 41.0. The liquid level was 2.3 feet below the top of the embankment. 7. Mr. Stallings did not have access to land to pump the waste on during my first visit. When I made my second visit he had obtained pumping rights to approximately 10 acres of bermuda grass adjacent to his operation. The 10 acres of bermuda grass would be adequate if the lagoon had sufficient depth to promote anaerobic break down of the waste. According to our Tech Guide, Waste Utilization Standard 633, the amount of nitrogen available increases from 5.4 pounds per sow to 22 pounds per sow. This increases the acres of bermuda grass needed to 36.7 acres. 8. The present lagoon, based on the surface area, would handle the waste properly if it had a 12.0 feet depth. 9. The present lagoon with a minimum 7.0 feet depth (6.0 feet for treatment and 1.0 foot for freeboard) could be used as the first stage of a two stage lagoon system. install a pipe between the existing lagoon and the adjacent pond. Use the pond for the second stage to handle the temporary storage for waste, excess rainfall and a 25yr24hr storm. 10. All outside drainage areas should be diverted out of the lagoon to minimize the amount to be pumped. 11. Repairs need to be made to the broken pipes and/or solids collectors to eliminate illegal discharge. 12. There is another small lagoon, approximately, 100 feet by 50 feet, that has waste in it. 13. The pond adjacent to the large lagoon appears to have some waste in it. Since we are entering the winter, and normally a wetter season of the year, I would recommend using temporary measures to get Mr. Stallings through the winter. In the spring the existing structures would be brought up to current standards to give anaerobic treatment. To meet the Division of Environmental Management requirements, I would recommend that the following be done now: 1. Divert all surface runoff out of the lagoon. 2. Develop a Waste Utilization Plan for applying the waste. It is getting too late to pump the waste on the bermuda grass. Mr. Stallings needs to obtain acreage , such as fescue, to apply waste on now. Waste samples need to be analyzed to determine amount of nitrogen available and the rate of application. 3. Pump the liquid waste in the lagoon down approximately 1.3 feet below the level on October 29. This would be down to elevation 41.8 and gives approximately six months of temporary storage. Keep the waste pumped down a minimum of 1.6 feet below the top of the embankment (elevation 43.7). This would handle the waste until about May 1, 1994. 4. Repair necessary pipes and solid collectors. 5. Vegetate all the bare areas with temporary vegetation to prevent erosion. Then in the spring bring the lagoon up to recommended standards. This would decrease the amount of acreage needed to apply waste on from 36.7 acres of bermuda grass to 9r0 acres. Mr. Stallings would need to make a decision as to whether he would want to pursue having a one stage lagoon or a two stage lagoon. The present height of the lagoon embankment is approaching the maximum height possible without falling under the North Carolina Dam Safety Law. If the top of the embankment is raised it would fall under the law. There are two options that Mr. Stallings could use and keep the top of the lagoon at the present elevation. One option would be to remove the sludge down to a minimum 7.0 feet depth and use the existing lagoon as the first stage of a two stage system. The other option would be to excavate sludge and soil needed to obtain a minimum 12.0 feet depth for a one stage lagoon system. The sludge that would be removed should have samples analyzed to determine the nitrogen content and additional acreage would be needed to apply it on. Since we do not have any soils information on the existing lagoon, we would need to do a soils investigation. This is to confirm that the soils are okay for the changes necessary to bring the lagoon up to current standards. The existing small lagoon will need to have the waste removed and the embankment breached and/or the lagoon filled in and vegetated. If the Saralane Farms swine operation is abandoned the Division of Environmental Management may require the waste to be removed including the sludge. Then the embankment will have to be breached and/or the lagoons filled in and vegetated. Hudson, Regional Manager DIVISION OF ENVIRONMENTAL MANAGEMENT December 8, 1994 Mr. Cary Green Route 1, Box 398 B Castalia, NC 27816 Subject: Compliance Inspection Swine Operations State Road 1433 Franklin County Dear Mr. Green: On December 6, 1994 Mr. Danny Smith of the Raleigh Regional Office conducted a compliance inspection of your hog facility located on State Road 1433 in Franklin County. Mr. Smith observed that your lagoon had very little freeboard (about one foot). Also there was evidence of several broken/exposed pipes adjacent to the hog containment buildings. As much as possible, you should prevent stormwater (off the containment buildings, etc.) from having access to your waste system. Because, even from minor rain -events can easily lead to excessive volumes of wastewater in your lagoon that you otherwise would not have to address. Mr. Smith also noted that several of the solids collectors located at the end of your containment buildings had signs of resent discharges.' Also, there were several of these collectors that were discharging during the inspection. These problems should receive your prompt attention in order to prevent both future discharges and the possible loss of your Deemed Permitted Status.
