REQUEST FOR MORE INFORMATION
Dear Mr. Harrison:
On June 29, 2009, the Division of Water Quality (DWQ) received your application dated
June 1, 2009 to impact 0.306 acres of waters, 0.012 acres of coastal wetlands, and 2160
square feet (ft) of Zone 1 protected riparian buffers for the purpose of constructing a 29
slip marina and beach access. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. Therefore, unless
we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and 15A NCAC 213 .0233
(8) and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review
your project.
Additional Information Requested:
1. Riparian Buffer Impacts
Your project plans indicate on sheet 4 that you are proposing to run a six (6) foot
wide pier adjacent to the shoreline in Zone 1 of the riparian buffer for three

hundred ten (310) feet. That same pier then turns ninety (90) degrees to the
northeast and extends out into Adams Creek. Please submit information why the
pier alignment cannot be modified to reduce impacts to the riparian buffer.
Please respond in writing to the DWQ within four weeks of the date of this letter with the
requested information. If we do not hear from you within four weeks, we will assume that
you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Kyle Barnes
