Bear Creek, NC 27207 Resources Dee Freeman Secretary Subject: NOTICE OF VIOLATION North Carolina General Statues (NCGS) 143-214.1 and 143-215.1 NOV-201 I-SS-0012 Wayne Oldham Property Chatham County Dear Mr. Oldham: On March 15, 2011, Division of Water Quality (DWQ) staff responded to a complaint concerning the operation of a swine farm on your property. Based upon the results of the DWQ inspection at the subject site located in Bear Creek, NC in Chatham County, the DWQ has reason to believe that you are responsible for activities resulting in noncompliance with North Carolina law. On March 22, 2011 staff from the Raleigh Regional Office entered the property adjacent to Mr. Wayne Oldham's property. Staff observed approximately 30 swine in an open lot with direct access to a tributary of Little Indian Creek. On the date of inspection, staff conducted a sampling event to determine if water quality standard violations were occurring as a result of activities conducted on your site. Surface water samples were collected from the stream flowing from your property. The water quality standard for fecal coliform bacteria for Class C NSW waters in North Carolina is 200 colonies per 100 milliliter (ml) of sample. The sample collected on your property resulted in a report of 390 colonies per 100 (ml) of sample. The water quality standard for turbidity shall not exceed 50 Nepheiometric Turbidity Units (NTU) for Class C NSW waters of North Carolina. The sample results at the subject facility indicated 450 NTU. The above represent violation of water quality standards at 15A NCAC 2B.021 l (3)(e) and (3)(k) and NCGS 143-214.1. Furthermore no person shall cause or permit any waste directly or indirectly, to be discharged to or in any manner intermixed with waters of the State. A review of our files and records confirms that Mr. Wayne Oldham does not have a valid permit for the above referenced discharge. To correct the violations, you are required to do the following: 1. Remove swine from stream so turbidity violation does not occur. 2. Establish a vegetative buffer between the swine and stream. We request that Mr. Wayne Oldham respond to this notice within 30 working days after its receipt. In the response, please confirm your intent to comply with the above requirements and specify the actions you plan to undertake to correct the violations. The report requested pursuant to Items #1 and #2 is due on or before June 3, 2011. If you cannot comply within the timeframes specified you are required to submit a proposed schedule for accomplishing these actions. Please note that assessment of civil Penalties may have already been recommended for violations described within this Notice of Violation. Failure to comply with the State's rules, in the manner and time specfed, may result in the assessment of additional civil penalties and/or the use of other enforcement mechanisms available to the State. Fines may be imposed under NCGS 143-215.6A(a) of not more than $25,000 per violation of any classification, standard, limitation or management practice established pursuant to G.S. 143-214.1 or for any failure to apply for or to secure a permit as required by G.S. 143-215.1. Additional action may include the issuance of a special order against you under the authority of G.S. 143-215.2, or a request to the Attorney General to institute an action for injunctive relief. If any failure to act is continuous, penalties may be assessed not to exceed a maximum penalty of $25,000 per day, per violation under NCGS 143-215.6A(b) so long as the violation continues.
