Impacts to 37 linear feet of Th-e= channel are proposed in order to rehabilitate the existing dam to meet dam safety requirements as mandated in the attached letter from the NCDENR Land Quality. These impacts are assessed to have minimal adverse impacts on the aquatic environment, both individually and cumulatively, and are presented as a single and complete project as impacts from the subdivision are not dependant upon repair of the dam. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. Impact Justification (Avoidance and IN inimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Impacts are minimum necessary to comply with dam safety requirments VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure Page 4 of 7 that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httpJ/hlo.enr.state.nc.us/ncwetlands/strmgide.litmi. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Impacts have been reduced to the maximum extent practicable by utilizing head walls and shortening riprap aprons to the maximum extent practicable. Additional comments based on our site visit have been prepared by the project engineer and are attached for your consideration. Stream mitigation of 250 linear feet through the NCEEP is proposed as mitigation (request for availability has been submitted to NCEEP). North Carolina Tamp, The purpose of this letter is to request the issuance of Nationwide Permits for the construction of the proposed Stonebridge Subdivision. This project is a single-family residential subdivision located in ivlint Hill, Mecklenburg County between Bartlett Road (N.C.S.R. 3109) and Brief Road (N.C.S.R. 3106). We contend that the current site plan has been designed to minimize and avoid wetland impacts. The impacts shown on the enclosed drawings are necessary for the construction of this project. Section 7(f) of the Mint Hill Subdivision Ordinance requires the proposed subdivision roads provide connectivity internally and to existing parcels and road on the exterior property boundary. The proposed road crossing over the channel draining into the proposed pond is necessary to connect the Bartlett Road side of the project to the Brief Road side of the project. We have designed headwalls at this and other creek crossings that minimize the associated creek impacts. The 78 inch culvert used in this crossing will be installed below the existing creek bed elevation with baffles (per the attached detail) to allow migration of aquatic life through the pipe. Local codes governing connectivity and minimum road design criteria such as horizontal radii did not allow the proposed road layout to avoid the creek crossing between lots 60 and 61. However, our layout was successful in crossing the drainage feature above regulated wetlands at lots 86 and 87. Our impacts associated with Lot 15 are for the installation ofa driveway pipe to serve a house that will be located North West of the small regulated channel. We have minimized impacts in this location by placing the house pad away from the wetlands and providing a nominal impact allowance that will accommodate a small driveway. Lastly, the channel impacts associated with the dam are required to rehabilitate the dam as required by the Dam Safety Division ofNCDENR. These dam improvements will include the CADocuments and Setting\Tamp Bandy\Local Settings\Temporary [ntcmet Fi1es\Content.1E5\SD81EBKli\04135- memo311 ].doe clearing of vegetation off the back side of the dam and grading to flatten the slope. This slope grading will result in a nominal amount of channel impacts. Attached with this memo is a copy of the 08/07/2003 Notice of Inspection requiring these dam improvements. The determination of the channel between lots 60 and 61 as perennial was unexpected and has therefore forced this project into mitigation. This requirement is a heavy financial burden that was not anticipated during the design and development of this project. Any redesign or lot reduction at this point would make this project economically unfeasible due to the required mitigation. Due to the reasons outlined above, we feel that our request for this permit issuance is reasonable and justified.
