Dear Mr. Huggett:
Reference the application of George Taylor/Shellfish 2000 for a Department of the Army
permit to construct a 13' x 48' boat ramp, a 122' vinyl bulkhead, a docking facility with eight
boat slips, and a 40' x 60' storage building on high ground adjacent to a manmade canal, at
Shellfish 2000, wholesale/retail seafood market located at 421 Cedar Point Boulevard, in Cedar
roint, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
, .-
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part ofthis permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
i,f, in the opinion of the Secretary ofthe Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the 'navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOANNATIONAL OCEAN SERVICE

3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance ofthis project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. The bulkhead will not be positioned farther waterward than 2 feet from the normal water
level elevation contour at any point along its alignment.
5. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land-clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit docs not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
7. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
8. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters ofthe United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
9. The permittee must install and maintain, at his expense, any signallights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.

18. Ifthe permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
19. Approval ofthe structure was based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance ofthis permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
20. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion ofthe work authorized by this
permit.
21. The permittee shall require its contractors and/or agents to comply with the terms and
conditions ofthis permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy ofthis permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
22. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
. appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
23. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Incrcases such that
the turbidity in the waterbody is 50 NTD's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTD's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTD's or less in trout waters, are not
considered significant.
24. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion ofthe work will, without cxpense to the United States and in such
time and manner as the Secretary ofthe Anny or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
25. Violations of these conditions or violations of Section 404 ofthe Clean Water Act or

Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
26. The West Indian manatee (Triclzeclzus manatlls), which is listed as a federally
endangered species, has been reported in the waters in Carteret County. In order to protect the
West Indian manatee all work should be done during the period from November 1 to May 31. If
work must be done during the period from June through October the enclosed guidelines, entitled
"Precautions for General Construction in Areas Which May Be Used by the West Indian
Manatee in North Carolina" must be followed.
27. The Permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions ofthis permit. The Permittee is not relieved ofthis
requirement ifhe abandons the permitted activity without having it transferred to a third party.

Dear Mr. Wicker:
This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the subject
Public Notice (PN), dated February 22, 2005. The applicant, George Taylor for Shellfish 2000, a
wholesale-retail seafood market, has applied for a Department of the Army (DA) permit to
construct a boat ramp, install a bulkhead, and construct a docking facility on a man-made canal
off the White Oak River. The proposed work is being considered under Regional General Permit
#198000291, a permit/processing agreement for work that has been approved pursuant to the
North Carolina Coastal Area Management Act (CAMA). These comments arc submitted in
accordancc with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16
U.S.c. 661-667d). Comments related to the FWCA are to be used in your determination of
compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR
320.4) in relation to the protection of fish and wildlife resources. Additional comments are
provided regarding the District Engineer's determination of project impacts pursuant to section 7
of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.c. 1531-1543).
Proposed Actions and Anticipated Impacts
The PN contains the Field Investigation Report (FIR), dated February 3, 2005, of the North
Carolina Division of Coastal Management (NCDCM). The FIR states that the applicant would
construct a boat ramp, 13 feet by 48 feet into the canal. No excavation below nom1al high water
(NHW) would be required. The concrete base for the ramp would be poured on high ground and
slid into position after curing. A vinyl bulkhead, 122 feet long, would be installed for shoreline
stabilization. The bulkhead would average two feet waterward of mean high water (MHW).
Two docks would be constructed in the canal and six finger picrs would be connected to the
docks to create eight boat slips. Three mooring pilings would be installed. Water depths in the
slips would range from -3.5 to -5.5 feet at nom1allow water (NL W).

The FIR states that 543 square feet (ft2) of shallow water bottoms would be filled. This would
include 244 ft2 for the bulkhead and 299 fe for the ramp. Approximately 2,882 fe of Public
Trust Area would be usurped of which 1,108 fe would be shaded bottoms. The FIR notes that
no submerged aquatic vegetation or shellfish resources are evident in the project area. There is a
small patch of coastal marsh in the northeastern edge of the property and no vegetated wetlands
or coastal marsh would be impacted.
Federally Protected Species
The Service has reviewed available information on federally-threatened or endangered species
known to occur in Carteret County. We have also reviewed information from the North Carolina
Natural Heritage Program (NCNHP) database which contains excellent data on the special status
species, both federal and state. This database can be accessed by topographic quadrangle (quad)
of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-
specific inforn1ation on species which should be considered in pern1itting this project. The
project area is in the Swansboro quad. The occurrence data of special status species within this
quad can be obtained on the internet at the "Database Search" heading of <

Our review indicates that the only federally protected species likely to occur in the project area is
the West Indian manatee (Trichecllus mana/liS), a federally-endangered mammal. While there
are no records of the manatee within the Swansboro quad, the species has been reported from
Carteret County. The shallow, estuarine waters of the lower White Oak River provide suitable
habitat for manatees that move along the Atlantic Coast during summer months and are seasonal
transients in North Carolina, primarily from June through October. Manatees may occupy
watcrs one to two meters (3.3 -6.6 feet) deep. The species moves extensively when in North
Carolina waters and past occurrence records cannot be used to precisely dctern1ine the likelihood
that it will be present at a particular construction site.
Based on inforn1ation in the FIR, water depths at the proposed boat slips and mooring pilings are
sufficient for manatees to occur at the site. Pile driving could pose a threat to manatees. To
protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for
General Construction in Areas Which May Be Used by the West Indian Manatee in North
Carolina." These guidelines address all types of in-water construction, except blasting, and
should produce little, if any, additional expense. The guidelines are intended mainly to ensure
that construction personnel are informed that manatees may occur in the work area, that work
should cease if a manatee approaches the work area, work should not resume until the manatee
leaves the work area, and procedures for reporting the death or injury of a manatee. These
guidelines arc available on our web site at < http://nc-

acceptable level by the implementation of the Service's guidelines. The risk would be further
reduced by perforn1ing the work during the period of November through May.

With the inclusion of our manatee guidelines, the Scrvice would concur with a determination by
the District Engineer that the action is not likely to adversely affect species designated as
threatened, endangered, or their designated critical habitat. The Corps' rcquircmcnts of section 7
of the Endangered Species Act would be fulfilled. However, the Corps must reconsider its
obligations under section 7 of the ESA if: (1) new information reveals impacts of this identified
action that may affect listed species or critical habitat in a manner not previously considcrcd; (2)
this action is subsequently modified in a manner which was not considered in this review; or, (3)
a new specics is listed or critical habitat determined that may be affected by the identified action.
Service Concerns and Recommendations
The Service recognizes the relatively small scale of the proposed work. We support the effort of
the applicant to cure the concrete on high ground to prevent wet concrete from coming in contact
with water in the canal. We also support the limited, two-foot waterward extension of the
proposed bulkhead. For structurcs built over SA V or emcrgent coastal marsh, we recommcnd
enough elevation of the structure to allow sunlight to support such vegetation. However, the FIR
provides no indication that any vegetation exists under the proposed structure. The side view of
the pier/bulkhcad indicates only a very narrow intertidal zone which would be suitable for
coastal marsh. Thcrcfore, the adverse impacts on vegetated wetlands appear minimal.
Based on the infomlation given in the FIR and permit application, we do not bclieve the
proposed activities would create irrevcrsible or significant adverse impacts on fish and wildlife
resources under our jurisdiction. Thcrefore, with prudent measures to protect manatees we have
no objcction to issuance of a DA permit for the proposed work described in the PN.

Dear Mr. Taylor:
You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct the
following activity located at 421 Cedar Point Blvd. in Cedar Point, Carteret County. This approval allows
you to:
1. Construct a 13' X 48' boatramp (13' X 23' [299 square feet] of shallow bottom impacts);
2. Construct 122 ' vinyl bulkhead (244 square feet of shallow bottom impacts);
3. Construct two docks with finger piers.
This approval is only valid for the purpose and design that you described in your CAMA Major
application received by the Division onVater Quality (DWQ) in the Wilmington Regional Office
(WiRO) on February 10,2005. After reviewing your application, we have determined that General Water
Quality Certification Number 3400 covers this activity. This Certification allows you to use your CAMA
Permit when the NC Division of Coastal Management issues it. Please keep in mind that there may be
additional Federal, State or Local regulations applicable to your project, such as (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations, NPDES and
Coastal Stormwater: In addition, this approval will expire when the accompanying CAMA Permit
expires unless othenvise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your revised CAMA Major
Permit application received by the Division of Coastal Management on January 18, 2005. If you change or
modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a
new application for a new certification. If the property is sold, the new owner must be given a copy of the
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed on the following
page:

1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate
of completion to this office and a copy to the 401/Wetlands Unit, North Carolina Division ofVVater
Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650;
2. No excavation and no spoil, solids, or fiIl of any kind shaIl occur in wetlands, waters, or riparian
areas beyond the footprint of the impacts depicted in the CAMA Major Application. AIl
construction activities, including the design, instaIlation, operation, and maintenance of sediment
and erosion control Best Management Practices, shaIl be performed so that no violations of state
water quality standards, statutes, or rules occur.
3. Measures shaIl be taken to prevent live or fresh concrete from coming into contact with waters of
the state until the concrete has hardened.
Please notify this Office at the number listed below if any problem arises during the construction of
the project that may affect water quality.
If you do not.~ccept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the DWQ Permit #050342 under Section 401 of the Clean Water

CAMA PERMIT CERTIFICATION
GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE FOR CORPS OF ENGINEERS
GENERAL PERMIT NUMBER 198000291 (ISSUED TO THE NORTH CAROLINA DIVISION OF
COASTAL MANAGEMENT AND RIPARIAN AREA PROTECTION RULES (BUFFER RULES)
This General Certification is issued in conformity with requirement of Section 401, Public
Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Water
Quality Regulations in 15 NCAC 2H, Section ,0500 and 15 NCAC 2B .0200 for the discharge of
fill material as described in General Permit 198000291 and for the Riparian Area Protection Rules
(Buffer Rules) in 15A NCAC 2B .0200. This Certification replaces Water Quality Certification
Number 3025 issued on September 6, 1995. Water Quality Certification Number 3112 issued on
February 11, 1997, Water Quality Certification Number 3274 issued June 1, 2000 and Water
Quality Certification Number 3371 issued March 18, 2002. This WQC is rescinded when the
Corps of Engineers re-authorizes Regional General Permit 0291 or when deemed appropriate by
the Director of DWQ.
The State of North Carolina certifies that the specified category of activity will not violate
applicable portions of Sections 301, 302, 303, 306 and 307 of the Public Laws 92-500 and 95-217
if conducted in accordance with conditions hereinafter set forth.
Conditions of Certification:
1. Activities authorized by CAMA major permits require written concurrence from the
Division of Water Quality as well' as compliance with all conditions of this General
Certification;
2. Activities authorized by Coastal Area Management Act (CAMA) Minor or General
Permits do not require written authorization from the Division of Water Quality as long
as they comply with all other conditions of this General Certification;
3. In accordance with North Carolina General Statute Section 143-215.3D(e), any
request for written concurrence for a 401 Water Quality Certification must include the
appropriate fee. If a project also requires a CAMA Permit, one payment to both
agencies shall be submitted and will be the higher of the two fees. The fee shall be
collected and distributed between the two agencies in accordance with agreements
reached between the Division of Water Quality and the Division of Coastal
Management;
4. In accordance with 15A NCAC 2H .0506 (h) compensatory mitigation may be
required for impacts to 150 linear feet or more of streams and/or one acre or more of
wetlands. In addition, buffer mitigation may be required for any project with Buffer
Rules in effect at the time of application for buffer impacts resulting from activities
classified as "allowable with mitigation" within the "Table of Uses" section of the
Buffer Rules or require a variance under the Buffer Rules. A determination of buffer,
wetland and stream mitigation requirements shall be made for any Certification for
this Nationwide Permit. The most current design and monitoring protocols from DWQ
shall be followed and written plans submitted for DWQ approval as required in those
protocols. When compensatory mitigation is required for a project, the mitigation
plans must be approved by DWQ in writing before the impacts approved by the
Certification occur. The mitigation plan must be implemented and/or constructed
before any permanent building or structure on site is occupied. In the case of public
road projects, the mitigation plan must be implemented before the road is opened to
the travelling public;

The Director of the North Carolina Division of Water Quality may require submission of a
formal application for individual certification for any project in this category of activity that requires
written concurrence under this certification, if it is determined that the project is likely to have a
significant adverse effect upon water quality or degrade the waters so that existing uses of the
wetland or downstream waters are precluded.
Public hearings may be held for specific applications or group of applications prior to a
Certification decision if deemed in the public's best interest by the Director of the North Carolina
Division of Water Quality.

9. NARRATIVE DESCRIPTION:
Project Setting
Shellfish 2000 is a wholesale - retail seafood market located at 421 Cedar Point Blvd., Cedar Point, NC. Hwy
24 turns into Cedar Point Blvd when entering the town of Cedar Point from the east, just before the Swansboro Bridge.
Shellfish 2000 is located on the north side of the road, and is adjacent to a man made canal off the White Oak River.
The applicant owns a lot that is 0.72 acres in size. Applicant states that the property is 5.5' above MLW. The
lot is vegetated with lawn grasses and a patch of Coastal Marsh, Spartina alterniflora, on the eastern boundary. Man
made features that exist on the property include a block building used as a fish house and retail market, a wood
bulkhead, and marl driveway and parking area. The property is classified as Developed in the local land use plan, with
all AEC(s) classified as Conservation. Other permits for this site include a CAMA Minor Permit issued in 2002. Existing
wastewater is dealt with by an existing septic system.
Adjacent properties to the east and west have stabilized shorelines with wood bulkheads. Small boats are tied
off to pilings to the west and a small boat dock exists to the east. The only wetlands on site is the small patch (18' x
12') of ~. alterniflora on the northeastern edge of the property. Existing water depths in the canal range from -1.2'
NLW at the bulkhead to -7.0' in the middle of the canal. The width of the canal at the project site is 125'. The canal runs
east - west with the entrance to the White Oak River to the east.
The waterbody is not classified as a primary nursery area by the DMF, and is classified SA by the DWQ. The
canal and the section of the White Oak River east of the Swansboro Bridge are open to shellfishing. There are no
SA Vs or shellfish resources evident at the project location.
The applicant proposes a 13' x 48' boat ramp to an existing depth of -3'. Also proposed is 122' of vinyl
bulkhead for shoreline stabilization. There are two docks proposed, one 6' x 62', the other 6' x 48'. Six finger piers
would be connected to the two proposed docks. Three mooring pilings are also proposed. When configured, these
would give the applicant eight boat slips. A 40' x 60' metal building is proposed for storage to the east of the existing
building.
Project Description
A 3500sf area on site to the east of the fish house would be filled and raised to an elevation approximating a
100-year flood. Fill material would be brought from an offsite source. The 70' x 50' X 4.5' area to be filled would be
surrounded by silt fencing to prevent sediment run off. When the foundation is ready for building, a 40' x 60' metal
building is proposed for storage. No septic system would be needed for the building as it is for storage only. The new
building would be accessed by an existing marl driveway and would utilize existing marl parking areas. No stormwater
plan has been submitted.
A boat ramp, 13' x 48' is proposed approximately 60' west of the eastern property line. High ground excavation
totaling 20cy of material will be necessary to form the ramp. The high ground area of the ramp would be 13' x 25' x 3'.
Applicant states that no excavation would be necessary below the NHW line, the bottom contours fit the ramp contours.
Material excavated from the high ground would be placed on site in an area exceeding 3D' from the NHW contour.
This material would later be used to backfill a proposed bulkhead. The ramp would be poured to a 6" depth with

concrete on high ground. The ramp from the NHW line waterward would be poured in sections on high ground and slid
into position after curing.
Two docks are proposed. A 4' x 8' access to a 6' x 62' pier running parallel to the shoreline is proposed to the
west of the boat ramp. Three 4' x 16' finger piers are proposed on this dock, creating four boat slips. Two outer tie
pilings would be placed between the finger piers. Total distance of the dock offshore from N L W is 30'. A second 4' x 8'
access on the east side of the proposed ramp would lead to a 6' x 48' dock running parallel to the shoreline. Three
additional finger piers are proposed that would add three slips. One boat could be tied up between the finger piers in
the proposed ramp area, giving a total of eight slips. Water depths at the ends of the finger piers are -5.5 to -6.0. The
channel or deepest water depths are in the middle of the canal, or about 32' offshore of the proposed docks. Docks
would be 15' or greater from the adjoining riparian corridors. The slips would be for small commercial boats.
10. ANTICIPATED IMPACTS:
There would be 620sf of high ground affected by the tie back system of the proposed bulkhead. There would
be 244sf of shallow water bottom habitat affected by bulkhead construction. Approximately 27cy of backfill would be
needed to grade behind the proposed wall. Some turbidity could be expected during construction.
A 50' x 70' area (3500sD of high ground is proposed as a foundation area for a metal building. Fill would be
brought in from a high ground source to raise the elevation out of the flood plain. Silt fencing would be placed around
the perimeter of the fill area to prevent sediment movement. No wetlands are involved in this area, and 14% of the
AEC would be impacted by impervious structures. This development is in excess of 30' of the NHW contour landward..
The ramp would require 325sf of high ground fill of concrete, with an additional 299sf of concrete filling
shallow water bottom. No wetlands are involved in the construction of the ramp. The depth at the end of the ramp is-
3'. Turbidity would likely increase during the time the concrete pads were set in place. but should be short in duration.
Dock impacts include 2882sf of Public Trust Area usurped. Of this, 11 08sf are shaded bottom area. The
proposed docking facility would have eight boat slips. The water depths in the slips would be -3.5 to -5.5 NLW. The
docks should not impede navigation, as they would be at least 32' from the center of the canal, where the water is
deepest and would extend 30' into a body of water 125' across.. No SA V's or wetlands would be impacted. Some
turbidity can be expected during construction.
