Dear Permit Holder:
The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal
and signed certification of no exposure at the 1236 Elon Place, High Point facility as well as observations
made by Brandon Wise with the Winston-Salem Regional Office on January 30, 2019, the division is
grating your conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is
incorporated by reference in North Carolina regulations.
During the site visit the following was noted by the inspector, this will not keep you from
obtaining the No Exposure Certification but should be addressed. A follow-up inspection will be
completed in Fall of 2019 to ensure these two conditions have been completed.
- Full drums were located on the backside of the maintenance building without any secondary
containment. Drums were under cover however secondary containment is required as well.
- A large scrap metal bin was on site without cover. This scrap metal bin should be covered
and a permanent location of the bin should be noted on a site map for regular inspections.
Please note that by our acceptance of your No Exposure Certification, you are obligated to
maintain no exposure conditions at your facility. If conditions change such that your facility can no
longer qualify for the No Exposure Certification, you are obligated to immediately obtain NPDES permit
coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an
un-permitted discharge. You must self -re -certify annually using the enclosed form or obtain NPDES
permit coverage for any stormwater discharges from your facility. The annual self -re -certification does
not need to be submitted unless requested, this form should however remain on file and be available for
review should an inspector request it. The permit holder should also understand that should issues arise
that the department deems to be a problem, then this permit can be suspended and the site can be required
to obtain other NPDES permits.

A large retention pond is also located at the western side of the site. This permit does not affect
the requirements for this pond. The pond is still expected to be maintained as required and inspected with
regular frequency.
Your conditional exclusion from permitting does not affect your facility's legal requirements to
obtain environmental permits that may be required under other federal, state, or local regulations or
