Subject: Elm City remission case
Gentlemen;
Last Thursday, the EMC voted to remit the entire $6,000 civil penalty for case LV-2018-0176 on the grounds that paying
the CPA would cause economic hardship for the Town (even though they did not specifically check that option in their
remission request, it was alleged in their narrative). The implications of total remission in this case on those grounds has
the potential to significantly undermine the Division's efforts to bring the Town back into compliance with their current
permit. I don't know if the Commission is aware of this consequence and I was not allowed an opportunity to convey
this concern at the time the case was being debated and voted on by the Commission.
Given the significance of this decision and its impact on our ability to conduct our mission, do we have any options to
appeal this decision?
