Pier This permit authorizes only the pier, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stati,onary, shall become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures may be conducted on, in or over public trust .....r:.ters without permit modification. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. The authorized structure and associated activity shall not cause an unacceptr:.ble interference with navigation. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury, which may be caused from existing or future operations undertaken by the United States in the public interest. -... :--.....................................................................-,..; Robert R. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. I 7.'. General The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. ' Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. Wolfarth 89 Sunset Drive Columbia, NC, 27925 Subject Property: Robert Wolfarth and George Hayes property Approval of 401 Water Quality Certification (GC3490) with Additional Conditions Dear Mr. Wolfarth: You have our approval, in accordance with the attached conditions, to place fill material within or otherwise impact 0.61 acres of non-vegetated wetlands to construct a bulkhead, boat ramp and pier and perform maintenance excavation as described in your application received by the Division of Water Quality (DWQ) Wetlands/401 Unit on February 15,2005. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: Applicant proposes to construct :t47:iinear feet of bulkhead in an existing man-made canal and conduct maintenance excavation, to a fmal depth of -5.0 feet, in said man-made canal. Additionally, the applicant proposes to construct a I 14 'wide by I2010ng boat ramp in the man-made canal. Approximately 120 linear feet of rip rap is proposed to be installed waterward of an existing concrete bulkhead along the Albemarle Sound.. The applicant also proposes to construct a pier with a I20'by I20'platform with 2-boat slips. Robert Wolfarth and George Hayes Tyrrell County Project setting The project site is located off SR 1212 in the Rhodes Haven Subdivision near Columbia, Tyrrell County, North Carolina on the Albemarle Sound. The project area is bordered on the downstream (east) end by a developed lot. This property has a house and bulkheaded shoreline. It is vegetated with lawn grasses and ornamental shrubs. The project area is bordered on the upstream (west) side by an undeveloped tract of 404 Wetlands. The project site is a combination of2 tracts ofland owned by different parties. The majority of the project area is located on a :1:1.2 acre tract owned by Mr. Robert \Volfarth. The remaining proj ect is located on property owned by Mr. George Hayes. Mr. Wolfarth's property is bordered by the Albemarle Sound to the North and Hayes property to the south. Existing on the western side of the Wolfarth property is a man-made canal, which bisects his property, turns to the east and terminates on the Hayes property. Existing features found on Mr. Wolfarth's property comprise of a house, 2-delapidated metal and wooden groins, and a concrete bulkhead fronts the Sound. Additionally a man-made canal, which is severely eroded on the eastern and southern sides, is located on the property. The existing average water depths are :1:2.7' for the man-made canal and :1:3.5' for the entrance channel in the Sound. Also located on the property are numerous wooden pilings located along the eastern and southern side of the man-made canal. The eroded area landward of the existing pilings ranges from :1:20' to :1:45'. These pilings are the remnants of a previous bulkhead. The Vegetation on the tract consists of upland lawn grasses and pine trees. The site elevation is :1:3.0' above the Normal Water Level. The Albemarle Sound is classified as SB by the Envirorunental Management Commission. The Albemarle Sound is Coastal waters and is not open to shell fishing in the project area. Project description The applicant proposes to construct:l:4 75 linear feet of bulkhead in the man-made canal along the alignment of the previous bulkhead and backfill the eroded area landward of the bulkhead. Maintenance excavation will be conducted within the man-made canal to a final project depth of :1:5.0 feet. Additionally, maintenance excavation is proposed, to a final project depth of :1:5.0 feet in the entrance channel :1:60' into the Albemarle Sound. The maintenance excavation ofthe man-made canal and entrance channel will produce approximately 1300 cubic yards of material that will be used as backfill. The applicant proposes to install a :I: 14' wide by :1:20' long boat ramp in the canal. The existing concrete bulkhead adjacent the sound is proposed to be reinforced with riprap extending :I: 1 0' waterward. Additionally, the applicant proposes to construct a:l:6' wide by :1:45' long pier with a:l:20' by:l:20' T-Head platform at the waterward end with a boat slip on each side of the platform in the Sound. Based on surveys conducted by Timothy J Esolen, the Wolfarth parcel measures 1.22 acres and the Hayes parcel consists of 2.27 acres. Both property boundaries are shown on the enclosed Attachment 3. Copies of the deeds are included as Attachment 4. Proposed development activities include the construction of a bulkhead and subsequent backfilling to reclaim eroded shore face, construction of a boat ramp, pier and platform with four mooring pilings; excavation of an existing man-made basin; rip rap shore stabilization along the sound and removal of creosote pilings. A detailed site plan depicting the proposed development has been included as Attachment 3. The total area of the pr()p~rty within the current 75' A.F:C is 45,548.97 sf. The to.ta.1 area of disturbance within the AEC is 7,590 sf., or 17%. The disturbed area within the AEC will be the proposed backfill area behind the bulkhead. The ABC boundary will change once the shoreline is reestablished. The ABC is depicted both before and after the proposed project activities on the enclosed site plan. " Nearly 475 linear feet of bulkhead are proposed to be constructed using already in place creosote pilings. The normal water line is an average of 25 feet beyond the position of the pilings with a maximum distance of 45-50 feet in one area. The area proposed for a bulkhead is a man-made basin. According to the property owner, Robert Wolfarth, the shore around the east side of the man-made basin has been eroding. Erosion since the 2003 Esolen survey is reported to have been nearly ten feet. Based on locations of the existing creosote pilings, it is assumed that the east side of the basin has lost as much as 40 to 50 feet in the last 15 years. This would equal approximately 3.3 feet per year of worst case shore erosion per year. Details of the bulkhead construction are shown on the enclosed site plan. Once the bulkhead is completed, the applicants propose to excavate nearly 1,300 cubic yards of material to create a 550 feet long, 30 feet wide and 5 feet deep channel in the basin. The material will be excavated using long reach excavators. The spoils will be side cast behind the bulkhead and once settled, graded appropriately. The graded material will be left with a freeboard of 0.5 feet. This should keep runoff from entering the boat basin prior to seeding and stabilization of the backfill. Seeding specifications are included as Sheet 2 accompanying the site plan (Attachment 3). A boat ramp is proposed to be built as shown on the enclosed site plan. The ramp will be 14 feet wide and 20 feet long at a 2.5: 1 slope terminating at the proposed dredge project depth of 5 feet below the normal water line. Details of the boat ramp are depicted on the enclosed site plan. A pier and platform along with four mooring pilings are proposed in the Albemarle Sound as shown. The pier is proposed to be six feet wide and 40 feet long. The platform at the end of the pier is proposed to be 20 feet by 20 feet. Total area of the pier and platform is 640 sf. The shore along the sound has an existing concrete bulkhead as shown on the enclosed site plan. The applicants propose to place approximately 135 cubic yards of rip rap along the interface with the normal water line and existing bulkhead in the Albemarle Sound. Of the proposed 135 cubic yards of rip rap, half will be placed below the normal water line (67.5 cubic yards). A detail of the rip rap placement and the water dependent structures (pier and platform) is shown on the enclosed site plan. Construction Activity Details: Bulkhead. The bulkhead is proposed to be built using existing creosote pilings. Reportedly, the pilings are in sound shape and suitable for re-use. The pilings will most likely need to be removed and then reinstalled. A typical wood and vinyl bulkhead will be constructed with filter cloth installed on the landward side. The bulkhead will be advanced into the substrate at a 1: 1 ratio height to depth. Therefore, based on a proposed channel excavation depth of five feet and a bulkhead height of four feet above normal water, the bulkhead pilings will need to extend to a finished depth of nine feet below the ground surface. The bulkhead will be completely finished prior to any back filling. The property owners propose to use wood mats to transport equipment out to the bulkhead edge to perform the construction activities. Once the bulkhead is completed the property owner will use mats to operate excavation equipment and begin to backfill behind the bulkhead. Materials will be cast and allowed to settle and then graded behind the bulkhead. 2 Basin Excavation- The existing basin was created many years ago and based on reports from the property owners, the east edge of the basin has been eroding at a rate of nearly three and a half feet per year. Based on the water depths from the Timothy Esolen Survey, it appears that the material eroding from the shoreline has been filling in the basin over the past 15 years. Therefore, the property owners propose to stabilize the entire length of the eastern edge of the basin and then dredge the channel out and use the material to backfill behind the newly constructed bulkhead. Based on surveyed water depths, it is estimated that 1,300 cubic yards of material will be excavated and used as backfill. The property owners have access to wooden mats that should be sufficient to support some of the smaller excavation equipment they own. Initially, a small excavator capable of reaching thirty feet will be used to add material behind the bulkhead. Once a sufficient volume of material has been placed along the north east edge of the basin and stabilized, a larger excavator capable of reaching 50 feet will be used to finish cleaning out the channel as shown on the enclosed site plan. Boat Ramp- A boat ramp is proposed to be constructed as indicated on the enclosed site plan. The ramp will measure 14 feet wide by 20 feet long. The slope fo the ramp will be 2.5:1 and the basin will be sloped accordingly during excavation activities. The ramp will be made of precast concrete in eight manageable sections (7' x 5' x 3') and set into place using typical construction equipment (i.e., winches, chains, excavator booms etc. . . ). Pier and Platform- 670 square feet of pier and platform are proposed to be constructed as shown on the enclosed site plan. The pier and platform are proposed to be built three to four feet above normal water. Construction of the pier and platform will include the installation of one foot diameter pilings spaced approximately seven feet on center in pairs for the six feet wide pier (total pilings required 12) and 12 additional pilings will be needed to support the platform. Therefore, a total of 24 pilings will be used. Piling locations are shown on the enclosed site plan. Grading, Excavation and FilV Storm water: Proposed excavation and fill activities on the site include the maintenance dredging of the proposed channel and the subsequent backfill of the newly constructed bulkhead. The area of the proposed channel is 13,143 square feet with an average depth of excavation of 2.66 feet. Therefore, the volume of material proposed to be removed is approximately 35,000 cubic feet or 1,300 cubic yards. The bulkhead will be constructed using the existing creosote pilings already in place. Details of the bulkhead construction are shown on the enclosed site plan. Please note, filter fabric is included in the design. Once the bulkhead is completed, the channel will be excavated and the spoils will be side cast behind the bulkhead, allowed to settle and drain and then graded in behind the bulkhead. The filter fabric should provide adequate filtration to prevent sediment from traveling back into the man-made boat basin. Impacts within the AEC at the site are limited to the excavation of the channel and the construction of water dependent structures and the bulkhead. No impervious surfaces are proposed. Therefore, stormwater controls are not required or necessary to prevent discharges to the waters of the state. 3 Sedimentation and Erosion Control Plan If necessary, a silt fence containment structure could be erected to stage spoils prior to grading. However, filter fabric installed as part of the bulkhead should eliminate the need for additional sedimentation control measures. During construction of the bulkhead proposed near the Section 404 wetlands, silt fencing will be placed upland of the wetlands line to prevent sediment discharges into Section 404 wetlands. The approximate location of the wetlands line is shown on the enclosed site plan. According to Robert Wolfarth, the wetlands line, located on the George Hayes Property, has not been delineated or confirmed by the USACE. Potable Water and Wastewater: Potable water is available on site via the Town of Columbia. Waste water at the site is handled by a permitted on site septic system.
