Upon review of the Non-compliance Reporting records by staff from the Wilmington Regional Office
(WIRO) of the Division of Water Resources (DWR), it was determined that this facility was not in
compliance in regards to maintaining the waste level in a lagoon/storage pond to not exceed the
maximum level specified in the facility's Certified Animal Waste Management Plan (CAWMP). We wish
to thank you for your cooperation and sending these records.
As a result of this incident, you are hereby notified that, having been permitted to have a
non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T
.1304, you have been found to be in violation of your CAWMP and the Swine Waste System General
Permit No. AWG100000 as follows:
Deficiency 1:
Failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in
Condition V.2 of General Permit No. AWG100000.

On June 4, 2018, staff from the Regional Office received notification of the subject farm's lagoon being
out of compliance with the designed freeboard levels speafied in the faality's CAWMP. Lagoon 1 has a
designed freeboard level of 19.5 inches. The level reported to DWR on June 4, 2018 was 18 inches.
You are required to provide a written response within 30 days of receipt of this Notice.
Please include in your response all corrective actions already taken and a schedule for completion of
any corrective actions not addressed. You can mail or email a copy to michael.meilinger@ncdenr.gov.
You may wish to contact your County Soil & Water Conservation District Office, County Extension
office, a qualified technical specialist, and/or a professional engineer for any assistance they may be
able to provide.

In response to your NOTICE OF DEFICIENCY NOD-2018_•PC-0233 for Justin Edwards Farm (31-437)
dated July 23. 2018,1 submit the fallowing msponse.
Oeficleticy 1: Faarim to maintain storaye Capadty in a lagoon greater than or equal to that required 16
Condition V.2 of the State General Permit_ On -June 4. 2018 in good faith and in accordance with my
perm8 requirements, I notified the Wilmington Regional Office that my lagoon was at'18% This level was
1.5' loss than required and I submitted a POA. From May 11, 2018 until June 4, 2018, t received 11' of
rainfall that caused my Lagoon to rise by that amount plus the additional waste deposited by mature
finisWng hogs. Wet field conditions vouki not allow me to redur;e my lagoon level during that time. If i had
applied waste I wauld possibly had runoff or -excessive ponding and 1 did not want that to occur and
compromise the environment. I felt It was best to leave the waste in the lagoon instead of risk a violation.
The lagoon was in compliance within the 30 day time period and since the time of notification, the lagoon
has been lowered in a manner that is responsible even though we are still battling wet conditions and
frequent rainfall events. I plan to continue to monitor the waste application and hopefully avoid this,
situation occurring again. In the event R does, 1 will again notify your office staff_
