Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. IVlarina Facilitv l) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed and operable, and maintained for the life of the marina. 2) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main piers. 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina facility. Any sewage discharge at the marina facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee K Port Cape Fear Association ADDITIONAL CONDITIONS Permit #128-98 Page 2 of 5 4) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to.the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 10) This permit authorizes a maximum of 137 boat slips. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. Maintenance Excavation 11) In order to protect juvenile shrimp and frnfrsh populations, no excavation or filling shall be permitted between February I" and July 31" of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 12) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 13) No excavation shall take place at any time outside of the area indicated on the attached workplan drawings. Port Cape Fear Association ADDITIONAL CONDITIONS Cultural Resources Permit #128-98 Page 4 of 5 23) The N.C. Department of Cultural Resources (NCDCR) has identified an archaeological resource site in close proximity to the location of the authorized launch well (Site 0106CFR). If construction of the launch well cannot avoid site 0106CFR, the permittee shall retain the services of a qualified nautical historian or archaeologist to document the vessels construction. The details of any such report shall be closely coordinated with appropriate NCDCR staff. Contact the NCDCR at (919) 733-4763 for more information on this condition. General 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 25) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T I 5A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or new excavation within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat propellers, shall not be authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 26) Any mitigative measures or environmental commitments specifically made by the applicant in the Environmental Assessment for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. 27) No vegetated wetlands/marsh grass shall be excavated or filled. 28) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands shall not be authorized. 29) The federally endangered West Indian manatee (Trichechus manatus), has been reported in North Carolina waters. In order to protect the manatee, all work should be done between November 1 and May 31. If work must be done outside of this time frame, the permittee shall adhere to enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina". NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Port Cape Fear Association ADDITIONAL CONDITIONS Permit #128-98 Page 3 of 5 14) All excavated materials shall be confined above the normal high water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands, marsh or surrounding waters. 15) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond the normal low water level to prevent gully erosion and unnecessary siltation. 16) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 17) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance with water quality standards. 18) The diked disposal area shall be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. 19) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Contact a representative of the Division at (910) 395-3900 to schedule this meeting. Easement 20) Prior to construction of any new boat slips or other docking facilities within the Cape Fear River, the permittee shall apply for and receive an Easement from the Department of Administration's State Property Office, as required under N.C.G.S. 146-12(e). Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 22) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8930917, which was issued on 5/17/05. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the. navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. The bulkhead will not be positioned farther waterward than 2 feet from the normal water level elevation contour at any point along its alignment. 5. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 6. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 7. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 8. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 9. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 2 10. In order to protect juvenile finfish resources, no excavation or filling activities will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management and the U.S. Army Corps of Engineers. 11. All excavated materials will be confined landward of the mean high water level elevation contour and any vegetated wetlands. 12. All excavated materials will be confined landward of the mean high water level elevation contour within adequate dikes or other retaining structures to prevent spillover of dredged materials into any vegetated wetlands or surrounding waters. 13. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 14. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 15. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water level elevation contour to prevent gully erosion and siltation. 16. Excavation will not exceed 8 feet below the elevation of mean low water. 17. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 18. Approval of the structure was based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 19. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 20. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 3 21. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 22. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 23. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre-project condition. 24. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmingtorr District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. 25. The West Indian manatee (Trichechus rntanatus), which is listed as a federally endangered species, has been reported in the waters in Carteret County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be followed. S. Fish and Wildlife Service (Service) on the subject Public Notice, dated March 15, 2005. The applicant, Port Cape Fear Association, has applied for a Department of the Army (DA) permit to construct a dry stack marina facility with a launch well and 290 linear feet (lf) of floating queuing docks. The project would also construct 820 linear feet of fixed pier walkways to access 48 boat lifts and 10 wet slips. The proposed work is being considered under Regional General Permit #198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA). The Field Investigation Report (FIR), dated January 10, 2005, of the North Carolina Division of Coastal Management (NCDCM), outlines the proposed activities and anticipated environmental impacts. These comments are submitted in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). They will be used in the Corps' determination of compliance with the Clean Water Act 404(b)(1) guidelines (40 CFR 230) and their public interest review (33 CFR 320.4) as they relate to protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). The Service reviewed the Environmental Assessment (EA), dated May 2004, prepared by the Land Management Group for the proposed work and provided comments to the North Carolina Intergovernmental Review Clearinghouse by letter dated June 25, 2004. This office provided you a copy of our comments. Project Area, Proposed Work, and-Anticipated Impacts The applicant owns a tract of approximately 16.7 acres adjacent to the Cape Fear River and south of Wilmington. The existing Wilmington Marine Center (NAWC) consists of an excavated 5.36-acre marina basin. constructed in 1992. that can accommodate 79 boats. The shoreline around this area is stabilized with stone riprap. This facility is permitted for eight feet of draft at mean low water 1) (MLW). High ground on the site is approximately 11.35 acres and the entire site is zoned for heavy manufacturing. Wetlands are limited at the project site. Approximately 0.14 of an acre of coastal wetlands exist along the western edge of the property adjacent to the Cape Fear River. The site contains no "404," or freshwater, wetlands (EA, p. 14). The Cape Fear River in the project area is designated as a primary nursery area (PNA). However, representatives of the North Carolina Division of Coastal Management (NCDCM) and the North Carolina Division of Marine Fisheries (NCDMF) have determined that the area proposed for excavation is not functioning as a nursery area (EA, pp. 9-10). Habitat for non-aquatic species appears limited at the project site. The site has been altered significantly by previous development and spoil deposition (EA, p. 10). Most of the site is currently devoid of vegetation. These activities have largely eliminated terrestrial wildlife habitat. The expansion plan includes both upland development and in-water work. Work on the uplands includes additional paved parking spaces, a boatlift, travel ways for boat launch and retrieval, a boat tumaround/hose down area, and a 5-level, dry stack storage facility to accommodate 210 boats. A fueling facility would be installed near the boat lift. A stormwater detention pond of 0.21 of an acre would be excavated. The proposed work would increase the amount of imperious surface adjacent to the Cape Fear River (EA, p. 16). The site currently has 2.4 acres of impervious surface (EA, p. 2), or 21% (2.4/11.35) of the upland area. The new development would create 1.75 acres of impervious surface. The extent to which the new impervious surface would overlap any existing impervious surface is not specified. However, the current CAMA permit application states (DCM-MP-3, Item g) that 39.1 % of the tract within 75 feet of mean high water would be covered by impervious and/or built upon surface. This amount exceeds the standard 30% impervious coverage given in 15 NCAC 7H .0209 unless runoff is limited by the project design. Along the shoreline a launch well would be constructed by removing 362 cubic yards (cy) of uplands and 3,519 cy of shallow bottoms. The shallow bottoms represent intertidal and subtidal estuarine areas. The EA notes (p. 9) that the area to be excavated has been significantly disturbed by previous maintenance of the entrance channel to the marina. The area of shallow bottoms to be dredged is approximately 17,500 square feet (ft2), or 0.4 of an acre. The launch well would be excavated to a depth of eight feet at mean low water (MLW). The shoreline around the well would be stabilized with 317 linear feet (If) of concrete bulkhead. Two queuing floating docks would be installed along the side of the launch well. The CAMA permit application states that the area to be dredged does not include coastal wetlands (marsh), submerged aquatic vegetation (SAV), or other wetlands. As noted, the NCDMF determined in February 2004 that the excavation area was not functioning as a PNA (EA, p. 10). A new docking facility would be constructed within the Cape Fear River. The fixed access piers and finger piers would accommodate 48 individual boat lifts. An additional 10 wet slips would be created. The proposed work would have no direct impact on wetlands. However, a proposed 8-foot- wide walkway would cross two small sections (approximately 150 ft2) of coastal wetlands. This structure would be elevated four feet over coastal wetlands. The docking facility would extend a maximum of 330 feet into the river. Two floating docks would be built adjacent to the boat lift. Several walkways would be built over the river to provide access to the marina. Water depths around the proposed marina range from -3.44 to -9.95 feet at mean sea level (MSL) (EA, p. 5). Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in New Hanover County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project- specific information on species which should be considered in permitting this project. The project area is in the Wilmington quad. The occurrence data of special status species within this quad can be obtained on the internet under the Database Search section of < http://www.ncnhp.or(j/Paees/herita?(iedata.htm] >. The EA notes (p. 17) that no rare plants or animals currently exist within the tract and that the proposed project will not impact any protected species. However, as we noted in our June 2004 comments, the West Indian manatee (Trichechus manatus), a federally-endangered mammal, could occur in the project area. The species has been reported from New Hanover County and there is an occurrence record in the Cape Fear River, north of the project site. The Cape Fear River may provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees may occupy waters one to two meters (3.3 -6.6 feet) deep. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. The letter, dated May 18, 2004, from the project consultant to the NCDCM states that the applicant plans to pile drive the pilings into the bottom surface. Project diagrams indicate that the waterward portion of the river docking facility would be in water greater than three feet deep. Pile driving during construction poses a risk to manatees. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < http://nc- es.fivs.eov/mammal/manatee uuidelines.pdf>. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. With the inclusion of our manatee guidelines, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the requirement of section 7 would need to be reconsidered if (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. 4 Service Concerns and Recommendations Service comments of June 2004 noted that the EA did not contain a statement of need for the expanded facility. The document notes (p. 4) that Wilmington is a port town which has few available boat slips or storage facilities for the public. However, a low supply of a particular service does not necessarily mean there is an unmet demand for that service. Supply and demand may be in balance within the project site. The EA later noted (p. 5) that there is a "perceived market" for additional boat docking and storage facilities, but no quantitative assessment of this market is provided. We stated that need could be reflected in the capacity utilization of the existing marina. If all the existing spaces are being utilized, there could be a reasonable assumption that additional spaces are needed. However, this information is not provided in the current PN. The Service does not oppose low environmental impact projects which meet a demonstrated need. Since public trust resources would be affected by the proposed work, we continue to believe that the Corps public interest review should ensure that the proposed work will meet a societal demand that is not now being met by existing facilities. If there is an established need for additional boat storage and docking facilities, we agree that the property location and physical features are well suited for additional water access (EA, p. 4). The Service also recognizes the developed nature of the site and the low value of upland habitat on the site. We are also pleased by the mitigation measures summarized in the EA (pp. 18-19) and support the 15 permit conditions recommended by the NCDCM. The Service expressed concerns about structures built over coastal marsh. We recommended that the applicant consider constructing such structures at an elevation above the marsh which would allow sunlight to penetrate through to the coastal vegetation. As noted, the FIR report states that fixed pier would be elevated four feet over coastal wetlands. While greater elevation would be preferable; this elevation is consistent with Regional General Permit 197800056 and is acceptable to the Service. The Service also expressed concern that the amount of impervious surface adjacent to the Cape Fear River would result in increased stormwater runoff. We recommended that the applicant consider innovative materials to reduce the impervious surface created by the project. For example, pervious landscape blocks could be used in areas where concrete and asphalt are currently proposed. Such blocks, also referred to as infiltration blocks or modular paving blocks, create a firm surface but minimize the amount of impervious area, allow vegetation to grow, and allow precipitation to infiltrate into the subsurface soil. The open portion of the blocks reduces runoff volumes. Surface vegetation growing in the open portions will trap some sediment and nutrient from surface runoff. The current PN does not include the recommended design feature. The CAMA permit (DCM-MP-3, Item f) indicates that asphalt and concrete would be used for paved surfaces. However, the May 2004 EA states (p. 16) that stormwater runoff from the boat storage building, boat turnaround area, boat launch travel ways, and parking areas would be treated within the existin- and desi-nated retention ponds. The CAMA permit application notes (DCM-MP-1, Item n) that discharge to waters of the state would "run off through treated swales." While project plans do not provide a clear indication of how stormwater would be transported from the new development in the northwestern part of the tract to the swales mentioned or the new retention pond in the northeastern part, the use of the created pond to limit runoff into the Cape Fear River would be acceptable to the Service. The diversion of stormwater to the retention pond may be necessary as a mitigation measure for the relatively high (39.1%) coverage by built upon surface and paved surfaces within 75 feet of the MHW line. Finally, the applicant should employ precautionary measures to ensure that manatees would not be harmed by pile driving. The Service guidelines should be incorporated into project plans. Additional protection would be achieved by scheduling this work during the November through May period when manatees are not likely to be in the Cape Fear River. Overall, the Service finds the proposed elevation of structures over coastal marsh to be acceptable. The Service does not oppose issuance of a DA permit if the Corps public interest review should find that: (1) the impacts to public trust resources are justified by a public need for the services to be provided; and, (2) the project design has adequate measures to prevent harmful stormwater runoff into the Cape Fear River. PROJECT DESCRIPTION: The project site is the existing Port Cape Fear Marina/Wilmington Marine Center facility, located adjacent to the Cape Fear River, at 3410 River Road, in Wilmington, NC, in New Hanover County. The existing facility consists of an inland basin measuring approximately 700 feet long by 300 feet wide. The facility includes 79 wet slips, a travel hoist, and a boat rail system, with associated temporary dockage between the boat hoist and rail. The shoreline around this area is stabilized by stone rip rap. The basin is connected to the Cape Fear River by an access channel, measuring approximately 2200 feet in length and 100 feet in width. The surrounding highground development currently includes a service/repair building, office, parking, and a dedicated, diked spoils disposal area. The property varies in elevation from +4 to +9 feet above mean sea level. The applicant maintains his existing CAMA Major Permit 1!128-98 for continued maintenance excavation of the marina basin (700' x 250' x -8' MLW) and entrance channel (2220' x 100' X -8'MLW) and recent modifications for shoreline stabilization and docking structures. The proposed project area is located on the westernmost portion of the site, adjacent to the north side of the existing entrance channel to the marina basin. This portion of the property is approximately 4.4 acres and remains vacant.. Upland vegetation on the project site consists of shrub type plants, wild grasses and "404" vegetation such as Marsh Elder (Iva frutescens) and Grounsel- bush (Baccharus haliniifolia). The tract exhibits borders of coastal wetlands along the river vegetated primarily with Giant Cordgrass (Spartina cynocoroides) and Smooth Cordgrass (Spartina altendflora). ' The Cape Fear River is approximately 7000 feet wide at the project site. It's waters are classified as "SC", by the NC Division of Water Quality. There are no shellfish resources in the project area. At the project site, the Cape Fear River is a designated Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. The highground portion of the project is classified as "Developed" by the Wilmington-New Hanover Land Use Plan. The CAMA Areas of Environmental Concern and any area located in the 100-year flood plain are classified as "Conservation". PROPOSED PROJECT: The applicants are requesting a Major Modification to their existing State Permit 9128-98 to construct a full-service, dry- stack marina facility with a harbormasters office and parking lot, fixed piers, finger piers, floating docks, boatlifts, wet slips, launch well, bulkhead, new dredging and a stormwater detention pond. To comply with the requirements of the North Carolina Environmental Policy Act (NCEPA), an environmental documentwas prepared forthe project and reviewed through the State Clearinghouse. A Finding of No Significant Impact (FONSI) was issued on July 23, 2004, following the review process. This application reflects the preferred alternative of the Environmental Assessment (EA). The proposed new dry stack facility would measure 110' x 210' and would have 5 storage levels. The overall height of the building would be 47.5 feet. The building would provide a storage capacity for 210 boats. A harbormasters office would also be constructed adjacent to the dry stack building. This building would measure 30' x 65' and would contain restrooms and space for retail sales. The new facility would have a new 63 space paved parking lot, including 2 handicapped parking spaces. 40 additional paved parking spaces would be located on the northern end of the proposed dry- stack building. An above ground fuel tank would be installed on the north western end of this parking lot, outside the Coastal Shoreline 30 foot buffer area. The applicant proposes to remove approximately 3,520 cubic yards of highground material to a depth of +9 feet above Mean Low Water (MLW) to achieve the proper grade for the dry-stack building and parking lot. There are also 23 paved parking spaces proposed on the eastern side of the property located at the marina entrance road near River Road. The applicant is proposing to construct a stormwater detention pond of approximately 0.21 acres between the existing boat rail and the proposed 23 paved parking spaces to handle runoff from all new impervious surfaces aforementioned. The applicant has submitted an application for a stormwater permit through the N.C. Division of Water Quality (SW-8930917). Port Cape Fear Marina, dba Wihnington Marine Center Page 3 There would be a concrete slab on the southern end of the dry-stack building, which would serve as a boat washing hose- down area. This concrete would be approximately 76 feet in width by 128 feet in length and would connect to the inside concrete floor slab of the dry-stack building. The concrete slab would primarily serve as a stable surface for the forklifts to drive on when launching boats from the dry-stack building into the proposed launch well located on the southern side of the dry-stack building. The applicant proposes to remove approximately 362 cubic yards of highground material and approximately 3,519 cubic yards of shallow bottom material to construct the launch well into the existing entrance channel. The proposed launch well would measure approximately 170 in length by approximately 50 feet in width. The launch well would be excavated to a depth of -8 feet @ MLW. The construction equipment would involve hydraulic dredge and longreach-backhoe and dump truck. The spoils disposal area (120' x 250') is located on site, at the most southern end of the property. The site is sufficient size to accommodate the amount of material proposed to be removed. The applicant proposes to stabilize the shoreline around the launch well with a 317 linear feet concrete bulkhead. The proposed bulkhead would have 102 linear feet along the shoreline of the north end of the entrance channel, 45 linear feet inside the launch well area and 170 linear feet along the north side of the launch well. Two queuing floating docks would be installed within the sides of the launch well, which would run perpendicular to the shoreline and the river; one on the southern side of the launch well at 8' x 120' and one on the northern side at 8' x 170'. The applicant proposes to use this floating dock primarily for fueling and for access to a proposed pumpout station. The applicant also proposes to construct an additional 58 slip docking facility into the Cape Fear River. This docking facility would consist of a main fixed pier that would extend waterward of the proposed dry-stack facility 8' in width by 152' in length. The structure would then "Y" off into separate access piers. There would be one fixed pier oriented to the north with the dimensions of 8' in width by 287' in length. This pier would have would have 11 fixed finger piers on the western side and 9 fixed finger piers on the eastern side of the pier. The dimensions of the finger piers would be 4' in width by 34.5' in length, which would have a distance of 22' between them. There would also be an access pier oriented to the south with the dimensions of 8' in width by 134' in length. This pier would have five fixed finger piers 4' in width by 34.5' in length on the western side of the pier, which would 22' apart as well. These fixed access piers and finger piers would accommodate a total of 48 individual boat lifts approximately 11'x11' each. The applicant also proposes two fixed fingers on the north side and one fixed finger on the south side of the main fixed pier. These finger piers would have the dimensions of 4' in width by 25' in length, which would create 10 additional wet slips. The applicant also proposes to construct an access fixed pier extending from the previously mentioned floating docks. The dimensions of the access pier would be 8' in width by 156' in length, which would run parallel to the shoreline. The pier would connect to the main pier and continue another 100' in length. This section would serve larger vessels utilizing the wetslips on the north side of the main pier. The proposed fixed piers would be elevated 4 feet over coastal wetlands. Construction of the 58 slip docking facility would result in a total of 137 at the marina.. N.C. Department of Cultural Resources stated in a letter dated January 14, 2003 that the proposed project will not impact any existing submerged archaeological sites present in project site. The applicants have submitted an application for sedimentation and erosion control plan through the N.C. Division of Land Resources which is currently under review. 10. ANTICIPATED IMPACTS The proposed excavation and grading of the site for the dry-stack building, parking areas, concrete slab, bulkhead, launch well, and detention pond would result in the disturbance of approximately 3 acres of highground area. The proposed excavation of the launch well into the existing entrance channel would result in the disturbance of approximately 17,500 sq. ft. of shallow bottom. The project would create approximately 7,401 cubic yards of spoil material to be place at an existing diked spoil site on the southern end of the property. Dimensions of the spoil site is 30,000 square feet. The proposed open water marina facility would create an additional 58 private boat slips that would incorporate approximately 34,454 sq.ft. PROJECT DESCRIPTION: The project site is the existing Port Cape Fear Marina/Wilmington Marine Center facility, located adjacent to the Cape Fear River, at 3410 River Road, in Wilmington, NC, in New Hanover County. The existing facility consists of an inland basin measuring approximately 700 feet long by 300 feet wide. The facility includes 79 wet slips, a travel hoist, and a boat rail system, with associated temporary dockage between the boat hoist and rail. The shoreline around this area is stabilized by stone rip rap. The basin is connected to the Cape Fear River by an access channel, measuring approximately 2200 feet in length and 100 feet in width. The surrounding highground development currently includes a service/repair building, office, parking, and a dedicated, diked spoils disposal area. The property varies in elevation from +4 to +9 feet above mean sea level. The applicant maintains his existing CAMA Major Permit #128-98 for continued maintenance excavation of the marina basin (700' x 250' x -8' MLW) and entrance channel (2220' x 100' X -8'MLW) and recent modifications for shoreline stabilization and docking structures. The proposed project area is located on the westernmost portion of the site, adjacent to the north side of the existing entrance channel to the marina basin. This portion of the property is approximately 4.4 acres and remains vacant.. Upland vegetation on the project site consists of shrub type plants, wild grasses and "404" vegetation such as Marsh Elder (Iva frutescens) and Grounsel- bush (Baccharus halintifolia). The tract exhibits borders of coastal wetlands along the river vegetated primarily with Giant Cordgrass (Spartina cynocoroides) and Smooth Cordgrass (Spartina altemiflora). The Cape Fear River is approximately 7000 feet wide at the project site. It's waters are classified as "SC", by the NC Division of Water Quality. There are no shellfish resources in the project area. At the project site, the Cape Fear River is a designated Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. The highground portion of the project is classified as "Developed" by the Wilmington-New Hanover Land Use Plan. The CAMA Areas of Environmental Concern and any area located in the 100-year flood plain are classified as "Conservation". PROPOSED PROJECT: The applicants are requesting a Major Modification to their existing State Permit #128-98 to construct a full-service, dry- stack marina facility with a harbormasters office and parking lot, fixed piers, finger piers, floating docks, boatlifts, wet slips, launch well, bulkhead, new dredging and a stormwater detention pond. To comply with the requirements of the North Carolina Environmental Policy Act (NCEPA), an environmental document was prepared forthe project and reviewed through the State Clearinghouse. A Finding of No Significant Impact (FONSI) was issued on July 23, 2004, following the review process. This application reflects the preferred alternative of the Environmental Assessment (EA). The proposed new dry stack facility would measure 110' x 210' and would have 5 storage levels. The overall height of the building would be 47.5 feet. The building would provide a storage capacity for 210 boats. A harbormasters office would also be constructed adjacent to the dry stack building. This building would measure 30' x 65' and would contain restrooms and space for retail sales. The new facility would have a new 63 space paved parking lot, including 2 handicapped parking spaces. 40 additional paved parking spaces would be located on the northern end of the proposed dry- stack building. An above ground fuel tank would be installed on the north western end of this parking lot, outside the Coastal Shoreline 30 foot buffer area. The applicant proposes to remove approximately 3,520 cubic yards of highground material to a depth of +9 feet above Mean Low Water (MLW) to achieve the proper grade for the dry-stack building and parking lot. There are also 23 paved parking spaces proposed on the eastern side of the property located at the marina entrance road near River Road. The applicant is proposing to construct a stormwater detention pond of approximately 0.21 acres between the existing boat rail and the proposed 23 paved parking spaces to handle runoff from all new impervious surfaces aforementioned. The applicant has submitted an application for a stormwater permit through the N.C. Division of Water Quality (SW-8930917). Port Cape Fear Marina, dba Wilmington Marine Center Page 3 There would be a concrete slab on the southern end of the dry-stack building, which would serve as a boat washing hose- down area. This concrete would be approximately 76 feet in width by 128 feet in length and would connect to the inside concrete floor slab of the dry-stack building. The concrete slab would primarily serve as a stable surface for the forklifts to drive on when launching boats from the dry-stack building into the proposed launch well located on the southern side of the dry-stack building. The applicant proposes to remove approximately 362 cubic yards of highground material and approximately 3,519 cubic yards of shallow bottom material to construct the launch well into the existing entrance channel. The proposed launch well would measure approximately 170 in length by approximately 50 feet in width. The launch well would be excavated to a depth of -8 feet a MLW. The construction equipment would involve hydraulic dredge and longreach-backhoe and dump truck. The spoils disposal area (120' x 250') is located on site, at the most southern end of the property. The site is sufficient size to accommodate the amount of material proposed to be removed. The applicant proposes to stabilize the shoreline around the launch well with a 317 linear feet concrete bulkhead. The proposed bulkhead would have 102 linear feet along the shoreline of the north end of the entrance channel, 45 linear feet inside the launch well area and 170 linear feet along the north side of the launch well. Two queuing floating docks would be installed within the sides of the launch well, which would run perpendicular to the shoreline and the river; one on the southern side of the launch well at 8' x 120' and one on the northern side at 8' x 170'. The applicant proposes to use this floating dock primarily for fueling and for access to a proposed pumpout station. The applicant also proposes to construct an additional 58 slip docking facility into the Cape Fear River. This docking facility would consist of a main fixed pier that would extend waterward of the proposed dry-stack facility 8' in width by 152' in length. The structure would then "Y" off into separate access piers. There would be one fixed pier oriented to the north with the dimensions of 8' in width by 287' in length. This pier would have would have 11 fixed finger piers on the western side and 9 fixed finger piers on the eastern side of the pier. The dimensions of the finger piers would be 4' in width by 34.5' in length, which would have a distance of 22' between them. There would also be an access pier oriented to the south with the dimensions of 8' in width by 134' in length. This pier would have five fixed finger piers 4' in width by 34.5' in length on the western side of the pier, which would 22' apart as well. These fixed access piers and finger piers would accommodate a total of 48 individual boat lifts approximately 11'x11' each. The applicant also proposes two fixed fingers on the north side and one fixed finger on the south side of the main fixed pier. These finger piers would have the dimensions of 4' in width by 25' in length, which would create 10 additional wet slips. The applicant also proposes to construct an access fixed pier extending from the previously mentioned floating docks. The dimensions of the access pier would be 8' in width by 156' in length, which would run parallel to the shoreline. The pier would connect to the main pier and continue another 100' in length. This section would serve larger vessels utilizing the wetslips on the north side of the main pier. The proposed fixed piers would be elevated 4 feet over coastal wetlands. Construction of the 58 slip docking facility would result in a total of 137 at the marina.. N.C. Department of Cultural Resources stated in a letter dated January 14, 2003 that the proposed project will not impact any existing submerged archaeological sites present in project site. ANTICIPATED IMPACTS The proposed excavation and grading of the site for the dry-stack building, parking areas, concrete'slab, bulkhead,'{' launch well, and detention pond would result in the disturbance of approximately 3 acres of highground area. The proposed excavation of the launch well into the existing entrance channel would result in the disturbance of approximately 17,500 sq. ft. of shallow bottom. The project would create approximately 7,401 cubic yards of spoil material to be place at an existing diked spoil site on the southern end of the property. Dimensions of the spoil site is 30,000 square feet. The proposed open water marina facility would create an additional 58 private boat slips that would incorporate approximately 34,454 sq.ft. Estuarine Waters and Public Trust Area. There would be increased turbidity levels during project activity, however, if timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated.
