Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts could be avoided & minimized to the maximum extent practicable. Proposed impacts include two (2) road crossings, one (1) greenway crossing and three (3) Stormwater Control Measures (SCM) discharge outlets. Impacts A-1, C and D are all SCM discharge outlets through riparian buffers. These are permanent riparian buffer impacts necessary to discharge treated stormwater down to the receiving waters. These discharges have been designed to enter the stream at an angle, and to avoid stream impacts. Additionally, Impact A-2 includes permanent and temporary wetland impacts. This wetland impact has been minimized by shifting the discharge as far north as possible and within the narrowest portion of the wetland. Impact B is a proposed road crossing necessary for access to the east side of the property. Proposed impacts include permanent and temporary intermittent stream impacts and associated riparian buffer impacts. Temporary stream impacts are necessary for construction activities. Stream and riparian buffer impacts have been minimized by utilizing head walls. Impact E is a proposed road crossing necessary for access to the property from an existing stub Phlox Road. Proposed impacts include permanent and temporary perennial stream impacts and associated riparian buffer impacts. Temporary stream impacts are necessary for construction activities. Stream and riparian buffer impacts have been minimized by utilizing head walls and wing walls. Impact F-1 & F-2 is a proposed greenway crossing necessary for pedestrian connectivity which avoids a road crossing in this location. Proposed impacts include permanent and temporary wetland impacts and associated riparian buffer impacts. Temporary wetland impacts are necessary for construction activities. Stream impacts have been avoided in this location. Temporary wetland impacts will be brought back to pre -construction contours and allowed to re -vegetate with adjacent wetland seed source. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs' document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Milburnie Ridge project is a residential development. Additionally, the project is located within the City of Raleigh jurisdiction, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition to "diffuse flow" requirements and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements.
