After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide Permit(s) 39 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non-discharge regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 6. Diffuse Flow All stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). Construction Stormwater Permit NCGO10000 Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES General stormwater permit (NCGO10000) administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required. A copy of this permit and monitoring report forms may be found at http://h 2o.enr.state.nc.us/su/Forms Docianents.htm. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Written concurrence is requested from the North Carolina Division of Water Quality that states that the project complies with the Neuse Buffer Rules and GC3374. A Pre-construction Notification Application (PCN) is attached, which includes an Agent Authorization Form. Site Location The Project is located southeast of the intersection of Hilltop-Needmore Rd. (SR 1399) and Sunset Lake Rd. (SR 1301) in Fuquay-Varina. Please refer to the attached Figures 1 and 2 for the project's location on a USGS topographic quadrangle and the Wake County Soil Survey maps, respectively. Project History On January 5, 2005 Ms. Deborah Edwards made and on-site determination for applicability to the Neuse River Riparian Area Protection Rules. See the attached letter (DWQ EXP# 04-2017). On January 24, 2005 Kevin Martin met with Jennifer Burdette of the USACE to discuss the proposed project and obtain her input prior to preparing this application (Action ID# 200520346). Attached is the revised PCN. Project Description Time, use, and the desire to maintain the course properly and in accordance with current design standards, have brought about the need for maintenance and redesign at the 30+ year old golf course. The project involves the filling of jurisdictional open waters,-the excavation of a small emergent wetland, the enlargement of jurisdictional open waters, the enlargement of isolated/non-jurisdictional open waters, and the maintenance of existing uses inside Zone 1 and 2 of Neuse Riparian Buffers. The following summary is arranged by golf hole #. Please refer to the attached impact/maintenance plan for the course. We are only discussing holes where work requiring DWQ and/or Corps approval is required. The entire course is being rehabilitated. Hole #2 Grading and revegetation with grass will occur on an existing grass fairway within Zones 1 and 2 of Neuse buffer. This is activity is considered the maintenance of an existing use. Hole #3 Open waters are to be enlarged 0.25 acres. Stone walls are to be installed at pond edges resulting in a loss of 0.02 acres due to fill. The walls are to be installed to maintain a stable grade on the course which is directly adjacent to the pond. The wall is within the pond (i.e. not the buffer) but grading + backfilling will occur in Zone 1 of the buffer. However, the resultant grass buffers will be equivalent to or larger than the existing buffers. Hole #9 An isolated/non-jurisdictional non-buffered pond is to be enlarged 0.47 acre. Hole #12 Open Waters will be enlarged 0.18 acre. Note that the Cart Path will be modified to stay out of the newly created buffers. Hole #13 Open waters are to be enlarged 0.19 acre. Hole #18 A stone wall is to be installed within the lake near its edge and backfilled. The installation of the stone wall and the associated fill at the mouth of Big Lake will result in the loss of 0.38 acre of loss to open waters. The purpose of the enlargement is to increase the playability of the hole. The applicant also proposes to remove a small depositional sediment peninsula (20'x 80') that has formed at the mouth of the pond, is vegetated sparsely with Juncus sp., and would be considered wetland. The pond will also be enlarged at another location by excavating an existing peninsula adding 0.08 acres of open water to Big Lake. Also, an existing grass fairway within'Zones 1 and 2 is to be graded to remedy drainage problems. The installation of the stone wall at the lake edge as well as the grading and re-vegetation in the buffer as similar to that described for Hole #3. Total loss of jurisdictional open waters due to fill is 0.40 acre. Total amount of enlargements made to jurisdictional open water is 0.70 acre. The total amount of enlargements made to isolated/non-jurisdictional waters is 0.47 acre. The total amount of wetland impact is 0.036 acre. Mitigation Because all activity within Neuse buffers is maintenance of existing uses no buffer mitigation should be required.
