The City of Eden requires a 20' wide maintenance access corridor for sewer lines, which conflicts with Condition 15 of wac #3374. The increased width is to accommodate site constraints due to existing trees and buildings along the route of the existing sewer line In several locations the line will parallel a stream closer than 10 feet This cannot be avoided due to the physcal constraints at these particular locations In addition there is one stream crossing that will not meet the required crossing angle due to the alignment of the existing sewer line and the topography. This crossing will need to placed at an angle of -45 degrees All of the proposed stream impacts will involve replacing existing impacts associated with the old sewer line There will be no significant increase in impact lengths This project is part of a consent order between DWO and the City of Eden which addresses the frequent overflows of the existing sanitary sewer system. Director Division of Water Quality March 7, 2005 DWQ# 05-0217 Rockingham County Mr. Brad Corcoran City Manager City of Eden 308 East Stadium Drive Eden, NC 27288-3299 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Corcoran: The City of Eden has our approval, in accordance with the attached conditions, to place permanent fill in 145 linear feet of perennial stream for the purpose of installing gravity sewer lines in the Meadow Greens, Dan River, and Covenant Branch wastewater collection subsystems in Eden, Rockingham County, as described in your application received by the Division of Water Quality (DWQ) on January 31, 2005. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3374, which can be viewed on our web site at http://h20.enr.state.nc.us/ncwetlands.This Certification allows you to use Nationwide Permit Number 12 when it is issued by the U.S. Army Corps of Engineers. In addition, you 'shou1d secure any other applicable federal, state or local permits before you proceed with your project, including (but not limited to) those required by Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is valid only for the purpose and design that you have described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). The stream channel crossing depicted on Sheet C33 of the Design Plans for the Dan River Western Section, and indicated as being between markers 14+61 and 15+ 11 (Impact #6, Attachment B of the Pre- Construction Notification) shall be at an angle to the stream bank of no less than 45 degrees. All other stream channel crossings shall be at an angle of not less than 75 degrees or more than 105 degrees (900 +/- 150) to the stream banle 3. Soft bank stabilization methods, such as the use of erosion control matting and the planting of appropriate ground cover, shall be utilized to the maximum extent practicable. Riprap may only be used below the normal high water level. The original grade and elevation of the stream's cross-section must be maintained. Riprap placed in the stream bottom must be inserted into the bottom matrix to a depth sufficient to provide the thickness of riprap required for scour protection. The elevation of the stream bottom must not be increased by the placement of riprap. Placement of riprap must not result in destabilization ofthe streambed or banks upstream or downstream of any crossing. 4. In those areas where the construction corridor must be installed parallel to and closer than 10 feet to a stream channel, appropriate sediment and erosion control measures which equal or exceed those outlined in the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual or the North Carolina Surface Mining Manual (available from the Division of Land Resources at NCDENR regional offices or the central office), whichever is more appropriate, shall be designed, installed and maintained properly to assure compliance at all times with the North Carolina water quality standards that are applicable to Class C waters as described in 15A NCAC 02B .0211 Fresh Surface Water Quality Standards For Class C Waters. Such measures must equal or exceed the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. These measures must be maintained on all construction sites, borrow sites, and waste pile (spoil) sites, including contractor owned and leased borrow pits, which are associated with this project. 5. Permanent, maintained access corridors shall be restricted to a maximum width of 20 feet, including manhole locations and vehicle turnaround areas. 6. Where joints must be placed in sewer lines within the foot print of the stream channel at crossings having topographic and bedrock constraints, the jointed section shall either be completely enclosed in a steel encasement pipe sealed at both ends, for aerial crossings, or encased in concrete from bank to bank, for buried crossings. 7. If concrete is used with any fill material, it shall not be allowed to come in contact with surface waters until it has cured. 8. Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the ~401 Certification has been completed. The responsible party shall complete the attached form and return it to the 40 1/W etlands Unit of the NC Division of Water Quality upon completion of the project. Along with the Certificate of Completion form, please send photographs upstream and downstream of each stream-crossing site to document correct installation. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Dickson & Co., Inc. for design of approximately 25,000 linear feet of 8, 10 and 12 inch gravity sanitary sewer collectors and outfalls to serve the Meadow Greens, Dan River and Covenant Branch wastewater collection subsystems. This project will meet conditions set forth in a Special Order by Consent (SaC) by the Division of Water Quality and Environmental Management Commission. The project entails installing approximately 10,800 linear feet of 8-inch and 12-inch gravity sanitary sewer in the Meadow Greens portion, approximately 8,800 linear feet of 8-inch and lO-inch sewer in the Dan River portion and approximately 6,500 linear feet of 8-inch gravity sanitary sewer in the Covenant Branch portion. Total land disturbing activity is estimated to be 13 acres. Total stream disturbance is less than 150 linear feet combined. The streams will be crossed using one of two methods, depending on the depth of the line. The first will be an aerial crossing, which will have no impact to stream conditions. The other type will be buried beneath the stream and encased in concrete. Topological and geological conditions prevent several of these crossings from containing only one joint or section of pipe. In these cases, the terrain is very steep on one side and then flattens out on the opposite side. This type of situation combined with the presence of rock dictates the need to cross the stream with multiple joints of pipe. Unfortunately, no viable and economical alternatives are available that would reduce the length of these crossings. In some cases, the proposed construction corridor comes within 10 feet of some streams. Given that both sanitary sewer lines and streams tend to flow to the lowest points in a concerned watershed, this conflict is likely to be common. Florid,) \ . only a small corridor in which in would be feasible to construct without mandating blasting in an urban area. These areas are short relative to the stream's length, and are so few in number that they are unlikely to have any significant impact on buffer areas. City regulations mandate a 20' easement for maintenance of sanitary sewer lines. The regulations are to ensure that proper space is allocated and cleared so that it is possible to get maintenance equipment to manholes. The mandated 10' easement would allow blockage of sanitary sewer lines by tree roots growing at the edge of easements, and would not provide enough room to maneuver around manholes set above flood plains. These unavoidable and necessary circumstances are in conflict with Articles 4, 5 and 15 of the Water Quality Certification 3374 (WQC #3374). Mindful of these stipulations, we, therefore, propose a rigid and conservative design to protect and safeguard the streams in the event of line failure or leaking pipe joints. We propose a rigid and conservative design for both aerial and buried crossings of any length. For aerial crossings, the sewer pipe will be restrained joint and encased in steel encasement pipe sealed on either end. For buried crossings, the sewer pipe will be encased in concrete the entire length of the crossing from top of bank to top of bank. Full sediment control measures will be in place to prevent sediment from running off in to the stream, and the access corridor will be reseeded after construction activities to prevent post-project sediment runoff. We trust this design meets or exceeds the expectations of your permitting unit and written concurrence will be issued. We respectfully request that the DWQ review the design of the sewer replacement in the vicinity of Pierce Street (State Road 1962) including plan sheets C8, C9, C10 and C30 and if possible provide the City of Eden authorization to construct the sewer improvements as soon as possible. The North Carolina Department of Transportation (NCDOT) is currently in midst of enhancing Pierce Street by of. widening the road for installation of a center turning lane, improving drainage and installing a pedestrian sidewalk. The NCDOT anticipates to be completed with construction by the spring. The proposed sewer replacement work will require that this road be open cut and at times be closed for deep excavation. The City would like for its work to be performed prior to or concurrent with the completion of the roadway project. The City and NCDOT will greatly benefit from this approach by: . Eliminating duplicate roadway construction work in Pierce Street . Reducing the likelihood of additional restoration costs along Pierce Street . Reducing the time that this road is disturbed . Minimizing nuisances to motorists, pedestrians and adjacent property owners These projects, as well as each of the other sub-projects, have independent utility work and could be considered several separate small sewer projects. However, in the interest of expediting paperwork and reducing workload on all parties concerned, we have submitted these projects together for convenience. We trust this request is both justified and well received by your agency. Please advise if you need any additional information for our request to be considered and hopefully accepted. Trenching equipment such as rubber tire backhoes, trackhoes for pipeline and manhole installation, tandem trucks to haul pipe, bulldozers for clearing and grubbing, dump trucks for hauling debris and hydraulic rams for pipe-bursting existing pipe will all be used. 11. Explain the purpose of the proposed work: This work is intended to replace faulty, leaking and deteriorated pipe. The replacement of this pipe will reduce the number of sanitary sewer overflows the city currently experiences thus complying with a current Special Order by Consent. IV. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of altemative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. An Erosion Control Plan has been submitted to the Land Quality Division to prevent any runoff from entering streams. Trenching in the actual stream itselfwill be immediately stabilized with Class 1 Rip-Rap, and the total disturbance area will be limited to 6' off of the centerline of the pipe. It was not financially feasible given the location of the pump stations to which these sewers drain to attempt to bypass or avoid crossing the streams. The streams were crossed at a perpendicular angle to avoid any unnecessary disturbance where possible. Furthennore, the construction of any and all lines that cross existing streams will be in full compliance with the Page 9 of 13 anti-seep collar and concrete encasement provisions ofWOC 3374. The affected channels are surrounded by sewer lines as well as buildings, making it impossible to relocate them. Some streams are crossed multiple times in order to pick up sewer services on either side. This practice was minimized where possible. VIII. Mitigation No mitigation is proposed. DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in detennining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h20.enr.state.nc.us/ncwetlands/stnn gi de. htm I. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Proper erosion control has been provided, and the corridor will be re-seeded after construction to prevent post-construction runoff. 5) There are some stream crossings that are too wide to be crossed with only one section of pipe. However, concrete encasement is being provided to prevent any seepage from pipe joints. 6) The project is not within the Tar-Pamlico, Catawba, Neuse or Randleman watersheds. 7) Measures will be taken to prevent live or fresh concrete from coming in to contact with stream waters. 8) No herbicides will be applied to this project. 9) Rip-Rap will only be applied to areas directly affected by installation of the sewer line. No extraneous pipe will be installed. 1 O)An erosion and sediment control plan has been submitted. l1)AII sediment and erosion control measures placed in the waters will be removed at the end of the project. 12) No species will be planted. 13) No fertilizers will be used. 14)The construction corridor does not exceed 40' at any point in the project. 15) The permanent easement exceeds 10' of total width. 10' of total width is too small for the City of Eden to maintain the line, and would not prevent tree roots and other concerns from entering the permanent easement. The entire project will be re-seeded after construction to offset any runoff issues. 16)The project is crossing no wetland areas. 17)There will be no change in pre-construction stream contours. 18) No environmental document is required. 19)The project is not in a coastal county. 20)There is no compensatory mitigation required. 21 )There is no compensatory mitigation required. 22)AII other relevant state and local permits will be acquired.
