The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine ifpayment to the NC EEP will be approved.
This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404
PermiU401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send
copies of the 404/40 l/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401
Certification an invoice will be issued and payment must be made.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation for the permitted impacts
up to a 2: I mitigation-to-impact ratio, (buffers, Zone I at a 3: I ratio and Zone 2 at a 1.5: 1 ratio). The type and amount of the
compensatory mitigation will be as specified in the Section 404 Permit and/or 40 I Water Quality Certification, and/or
CAMA Permit. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C.
Department of Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.

Dear Mr. Silverman:
Your application for a 401 Watcr Quality Certification to impact up to 0.09 acres of wetlands and 227 feet
of intermittent streams at the subject property was received in the Division of Watcr Quality's Central
Office on February 3, 2005. According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken
within 60 days, the Certification is waived unless DWQ has objectcd in writing to your application.
Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact
waters as described in your February 3, 2005 application materials.
However, if additional impact occurs or your development plans change, this waiver is no longer valid and
a 401 Water Quality Certification will be required.

On behalf of Midland Southpoint Development, LLC, we hereby request authorization
from the US Army Corps of Engineers (USACE) to use Nationwide Permit (NWP) 39 for
proposed permanent impacts to a perennial stream. and jurisdictional wetlands resulting
from the construction of a commercial development. Written concurrence is requested
from the North Carolina Division of Water Quality that states that the project complies
40 I-water quality certification. A Pre-construction Notification Application (PCN) is
attached, which includes an Agent Authorization Form.
Site Location
The site is located in Durham County, approximately 3,000' east of the interchange
between Interstate 40 and NC Hwy 751. It is +/- 3.85 acres in size. A stream bisects the
property. Please refer to the attached Figures 1 and 2 for the project's location on a
USGS topographic quadrangle and the Wake County Soil Survey maps, respectively.
Project History
The project was originally part of a larger project which was 'known as the AKC site.
Action ID #'s 199920159 and 199920160 correspond to Nationwide Permits 26 and 14
. that were previously issued for the site. A portion of the NWP 26 granted fill in the area
currently requesting fill, however the permits have expired. The previously issued
permits granted fill in a total of 0.301 acre. The corresponding 401 Pennit was issued by
DWQ Project #98-1122. A site meeting was held with Mr. Todd Tugwell of the USACE
on Dec 10, 2004 to confirm the jurisdictional boundaries.

Project Description
The project is the construction of a branch b<;mk and includes impacts to jurisdictional
wetland and perennial stream channel resulting from the fill required to construct the
parking area and a storm water retention area. Proposed impacts are described in the
attached PCN and detailed on the attached Wetland Impact Map. Proposed impacts
total 227 linear feet of perennial stream channel and 0.09 acres of wetland. Total
cumulative impacts for the property total 0.391 acre of wetland fill and 227 L.F. of
stream channel.
Impervious surface area on site is greater than 30 %. For this reason a stormwater plan is
included which will require approval from the NC DWQ.
Mitigation
In discussing the site plan with Todd Tugwell of the USACE, it was determined that a 1: 1
mitigation ratio will be required for proposed stream impacts (227 LF) and 2: 1 ratio will
be required for wetland impacts (0.18 acre). Payment to the NC- EEP is proposed to
satisfy the mitigation requirements. A request for 227 LF of stream channel and 0.25 acre
(EEP works in increments of 0.25 acre) of wetland has been sent to EEP. The acceptance
letter will be forwarded to you when it is sent to us.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Due to the size of the property the proposed impacts are necessary to allow the construction
of a sufficient parking area for the bank as well as a stormwater retention area. needed to treat
the stormwater run-off from the proposed impervious surface area.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application

lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h20.enr.state.nc.us/ncwetlands/stnngide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

Bio-retention Area Operation & Maintenance Guidelines
Plantin!! Soil:
Care should be taken that the planting soil of the basin does not become overly acidic due
to stormwater runoff. It is recommended that testing of the soil be conducted at least once
or twice per year. Testing is to encompass pH measurements as well as heavy metal and
toxin accumulation data. When soil pH exceeds an acidity of pH 5.5, limestone or
another suitable alkaline agent should be added to the soil. Toxin laden soils should
removed and disposed of properly.
The following table describes a typical maintenance schedule as recommended by the
North Carolina Department of Envirorunent and Natural Resources. Adherence to this
schedule will prolong the operational life of the rain garden.

Dear Mr. Tugwell and Ms. Ka'oly:
On Fcbruary 3, 2005, :,&EC requcsted authorization from the US Army Corps of
Engineers (USACE) and the NC-Division of Water Quality (DWQ) to utilize Nationwide Permit
(NWP) 39 and GC #3402 for be purpose of impacting 0.09 acres of wetland and 2271i11ear feet
of perennial stream. At this tine, 77 days have lapsed since the US Anny Corps of Engineer's
receipt of the complete precon:;tmction notification. To paraphrase the Federal Register (Vol. 67,
No. 10, section 13.a.l), tht: pennittee may.begin the proposed work if the USACE has not sent
any written notices (i,e. the peImit itself or any notice of an incomplete submittal, etc.) within 45
days of the District or Division Offic~ of the USACE receiving the complete permit application.
Similarly the DWQ's 40 I.Pernit process has a 60~day period of review. If no wntten response is
received within this time perio,I, the 40l-permit is waived/granted, Because both the 404 and the
401 permits were waived the a:lplicant intends to proceed with construction as proposed in the
permit application inunedi~te1y. Typically, the USACE requires that mitigation be completed or
paid for prior to work beginning on site, however the NC-EEP does not have the necessary
documentation from either the DWQ or the USACE to process this payment. Once the penuits
are issued and the EEP can provide the applicant with a receipt the mitigation payment will be
made.
