Fulcher's has processed and/or packed crab, shrimp and fish, in addition to discharging boiler blowdown and non -contact cooling water, via four (4) designated outfalls [species -specific under 40CFR §408 Subparts L, B, and U]. The facility was first permitted in 1980 but destroyed by fire in year 2000. Since then, the Permittee has regularly requested permit renewal, but operations have remained dormant through three permit cycles until recently. RECEIVING STREAM This facility discharges within the Oriental Restricted Area No. 2, [classified SC; NSW; HQW] under tidal conditions to the south side of Oriental Harbor [mouth of Raccoon Creek, segment 27-129-8], ultimately flowing into the Neuse River Estuary classified SA; HQW; NSW (see permit map). This receiving waterbody is not listed as "impaired" except as "nutrient sensitive" (NSW). Seasonal operations depend on the catch. In November 2018, the Permittee resumed discharging, but the startup reporting did not match the speciated effluent tables. Reporting has compromised compliance evaluation under NC State and federal guidelines 40CFR 408. Fact Sheet- updated May2019 NPDES Renewal NC0003174 Page 1 COMPLIANCE ISSUES Despite written direction to notify the Washington Regional Office (WARO) prior to discharge startup, Fulcher's began discharging in November 2018 without notifying DWR. Since then, WARO has cited them for various reporting violations, and the Central Office has subsequently cited the Permittee for repeated failure to submit DMRs since January 2019. Moreover, this facility has failed to register for the eDMR program. LIMIT CALCULATIONS - CHANGES FOR RENEWAL Currently stated production and reporting requirements have prompted DWR to revise the Effluent Tables for renewal, as follows: 1. Outfall 001 hereby designated Non -Process -Contact Wastewater for seafood -washing and packing, reported on the renewal application as "crab washing only." 2. Outfall 002 reinstated as Non -Breaded Shrimp Processing [40CFR 408, Subpart L]. 3. Outfall 003 reinstated as Manually -Processed Bottom Fish [40CFR 408, Subpart U] 4. [DRAFT Outfall 004 Deleted - hereby discontinued as a "technical error' because crab - processing activities are not conducted at this facility [crab -shell washing only] (Manually - Processed Blue Crab, 40CFR 408, Subpart B]. Limits and Monitoring Requirements have been revised for Outfalls 001, 002 and 003 in accord with the Permittee's stated shrimp production (30k lbs/mo) and are consistent with categorical Federal Guidelines 40 CFR 408 Subparts L and U [see sections A. (1.), A. (2.) and A. (3)]. However, these calculations were considered but not applied (see below, Final Limit Calculations). Outfall 002 — Non -Breaded Shrimp Processing, Subpart L. These limits are hereb\ waved as "less stringent" than state limits for TSS and O&G applied to similar facilities statewide [BPJ] as follows: • O&G =15 mg/L MA; 20 mg/L DM => 7.5 mg/L MA; 10 mg/L DM • TSS = 30 mg/L MA; 45 mg/L DM => 15 mg/L MA; 22.5 mg/L DM Note that State limits have been further cut in half (x 0.5) in accord with DWR's monitoring strategy to protect a receiving -stream classified High -Quality Waters (HQW).
