Location Project is located at the Grassy Island Boating Access Area, adjacent to Mountain Creek, on the north side of Grassy Island Road, west of Cagle Grave Road, east of McRea Road, west of Ellerbe, in Richmond County, North Carolina. (35.0551 N, 79.8767 W) Existing Site Conditions The North Carolina Wildlife Resource Commission (NCWRC) currently maintains a small boating access at this location with a small parking area. Applicant's Stated Purpose The NCWRC purpose is to remove the silt and sand that obstructs the boating navigation channel (aggravated by the new bridge construction) and to remove the stumps and fallen trees from the channel that is making boating on the stream unsafe. Project Description The NCWRC has applied for a permit to dredge approximately 300 linear feet of stream channel adjacent to the boat ramp in order to remove 370 cubic yards of silt and sand (300 CY below Normal High Water) that has accumulated in the navigational channel. The existing channel will not be deepened, just cleared of excess material. The existing channel will be widened to a uniform width of 10 feet, which will allow boat navigation at low water. The excavation will not exceed the existing bottom of the channel but to widen the channel, up to 2.6 feet in depth of material below Mean High Water (MHW) may be removed from the sides of the channel. In order to minimize water quality impacts, the NCWRC plans to do the work when the water level is 3 feet below Normal High Water. The dredged material will be trucked to an upland site owned by the NCWRC, located approximately 8 miles away. This material will be used as upland fill. Stumps and fallen trees within the navigational channel will also be removed to ensure safe boating practices. Cutting of fallen tress will be done with a chainsaw and stumps within the channel will be removed by using logging chains and a trackhoe. This vegetative material will also be trucked to an upland site for disposal. Other Required Authorizations This notice and all applicable application materials are being forwarded to the appropriate State agencies for review. The Corps will generally not make a final permit decision until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act (PL 92-500). The receipt of the application and this public notice in the NCDWQ Central Office in Raleigh serves as application to the NCDWQ for certification. A waiver will be deemed to occur if the NCDWQ fails to act on this request for certification within sixty days of the date of the receipt of this notice in the NCDWQ Central Office. Additional information regarding the Clean Water Act certification may be reviewed at the NCDWQ Central Office, 401 Oversight and Express Permits Unit, 2321 Crabtree Boulevard, Raleigh, North Carolina 27604-2260. All persons desiring to make comments regarding the application for certification under Section 401 of the Clean Water Act should do so in writing delivered to the North Carolina Division of Water Quality (NCDWQ), 1650 Mail Service Center, Raleigh, North Carolina 27699-1650 Attention: Ms Cyndi Karoly by July 5, 2005. Essential Fish Habitat This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson-Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely impact EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. 2 Cultural Resources The Corps has consulted the latest published version of the National Register of Historic Places and is not aware that any registered properties, or properties listed as being eligible for inclusion therein are located within the project area or will be affected by the proposed work. Presently, unknown archeological, scientific, prehistoric, or historical data may be located within the project area and/or could be affected by the proposed work. Endangered Species The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined pursuant to the Endangered Species Act of 1973, that the proposed project will have no effect on federally listed endangered or threatened species or their formally designated critical habitat. Evaluation The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values (in accordance with Executive Order 11988), land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the discharge of dredged or fill materials in waters of the United States, the evaluation of the impact of the activity on the public interest will include application of the Environmental Protection Agency's 404(b)(1) guidelines. Commenting Information The Corps is soliciting comments from the public; Federal, State and local agencies and officials, including any consolidate State Viewpoint or written position of the Governor; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the 3 National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider the application. Requests for public hearings shall state, with particularity, the reasons for holding a public hearing. Requests for a public hearing shall be granted, unless the District Engineer determines that the issues raised are insubstantial or there is otherwise no valid interest to be served by a hearing. Written comments pertinent to the proposed work, as outlined above, will be received by the Corps of Engineers, Wilmington District, until 5 pm, July 12, 2005. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of NC Wildlife Resources Commission Page 3 of 3 January 24, 2005 the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. Describe the overall project in detail, including the type of equipment to be used: Mountain Creek is the navigation channel between Grassy Island BAA and Blewett Falls Lake One part of this project consists of removing built-up sediment from around the base of the boating ramp from a point approximately 50' upstream from the ramp to a point approximately 300' downstream from the ramp. A small trackhoe and a small all-terrain truck will be used for this operation There will be approximately 3000Y of sediment removed below NWI and 370 CY removed overall The sediment will be trucked upland to a NCWRC owned property where it will be used in a controlled fill. The second part of this project consists of clearing; the navigation channel of stumps, snags, and leaning trees (see photos) A trackhoe will be walked along the North bank of the stream and used to pull out stumps A chain saw and logging chains will be used in this operation. The property is lightly forested and in a natural condition at this time. _ 10. Explain the purpose of the proposed work: The channel of Mountain Creek has accumulated silt the past several years. This could be due in part to a new bridge foundation that has been built. Defining the channel with minor excavation will allow use of this facility through a greater variation of water levels. The clearing of the channel is mainly for safety. The stumps that are exposed in the photos are usually covered with water. We have had many complaints from users about boat and motor damage. The leaning trees are very dangerous in that if one should fall while a boat is under it, serious injury could result. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated June 13, 2005. The applicant, the North Carolina Wildlife Resources Commission (NCWRC), has applied for a Department of the Army (DA) permit to dredge approximately 370 cubic yards from the stream channel providing access between the Grassy Island Boating Access Area (BAA) and Blewett Falls Lake. These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). The proposed action would occur in Mountain Creek, a stream flowing into Blewett Falls Lake. The material (370 cubic yards of silt and sand) would be removed from 300 linear feet of the creek. The existing channel would not be deepened, but material would be removed from the sides of the channel to create depths of 2.6 feet at mean high water, presumably related to the maximum water level created by manipulations of dam flow. Stumps and fallen logs that create unsafe boating would be removed from the channel. The Service recognizes the relatively small scale of the proposed work. We also support the five project features listed in the figure designated as "Impact #1." The most important features are that work would be done when water is three feet or more below the normal water level (NWL) and silt fencing would be installed during excavation. No schedule for the proposed work is provided. The Service has reviewed available information on federally-threatened or endangered species known to occur in Richmond County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is located near the boundary of the Mangum and Ellerbe quads. The occurrence data of special status species within these quads can be obtained on the internet at the "Database Search" heading of <http:/iwww.ncnhp.or?i/Pa?Tes/herita?,edata.html >. :r. .k 2 Our review indicates that the NCNHP database has no occurrence records for federally listed species in the immediate vicinity of the project area. Therefore, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. The Corps' requirements under section 7(a)(2) of the Act would be fulfilled. However, section 7 consultation must be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. There are, however, several current records for the Carolina redhorse (Moxostoma sp. 2) in Blewett Falls Lake near the project site. This species is a Federal Species of Concern (FSC) and, as such, is not protected under the ESA. While the Service recognizes the need for maintaining boat access, certain precautions should be employed to protect important fisheries resources. The sensitive period for this FSC is from March 15 through June 1. We recommend that the proposed work should not be conducted during this period. This would not be an issue if the work could be done during the rest of 2005 or early 2006. Since stumps and fallen logs provide important aquatic habitat, we recommend that the removal of such material be limited to the minimum amount necessary to ensure safe navigation. Overall, we do not believe that the proposed activity will have significant adverse and/or irreversible effects on general fish and wildlife resources under our jurisdiction. With due consideration of the recommendations given above and the environmental safeguards listed in the PN, the Service has no objection, from the standpoint of fish and wildlife, to the issuance of a DA permit for the actions described in the PN.
