This is with reference to Nags Head modification submittal for State Permit No. 45-10, acting as
agent for the Town of Nags Head. The major modification to the permit authorizing the current
event was issued on February 12, 2018 and the permit expires on December 31, 2021. The action
proposed in your submittal is to dredge 4 million cubic yards of beach compatible material and
revise the length and location of the constructed dune within revised Reaches 3N, 3S and 4.
In reviewing the information provided, the Division of Coastal Management has determined that the
proposed action is consistent with existing State rules and regulations and is in keeping with the
original purpose and intent of the permit, provided the overall project volume remains unchanged
from that which was previously authorized and the proposed action continues to comply with all
conditions of the permit. This Letter of Authorization serves as approval of the activities
described in your email and revised plans received on April 30, 2019, as further modified by the
plan (Sheet 6) dated and received May 7, 2019. All permit conditions remain in effect.
Please note this does not authorize any work not expressly described above, nor does it eliminate
the need to obtain any other additional state, federal or local permits, approvals or authorizations
that may be required. By copy of this letter we are also notifying the U. S. Army Corps of Engineers
and N.C. Division of Water Resources of our action. If you have any questions concerning the above
or if I can be of any other assistance, please advise.
