ADDITIONAL CONDITIONS
"All walkways located over any portion of the frontal dune shall be elevated in such a manner so that
noportion of the structure, with the exception of the pilings, touches the frontal dune.
Dune disturbance shall be allowed only to the extent necessary for development and if the dune's
protective value is not weakened or reduced. All disturbed areas shall be immediately stabilized
with vegetation.

structure shall touch the dune only to the extent absolutely necessary. In no case shall the access
ways diminish the dune's capacity as a protective barrier against flooding and erosion.
All buildings in the Ocean Hazard AEC shall be on pilings not less than 8 inches in diameter if
round, or 8 inches to a side if square.
All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National I'
Flood Insurance Program. If any provisions of the building code or a flood damage prevention
ordinance are inconsistent with any AEC standards, the more restrictive standard shall apply.

All foundations and structures shall be designed to be stable during applicable fluctuations in ground
elevation and wave forces during a 100-year storm. Cantilevered decks and walkways shall meet
this standard or shall be designed to break-away without structural damage to the main structure.
All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation
under the structure. For those structures so located on the primary dune or nearer to the ocean, the I
pilings shall extend to five feet below mean sea level.

F or all portions of the parking lot located oceanward of the large structure setback line referenced in
Condition No.1 of this permit, no individual section of parking lot may exceed 5,000 square feet in
size. Each parking lot section should be physically detached from adjacent section. This physical
detachment may be accomplished through the use of large expansion joints, unpaved strips of bare
sand or paver stone. The fiinal design for such detachment shall be submitted to and approved by
the Division of Coastal Management prior to the initiation of development.
Any structure within the Ocean Hazard AEC shall be relocated or dismantled when it becomes
imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or
dismantled within two years of the time when it becomes imminently threatened, and in any case
upon its collapse or subsidence. However, if natural shoreline recovery or beach renourishment
takes place within two years of the time the structure becomes imminently threatened, so that the
structure is no longer imminently threatened, then it need not be relocated or dismantled at that time.
This condition shall not affect the permit holder's right to seek authorization of temporary protective
measures allowed under the Rules of the Coastal Resources Commission.

,In order to protect hatchling loggerhead sea turtles, all lights on the building face, including balcony
lights on the ocean side of all structures should be eliminated. Where ocean side lighting is required,
alternatives including shading, screening, or replacing fixtures with modem alternative light sources
should be utilized. Parking lots, streets, tennis courts, walkways, dune crossovers, pools and other
areas requiring lights should be illuminated with light fixtures located close to the ground to
minimize casting direct light on the beach and dunes. For more information on the proper design of

Erosion and Sedimentation Control
The N.C. Division of Land Resources (DLR) approved the project under Erosion and Sedimentation
Control Plan No. Dare-200S-007 on 11/4/04.
Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).

The N.C. Division of Water Quality approved this project under stormwater management rules of the i
Environmental Management Commission under Stormwater Permit No. SW7041005 on 11/7/04. Any
violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit.

8. PROJECT SUMMARY: This permit application involves the construction of a 33-unit condominium
structure with a pool (with hot tubs and equipment building), office/community center parking and a
handicap accessible beach access walkover with a dune-top deck. The complex facility is proposed to
replace the previous on-site, oceanfront structure that was destroyed by Hurricane Isabel in 2003.

Project Setting,
The Durants Station Condominiums project property is located at 56773 NC Hwy 12, Hatteras
Village, Hatteras Island, Dare County, along the Atlantic Ocean. This property was platted on
September 1, 1971, as recorded inDeed Book 179, page 16-23, according to the applicant's agent.
The site ranges in elevation from MHW to 6 feet above the MHW with a 12-foot high man-made
dune along the oceanfront that was reconstructed after Hurricane Isabel. Between the Hurricane
damage, the demolition removal work that occurred after the storm, and the construction of a new
dune by FEMA contractors, most of the original vegetation was removed from the site. Although
some other seaside types of vegetation have re-emerged onsite, the lot is somewhat barren. The
dune has been planted with Uniola paniculata, Ammophila breviligulata. To allow for future re-
construction along this area, by Rule, the official FLSNV Measurement Line was established for
this area by the Division during the winter of 2004 and was officially codified by the CRC 's rule
revision of April 1 , 2004. This measurement line was staked by DCM for this application on June
29,2004.
The North Carolina Environmental Management Commission has designated the waters of the
Atlantic Ocean as 'SB' waters (suitable for swimming) and these waters are closed to the
harvesting of shellfish. The Coastal Resources Commission (CRC) has also designated these
waters as Public Trust Area and Estuarine Water Areas of Environmental Concern (AEC). In
addition, under the designation of the CRe, the land areas west of the shoreline have been
designated as part of the Ocean Hazard System. This area includes the Ocean Erodible Area AEC.
The western limit of this AEC is based upon the current erosion rate of 3.0-feet per year
multiplied by a factor of 60 plus the current lOO-year storm recession factor of 70 feet for a total
distance of 250 feet.
Project Description
This project involves the construction of a 33-unit condominium building with a pool (with 2
hot tubs and an equipment building), an office/community center building, a dumpster pad,
parking areas and a handicap accessible beach access walkover with a dune-top deck. The
facility will include an 8,860 GPD sewage treatment facility with pre-treatment, bioclere
secondary treatment units and a drain field, as well as on-site stormwater retention areas and
associated landscaping. The complex facility is proposed to replace the previous on-site,
oceanfront structure that included these same or similar features and was destroyed by
Hurricane Isabel in 2003.

The footprint of the condominium building, including decks and stairways, but all underneath one
roof will be 12,990 square feet. Although the overall building dimension will be greater than
5,000 square feet, the building has been designed to be pile supported, and in 6 sections, with
firewalls between each section. The firewalls will extend from the ground level to 2.6 feet above
the roofline and each will structurally stand independently and be able to be relocated in the event
of an extreme erosion occurrence. These independent sections have been designed to have the
roofs extend over three stories of floor area. The larger of the sections, 42 feet by 45 feet, would
have a floor area totaling 5,670 square feet. The smaller of the sections, 42 feet by 43 feet, would
have a floor area totaling 5,418 square feet. In both cases, these sections would exceed the 5,000
square feet limit for small structures. If the roofed-over external walkways were excluded from the
total floor area calculations, the larger section would have dimensions of 42 feet by 39 feet, for a
total floor area of 4,919 square feet. The smaller section would have dimensions of 42 feet by 36
feet, and total floor area would diminish to 4,536 square feet. While these floor area dimensions
, would not exceed the 5,000 square feet small structure limit, movement of the individual sections
does not appear possible if the rafters/trusses of the roof are to remain intact.
For all of the above calculations, the approximately 6-foot Oceanside decks have not been included
in the calculations, nor have the three, apparently independently-standing, stairwell structures that
are located outside of the small structure setback.
The office/community center building will be pile supported, with 2 stories, and a footprint of
1,122 square feet. The condominium and community buildings will be located landward of the
small structure setback.
The wastewater treatment facility referenced will be located to the west of the office/community
center building and the drain field will be adjacent to NC 12. The fish cleaning station and trash
dumpster pad will be located near the eastside of the front portion of the property near NC 12.
These facilities, including various sidewalks, will include approximately 2,000 square feet of
impervious surface area and will be located landward of the small structure setback.
Parking areas ar:e proposed in two locations. The primary parking area will be 22,290 square feet
and will be located on the northern portion of the property. This area will be surfaced in concrete
and/or asphalt and will be located landward of the l80-foot large structure setback. Parking will
also be available underneath the condo units. The concrete areas beneath the units appear to total
between 8,064 and 10,656 square feet. This would be regarded as a large structure located forward
of the large structure setback if the individual parking area segments are not suitably isolated from
each other. It has been indicated that these segments will be separated from each other by isolation
joints, as well as from the primary parking area.

Structures that will be located oceanward of the condominiums, but landward of the small structure
setback include a pool with 2-hot tubs, an equipment building, a stormwater retention area, and the
landward extension of a handicap accessible, elevated beach-dune accessway. This structure
extends into the small structure setback and will include a dune top lO-foot by 10-foot deck. A
second stormwater retention area lies at the southeast extremity of the property and is located for
the most part landward of the small structure setback, but with about 1/3 of the structure within
the setback area. The retention areas will not include any impervious surfaces within the setback,
and will receive stormwater from the roof and parking area through a gutter system.
Anticipated Impacts
The proposed fill and land disturbing activity within the Ocean Erodible AEC (including
impervious surfaces) will result in the disturbance of approximately 1.77 acres. Approximately 51
percent of the site will be covered with impervious surfaces. The proposed work will not include
the loss of any wetlands. The proposed condo construction appears to have been designed to be
consistent with CRC rules to limit its size to that of a small structure (i.e. each section of the
structure should be able to be relocated, in that they are self supporting, and the total enclosed
floor area of each individual structure section is 5,000 square feet or less). Other associated
development is proposed within the Ocean Erodible Area AEC setback. All of this additional
development will increase the potential for loss of property from storms and long-term erosion,
and represents additional permanent structural encroachment nearer to public beach areas. There is
no structural development proposed for the setback area that is not specifically authorized by 15A
NCAC 07H.0309(a). The unauthorized development within the setback, portions of one
stormwater retention area, has no associated structure located within the setback. If the parking
areas beneath the condominium units are not satisfactorily isolated from each other, and from the
primary parking area, it would be necessary to construct these parking spaces with the use of clay,
packed sand, or gravel to minimize potential adverse effects on the public trust beach.
The proposed work will allow for the replacement of the original structures but they will be
elevated and constructed so that they can comply with current building rules and better withstand
ocean overflows. This proposal will also provide a handicapped pedestrian access to the beach.

The site is located in the east end of Hatteras Village and the original structures were destroyed during the
storm surge created by Hurricane Isabel. The proposed development is aiming to will replace those
structures which existed prior to the hurricane, and in doing so, bring the site into compliance with Dare
County zoning, building codes, health department rules, NC DWQ stormwater regulations, and CAMA
regulations. The original structures were built prior to zoning in Hatteras Village.
The site is currently vacant and all proposed amenities per the plat will have to be constructed.
The site is included in the area designated as unvegetated beach by the CRC in June 2004.
Bissell Professional Group prepared the attached plans and will apply for state stormwater, septic and
sedimentation and erosion control permits.

Regarding the plat depicting the Stable Natural Vegetation line, as flagged by EPL the plats have been revised to
show that the First Line of Stable Natural Vegetation was flagged by the North Carolina Division of Coastal
Management, Mr. Dennis Hawthorn, and depicts the CRC designation for use in this area.

The plat has been amended to depict the landward extent of the ocean erodible AEC, and the maps have been
revised to show the 60x the 3 feet per year Annual Erosion Rate plus the storm recession line of70 feet.
The plat has been amended to reflect both large structure and small stIucture setbacks for this area. Attached is the
deed for when lot was platted, and shows that the site was platted in 1971.
The parking is concrete and will contain isolation joints, which will make the parking, pads that fall within the 30x
erosion rate less than 5,000 square feet and that area that is behind the 60x setback is one structure larger than
5,000 square feet.
Fire Wall Separation to Allow for the Structures to be considered under the Small Structure Setback:
Mr. Barshis was informed that developing a firewall, which would meet some standard of fire resistant rating,
would allow for this building to be considered a small structure. Under the rules the more exact requirement is
that each unit can stand on its own as an independent unit and should erosion or storm events occur, that structure,
which is less than 5,000 square feet, could be moved independently of the larger structure. The structural engineer
with BPG assures me that block wall and the other alternatives for firewall separation will allow for this to occur.
The plat contains a note confimring that there would be a 3-hour fire resistant separation to allow for the
consideration by the Division of Coastal Management that these would be a small structure. The support of the
notion that these would be able to separate the structures into small structure increments is that the firewall
sections are not stIuctural and cannot be a part of the structural integrity of each of the units. The design of the
firewall will allow for the beam to be placed on piers or columns to allow the bottom floor to wash away in a
storm event and yet allow for the firewall above that point to remain structurally intact. Either the block wall or
firewall design will act exactly the same in providing the separation and ability for the structures to stand
independently. The firewall partition will extend 2 feet 6 inches above the roof of the structure and therefore
breaking the structure into independent units ofless than 5,000 square feet, including the roofline.
Conclusion: The revisions to these plats and additional information should be sufficient to address the
comments noted by the Division of Coastal Management in your September letter.

ITl Review of minutes from last meeting: Questions from members regarding items from last
meeting. Question re: refund of fees from appraiser-money received, refund from contractor consultant-
refund not received yet. Update on dues: Six owners still owe. Total of $6175 still outstanding. Only
option for collecting monies is to put a lien on property. If owners have individual situations, please
submit issues in writing to the Board of Directors. Engineer study done, but $20,000 allotted for that at
last meeting has not been spent yet since the finn has not submitted a bill to DSCA as of meeting date.

and a motion was made for us to vote. Sam McKeen made a motion that we accept Darr Barshis'
proposal of conditions he wished to receive personally in exchange for functioning as the rebuild project
coordinator to include where his units would be placed but not for him to be the sole decision maker in
placement of other units or selection process. Andy Martof seconded. L. Baus abstained from the vote.
All other's present voted in favor of accepting Darr's proposal as indicated.
XIV.Create committees by resolution: The following committees were created by resolution with
membership and duties as listed below:
#159; Executive Liaison Committee: (Sam, Debra ,Shannon, Hunter, Don) Committee's role will
be to keep Darr abreast of the activities, progress, and challenges of each of the other committees. These

minimum Jlequirements of the Act. We, therefore. issue this LETTER OF APPROVAL.

constmction, in!ipectton, and testing activities must be discussed and clearly understood by all parties. Holding
such a preconSb:u.ction meeting must be listed as a condition in tho construction authorization, with atten.dance
required by all key parties prior to the onset of the system installation.
As you are aware, there are a number of times during the installation of this system wh~ inspection by the
health departmcmt must be provided to aid in ensuring the system is installed properly. For this project, make
