Dear Mr. Lilies:
You have our approval, in accordance with the conditions listed below, to impact approximately
2261 square feet (ft) of Zone I and Zone II of the protected riparian buffers for the purpose of
constructing a residence on the subject property as described within your application dated 04 February
2005. This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse
and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots
within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL
CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management
Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or
local permits before you proceed with your project including (but not limited to) Sediment and Erosion
Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006
unless the variance is renewed before that time by the EMC.
This approval is for the purpose and design that you described in your variance request. If you change
your project, you must notify us and you may be required to send us a new request for approval. If the
property is sold, the new owner must be given a copy of this approval and is thereby responsible for
complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:
1. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,

Mr. and Mrs. Lilies owners and Harry Sheing acting as
agent would like you to direct this review to Kyle
Barnes in the Washington office.
We would first like to express our feelings about this process. Mr.
Steve Trowel And Mr. Kyle Barnes has been very helpful with our
concerns. When we first bought this property in 1994 we were
planning on retiring here. We have applied for all the necessary
permits to build a house and had approval in 1999. But due to
financial reasons we decided to wait. Now we have this new issue
that was not brought on by us. This 50 foot extra buffer would
make our lot unbuildable.
This rule we feel is a great rule but should not apply towards us
since we were here previous to these changes.

Dear Mr. Tillman:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.10 acres
of wetlands or waters for the purpose of a residential development, as you described in your application dated August 12, 1999.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106.
This certification allows you to use Nationwide Permit Number 16 when the Corps of Engincers issues it. In addition, you should
act any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 211 .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have
