The DWQ has determined that neither the USGS topo map nor the Wake County Soil Survey show a
surface water within this approximate location. Also, the Raleigh Regional Office of the DWQ have
previously evaluated the pond above this feature and determined it to be exempt from the Neuse Buffer
Rule.
The Division of Water Quality (DWQ) has determined that the surface water labeled as "Evaluated
Surface Water" on the map above is an ephemeral gully, not shown on either the USGS topo map
or Wake County Soil Survey and is, therefore, not subject to the Neuse Buffer Rule. The owner (or
future owners) should notify the DWQ (and other relevant agencies) of this decision in any future
correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
State. If you have any additional questions or require additional information please call me at (919) 733-
