This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0233(9)(b). In addition to this approval, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Water Supply, Watershed Protection regulations. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If thc property is sold, the ncw owncr(s) must bc given a copy of this variance approval and is thercby responsiblc for complying with all conditions. This approval requires you to follow any conditions listed below. Thc Additional Conditions of the Ccrtification are: 1. No Zone 1 Impacts No impacts (exccpt for uscs as idcntified within 15A NCAC 2B .0233) shall occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ. No impervious surfaces shall be added to Zone 1, unless otherwise approved by the DWQ. Buffer Mitigation (WRP) You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 1,503 square feet as required under this variance approval and 15A NCAC 2B .0242. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0233, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0242(9)(C). Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts specified in this variance approval shall occur. For accounting purposes, this variance approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 1.503 ft2 of required riparian buffer mitigation for impacts to 1,002 ft2 of protected riparian buffers; 03-04-02,27-43-3 river and subbasin." The DWQ will also accept an alternative method of mitigation (including but not limited to Buffer Restoration or Enhancement) pursuant to'the Buffer Mitigation Rule (15A NCAC 02B .0242) to satisfy this mitigation requirement. If you choose to pursue this option, then you are required to submit in writing a mitigation plan to the DWQ Wetlands/401 Unit for review and approval. No impacts shall occur to the protected buffers until the mitigation plan is approved by the DWQ. 2. Protective Fencing - The construction corridor approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer prior to any land disturbing activities to ensure compliance with 15A NCAC 2B .0233 and this variance approval. A sedimentation control fence installed along the boundary of Zone 1 and Zone 2 (but not within Zone 1) of the protected buffer will satisfy this condition. This fence must be removed and any disturbed areas (outside of the proposed footprint of the house and driveway) shall be revegetated once construction is complete. 3. Diffuse Flow and Stormwater Management An additional condition is that all stormwater from the impervious within Zone 2 shall be directed away from the riparian buffer and released as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0233(5). 4. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable BufferRules, and any subsequent modifications, the applicant is required to Fischetti Page 3 of3 3/9/05 return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Requests for appeals ofthis decision shall be made to the Office of Administrative Hearings. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. This Minor Variance Approval shall expire five (5) years from the date of this letter. This is a variance for a house being built with parts of the house and driveway in Zone 2; I don't have any significant comments regarding this project as it doesn't look like there are too many options for house placement (who buys a lot in 1980 and builds in 2005???). I assume we will address the need for diffuse flow from gutter downspouts and stormwater flow off driveway pavement in the approval letter. Also may need to comment on where they are putting utility things (e.g. pad-mounted air conditioners, etc.). My comments are on Filemaker. Have a great weekend!!! Include the area of buffer impact in ft2.]: The requested activity reQuirinq a minor variance is the construction of a sinqle-family home (see attached buildinq footprint). Proposed impervious area within Zone 2 of the riparian buffers will total 1.002 fe and will result from a portion of the driveway and a portion of the house. 2. State reasons why this plan for the proposed activity cannot be practically accomplished. reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers: The property was purchased in October of 1980 (i.e. 17 years prior to the Neuse River Riparian Buffer Rules) by the current landowner with the intent to build a home. The lot was oriqinally platted in October of 1973. Approximately 40% (+/- 6500 ff in buffer) of the +/-16.400 ff lot is now within the Neuse Riparian Buffers. Because the property was purchased prior to the buffer rules the oriqinal site plan called for portions of the house to be constructed within what is now considered Zone 1 of the riparian buffers. The site plan has since been redesiqned to remove the previously proposed impervious area out of Zone 1 and Variance Request Fonn, page 2 Version 2: November 2000 reduce the amount of impervious within Zone 2. The lot has a buildinq offset from the road, a utility easement, and the lot lines thereby Iimitinq how the home can be positioned. There is also a siqnificant qrade chanqe from the front of the lot to the back. The portion of the driveway within Zone 2 is required to access the qaraqe from the side of the home on a "basement" level. Most of the homes in this area are front access qaraqes on qround level or side access on qround level. Due to the sever sloop of the property and the lot confiquration this type of qaraQe access is not possible. The driveway is needed to turn the vehicles around. The proposed construction will utilize multiple floor levels and retaininq walls to minimize the overall impacts. 3. Description of any best management practices to be used to control impacts associated with the proposed activity (Le., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): The proposed activity does not propose any best manaqement practices. This would require disturbance of the remaininq areas of the lot and cannot be practically constructed. However the property owner does propose to spend a significant amount of money constructinq foundation and retaininq walls to minimize the disturbed areas. 4. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. If the buffer rules are strictly applied the lot can not be built on with the same size homes that are typical of the surroundinq lots and that is needed by Mr. Fischetti on a lot that has been platted for 30 years and owned for 24 years. (2) How these difficulties or hardships result from conditions that are unique to the property involved. Because the lot was platted and purchased prior to the buffer rules almost half of the lot is within the now established riparian buffers with additional areas within a buildinq offset and a utility easement. (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. The property owner purchased the lot prior to the buffer rules with the intent to build a home however due to the area covered by the buffers on the property a home sized appropriately to the subdivision cannot be constructed, which qreatly decreases the resale value of the subiect property and qreatly restricts the oriQinal intent of the owner which was to build his home. If a much smaller home is constructed the surroundinq home values will depreciate. Part 3: Deed Restrictions By your signature in Part 5 of this application, you certify that all structural stormwater best management practices required by this variance shall be located in recorded stormwater easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot. Include the area of buffer impact in ft2.]: The requested activity requirinq a minor variance is the construction of a sinqle-family home (see attached buildinq footprint). Proposed impervious area within Zone 2 of the riparian buffers will total 1 ,002 ft2 and will result from a portion of the driveway and a portion of the house. 2. State reasons why this plan for the proposed activity cannot be practically accomplished, reduced or reconfigured to better minimize or eliminate disturbance to the riparian buffers: The property was purchased in October of 1980 (Le. 17 years prior to the Neuse River Riparian Buffer Rules) by the current landowner with the intent to build a home. The lot was oriqinally platted in October of 1973. Approximately 40% (+/- 6500 fe in buffer) of the +/-16.400 fe lot is now within the Neuse Riparian Buffers. Because the property was purchased prior to the buffer rules the oriqinal site plan called for portions of the house to be constructed within what is now considered Zone 1 of the riparian buffers. The site plan has since been redesiqned to remove the previously proposed impervious area out of Zone 1 and Variance Request Fonn, page 2 Version 2: November 2000 reduce the amount of impervious within Zone 2. The lot has a buildinq offset from the road, a utility easement, and the lot lines thereby Iimitinq how the home can be positioned. There is also a siqnificant qrade chanqe from the front of the lot to the back. The portion of the driveway within Zone 2 is required to access the qaraqe from the side of the home on a "basement" level. Most of the homes in this area are front access qaraqes on qround level or side access on qround level. Due to the sever sloop of the property and the lot confiquration this type of garaqe access is not possible. The driveway is needed to turn the vehicles around. The proposed construction will utilize multiple floor levels and retaininq walls to minimize the overall impacts. 3. Description of any best management practices to be used to control impacts associated with the proposed activity (Le., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): The proposed activity does not propose any best manaqement practices. This would require disturbance of the remaininq areas of the lot and cannot be practically constructed. However the property owner does propose to spend a siqnificant amount of money constructin!1 foundation and retaininq walls to minimize the disturbed areas. 4. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. If the buffer rules are strictly applied the lot can not be built on with the same size homes that are typical of the surroundinq lots and that is needed by Mr. Fischetti on a lot that has been platted for 30 years and owned for 24 years. (2) How these difficulties or hardships result from conditions that are unique to the property Involved. Because the lot was platted and purchased prior to the buffer rules almost half of the lot is within the now established riparian buffers with additional areas within a buildinq offset and a utility easement. (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. The property owner purchased the lot prior to the buffer rules with the intent to build a home however due to the area covered by the buffers on the property a home sized appropriately to the subdivision cannot be constructed. which qreatly decreases the resale value of the subiect property and qreatly restricts the oriqinal intent of the owner which was to build his home. If a much smaller home is constructed the surroundinq home values will depreciate.
