Dear Mr. Tucker:
The Asheville Regional Office on the NC Division of Water Quality (DWQ) is in receipt of
your request to modify the issued Water Quality Certification # 05-0074, dated July 21,
2005. The DWQ did not give authorization for this impoundment due to the "after the fact"
nature of the application and lack of a justification in the submitted application. The
following should clarify further the DWQ's decision:
Under Section VII. (Avoidance and Minimization) of the Pre-Construction Notice
requires a complete and thoughtful discussion as to the need for the proposed
impoundment. No discussion as to what steps were taken to avoid the impacts
associated with the impoundment were included in the application.
Should you choose to further pursue this request, a complete PCN form must be
submitted which clearly explains why no practicable alternative to constructing the pond
exists.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Carrick:
You have our approval, in accordance with the attached conditions and those listed
below, to place fill within or otherwise impact 0.02 acres of lake shore at the subject
property, as described within your application received by the N.C. Division of Water
Quality (DWQ) on July 21, 2005. After reviewing your application, we have decided that
the impacts are covered by General Water Quality Certification Number(s) 3492
(GC3492). The Certification(s) allows you to use Nationwide Permit(s) 30 when issued
by the US Army Corps of Engineers (USAGE). In addition, you should obtain or
otherwise comply with any other required federal, state or local permits before you go
ahead with your project including (but not limited to) Erosion and Sediment Control,
Non-discharge, and stormwater regulations. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new
application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all
conditions. If total fills for this project (now or in the future) exceed one acre of wetland
or 150 linear feet of stream, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in
the attached certification and any additional conditions listed below.

1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific
and general conditions of this Certification (or Isolated Wetland Permit) are met.
No other impacts are approved including incidental impacts:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all
specifications governing the proper design, installation and operation and
maintenance of such Best Management Practices in order to protect surface
waters standards:
a. The erosion and sediment control measures for the project must be
designed, installed, operated, and maintained in accordance with the most
recent version of the North Carolina Sediment and Erosion Control Planning
and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and
erosion control measures must be such that they equal, or exceed, the
requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual. The devices shall be maintained on
all construction sites, borrow sites, and waste pile (spoil) projects, including
contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be
designed, installed, operated, and maintained in accordance with the most
recent version of the North Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the
reclamation in accordance with the requirements of the Sedimentation
Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian
areas beyond the footprint of the impacts depicted in the Pre-Construction
Notification. All construction activities, including the design, installation, operation,
and maintenance of sediment and erosion control Best Management Practices,
shall be performed so that no violations of state water quality standards, statutes,
or rules occur.

4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters
to the maximum extent practicable. If placement of sediment and erosion control
devices in wetlands and waters is unavoidable, they shall be removed and the
natural grade restored within six months of the date that the Division of Land
Resources has released the project.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification
or applicable Buffer Rules, and any subsequent modifications, the applicant is
required to return the attached certificate of completion to the 401/Wetlands Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC,
27699-1650.
6. Diffuse Flow (No Review)
All constructed stormwater conveyance outlets shall be directed and maintained
as diffuse flow at non-erosive velocities through the protected stream buffers
such that it will not re-concentrate before discharging into a stream.
7. Protective Fencing
The outside buffer, wetland or water boundary and along the construction
corridor within these boundaries approved under this authorization shall be
clearly marked with orange warning fencing (or similar high visibility material) for
the areas that have been approved to infringe within the buffer, wetland or water
prior to any land disturbing activities.
8. Turbidity Standard
The turbidity standard of 10 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B. .0200. Appropriate sediment and
erosion control practices must be used to meet this standard.

10. Deed Notifications
Deed notifications or similar mechanisms shall be placed on all retained
jurisdictional wetlands, waters and protective buffers in order to assure
compliance for future wetland, water and buffer impact. These mechanisms shall
be put in place prior to impacting any wetlands, waters and/or buffers approved
for impact under this Certification Approval and Authorization Certificate. A
sample deed notification can be downloaded from the 401/Wetlands Unit web
site at http://h2o.enr.state.nc.us/ncwetlands. The text of the sample deed
notification may be modified as appropriate to suit to this project.
11. Temporary Fills
All temporary fill and culverts shall be removed and the impacted area returned
to the original grade, including each stream's original cross sectional dimensions,
planform pattern, and longitudinal bed and bed profile after construction is
complete or within 6 months of the establishment of the crossing, which ever is
sooner, and the various sites shall be stabilized with natural woody vegetation
(except for the maintenance areas of permanent utility crossings) and restored to
prevent erosion. If the crossings are not completely removed and restored as
described above within the specified time above, additional written approval from
this Office must be obtained to modify this condition.
12. Culvert Installation
Culverts required for this project shall be installed in such a manner that the
original stream profiles are not altered. Existing stream dimensions (including the
cross section dimensions, pattern, and longitudinal profile) must be maintained
above and below locations of each culvert. Culverts shall be designed and
installed to allow for aquatic life movement as well as to prevent head cutting of the
streams. If any of the existing pipes are or become perched, the appropriate
stream grade shall be re-established or, if the pipes installed in a perched manner,
the pipes shall be removed and re-installed correctly.
Culvert(s) shall not be installed in such a manner that will cause aggradation or
erosion of the stream up or down stream of the culvert(s). Existing stream
dimensions (including the cross section dimensions, pattern and longitudinal
profile) shall be maintained above and below locations of each culvert. Therefore,
you must provide plans with adequate details that indicate that the current stability
of the stream will be maintained or enhanced. You must receive written approval
from this Office for the above plans before the culvert(s) is installed. Culvert(s)
must be installed according to approved plans.
The establishment of native, woody vegetation and other soft stream bank
stabilization techniques must be used where practicable instead of rip rap or other
bank hardening methods. If rip-rap is necessary, it shall not be placed in the
stream bed, unless specifically approved by the Division of Water Quality.

Installation of culverts in wetlands must ensure continuity of water movement and
be designed to adequately accommodate high water or flood conditions.
Upon completion of the project, the Applicant shall complete and return the
enclosed "Certificate of Completion" form to notify NCDWQ when all work
included in the §401 Certification has been completed. The responsible party
shall complete the attached form and return it to the 401/Wetlands Unit of the NC
Division of Water Quality upon completion of the project.
13. Trout Moratorium
The stream is a Class Water Supply 3, High Quality, B Trout Waters. In order to
protect downstream uses for these waters a requirement of this Certification is
that any additional work conducted within the stream may not occur between the
dates of October 15 through April 15.
Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application and
as authorized by this Certification, shall expire upon expiration of the 404 or CAMA
Permit.
If you do not accept any of the conditions of this Certification (associated with the
approved wetland or stream impacts), you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition, which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you
ask for a hearing.

With regard to the 401 Certification issued by your office, we would like to request
approval for the 75 linear feet of flooding not mentioned in your approval. The wetland
impacts for flooding were included within the certification.
It has always been the developer's desire to include a trout pond in this project. We
worked with the developer to avoid and minimize impact from this pond and maximize
benefit. Due to the topography on site we suggested a smaller pond than initially
planned. We also suggested locating the pond above the road in order to avoid
additional hard impacts to the stream channel. Since the road will function as the dam,
there will be no new hard impacts associated with the proposed pond.
We also encouraged the developer to stock this pond with trout and chose this tributary
because in an electro-fishing trip with the NC WRC no trout were found in this tributary.
We feel that the presence of trout will improve the ecological function of these waters.
The perimeter of the pond will be planted with native species and a few specimen
plants.
We received approval for the impacts from the Corps and just received a copy of the
401 to realize that these flooding impacts were not addressed.

The purpose of this letter is to request written authorization for stream channel and
linear wetland impacts under Nationwide Permits 39 for the project known as Black
Bear Falls in Jackson County, North Carolina. The road crossing impacts have already
been completed. The pond impacts are proposed. The developer has completed
permanent channel impacts associated with the construction of eight road crossings
(NW 39) and the excavation/flooding of an aesthetic pond at the main entrance
(NW39). This proposed activity is located in Jackson County and is within lands owned
by Camp Creek Associates, LLC.
The attached US-GS topographical maps and aerial photograph show the location of the
project. Impacts are shown on the attached site plan map inserts. Channel and linear
wetland impacts total 297 linear feet and 0.013 acre under Nationwide Permit 39 for
the construction of eight permanent road crossings to facilitate access to the property
and for the construction of a small aesthetic / fish pond at the main entrance to the
project There were existing culverts at all of the road crossings. These pipes were
undersized for the flow regimes passing through. Some of these pipes were completely
buried with sediment.
The 40 linear feet of fill below Road Crossing #8 will be removed and restored as
requested according to the attached Restoration Plan and thus has not been included
within the impacts for the project The grading contractor is planning on accessing this
area with a small track hoe to avoid having to cut many trees. I am now in close contact
with Mr. Ricky Cook (grading contractor) and will monitor this restoration effort

The site is primarily forested with some open field areas. See the attached site plan
sheets for the location of each impact All streams are considered to be either
perennial or intermittent and important in aquatic function. Typical data forms for the
streams and wetlands on site are included within this application for your reference.
The North Carolina Division of Water Quality (NC DWQ) records Camp Creek as C
Waters.
All parties involved with this project have worked closely to minimize channel and
wetland impacts to the greatest extent possible and have utilized most of the existing
road infrastructure on site. There was miscommunication among the design team about
whether replacing existing culverts required a Corps/NC DWQ permit. As an
avoidance and minimization measure the developer has agreed to utilize arched spans at
all remaining stream crossing. There may be as many as six additional crossings. Two of
these stream crossings are not even on the property. These two crossings are on the
main road leading to the property which is maintained by the homeowners associations
of Camp Creek. The costs to install arched spans will be double that of the costs for a
pipe. The grading contractor did mention to me that the EPA employee who lives near
the site had been on site and had instructed him on how to install the rip-rap check
dams along the ditches of the roads.
For compensatory mitigation, as specified in the table above, 4455 linear feet of streams
and 0.13 acres of wetlands will be placed in protection under a conservation easement
with the Ecosystem Enhancement Program. I have spoken with them over the phone
preliminarily and they indicated that they would accept the proposed mitigation. The
remaining streams and wetlands on site are within the open space will be buffered as a
mitigative measure by a minimum of thirty feet. Native woody and herbaceous
vegetation will be re-established up and downstream of the stream road crossings and
around the pond. Our request is to have the 401 read that these deed notifications be
recorded as the lots are platted within each phase since construction schedules of the
future phases are uncertain at this time. The site plan has not been finalized in the
future phases either due to the lack of an accurate topography map. This data is due
back to the land planner on January 18, 2005. The following language will be used within
the restrictive convenants for the non-EEP mitigation.
Preserves and Buffers.
The Community may include certain tracts identified as
"Preserve" or "Private Preserve" or "Buffer" as may be depicted on a Plat.
Such areas, together with any property located within thirty (30) feet of a
stream, are hereinafter referred to as the "Preserve areas." Unless
otherwise approved in writing by Declarant, the County and any other
governmental authorities having jurisdiction, the Preserve areas shall be
maintained in their natural state in perpetuity. No Owner, member of an
Owner's household, or any other Person acting, or purporting to act, on
behalf of any Owner, or for whom any Owner shall be responsible pursuant to
this Declaration, shall disturb the natural environment of the Preserve
areas in any way without first obtaining the written consent of the Board
properly approved by the adoption of a resolution describing in detail the
exact activities to be conducted within the Preserve areas, the times and
dates when such activities are authorized to occur, and the identities of
the Persons who are authorized to so act, together with the written consent
of Declarant and any governmental authority having jurisdiction over the
proposed activity.
This restrictive covenant is intended in the broadest sense,
and includes, but is not limited to, trimming, cutting, or mowing grass,
shrubs, trees or other plants; placing grass clippings, landscape debris,
household trash or other materials; storing materials, equipment, vehicles,
boats, motor homes, trailers, or other items; erecting children's
playhouses, tree houses, swings, or other permanent or temporary
improvements; planting trees, shrubs, grass, or ground cover; releasing
birds, snakes, reptiles, insects, or other animals; grading or excavating;
cultivating or gardening; or dumping dirt, sand, rocks, gravel, or other
inorganic or organic material on any part of a Preserve area. No hunting or
animal trapping, carrying or discharging of firearms, overnight camping or

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

forested.
10. Describe the overall project in detail, including the type of equipment to be used:
Road Access for eight Creek Road Crossings in Order to Access High Ground for Site
Development have been Installed. These eight crossings were existing road crossings and
have been either replaced or replaced and extended to accommodate the wider road. The
remaining creek crossings (six) will be arch half piped to avoid additional impacts. Proposed
construction of a residential community. There will be no amenity area such as a clubhouse.
The current and proposed discharges are limited to 297 linear feet of streams and 0.013 acres
of wetlands. The project is further detailed in the narratives.
11. Explain the purpose of the proposed work:
The project will provide a housing community to the surrounding area. Impacts were
necessary to access high around. All eight road crossings are at locations where there was an
existtng pipe before development began.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
Corps Notice of Unauthorized Activity and NC DWQ Notice of Violation have been issued for
pipe replacements and extensions without a 404/401 permit. No work has been completed on the
proposed pond.
V. Future Project Plans

and provide justification for the exclusion of this work from the current application.
No Future Permits Anticipated Construction work at all remaining creek crossings will utilize
arched half pipes with headwalls.

wetlands, open water, and stream channels associated with the project. The applicant must also

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetiands/strm.gide.litmi.

Executive SummM
The Developer of Black Bear Falls proposes this restoration plan to satisfy a Notice of
Unauthorized Activity issued by the US Army Corps of Engineers and a Notice of
Violation issued by the North Carolina Division of Water Quality for unauthorized
impacts totaling 40 linear feet of fill below Road Crossing #8 as labeled on the enclosed
within the permit application. The plan, as outlined within this document, serves as
guidance for the proposed restoration for compliance. The after-the-fact permit
application is enclosed to satisfy the requirement to obtain permits for the previously
impacted areas.
Restoration will be:
• removal of existing fill from stream
• allow stream flow through channel once again
• stabilization of stream bank with fine grading, if necessary
• re-vegetation along this reach of stream

The restoration of these areas will have oversight by WNR, Inc. staff to ensure proper
installation, planting, and removal of structures on site and to propose alterations during
construction, if necessary. Restoration success will be measured in terms of percent
herbaceous coverage and stream condition. There were no existing woody trees or
shrubs along this reach of stream because it was an old road bed. However, woody
vegetation is included within this restoration plan because vegetation will be planted along
portions of the stream as part of the landscape planting plan for the development in areas
that lack sufficient vegetation. The stream bank will be stabilized with herbaceous
vegetation immediately in this area and then the woody vegetation will be planted in the
spring of 2005.
Planting Plan and Specifications
The area will be planted with the appropriate species once the restoration work is
complete. The shrub species will be planted at a denser ratio toward the inner and outer
edge of the stream buffer to reduce light penetration and re-colonization by invasive
exotic species. A listing of species is found below; additional species may be selected as
needed, due to availability and site need.
The planting arrangement will be on 13 X 13 foot spacing for tree species that will
produce 258 stems per acre. The shrubs will be on 10 X 10 foot spacing, which will
result in 436 stems per acre. A tree shelter may be used to accelerate growth and
increase survivability. Some specimen trees and shrubs may be incorporated into the plan
due to the high visibility of the area.
The objective will be to mimic most of the natural buffer that should be in this area,
which is to be composed of grasses, other herbaceous species, shrubs, and trees. The
planting area will be 30' wide adjacent to the fill area and will be planted with herbaceous
and woody material. The site will be prepared accordingly and be planted as described
below and with all appropriate soil amendments.

Plant Material Specifications
Bare Root or Container (Herbaceous):
The plants will either be ordered as bare root or in I -quart containers. Plants will be
planted immediately upon delivery. Plants will be stored in shade and kept moist
otherwise. Once planted, the specimens shall appear healthy with no leaf spots, leaf
damage, leaf discoloration, chlorosis, leaf wilting or curling, or evidence of insects on
leaves or stems.
Balled and Bagged (Woody Plants):
The size of the earthen ball shall at least meet the minimum requirements in the
American Standard for Nursery Stock (1980). Where plants are to be planted in
saturated soils, the bagged root ball shall have a surface diameter that is at least '/2 of the
diameter of the un-pruned drip-line and a depth that is at least 8" per S' of tree/shrub
height The hole for the tree/shrub will be the rootball diameter plus 12" around the
outer edge. The crown of the rootball will be placed I" above finish grade.
Plants will be planted immediately upon delivery. If this does not occur, plants shall be
stored in shade and root balls kept moist through periodic watering until the time of
planting. Once growing, the plants shall appear healthy with no leaf spots, leaf damage,
leaf discoloration, chlorosis, leaf wilting or curling, or evidence of insects on leaves.
Container (Woody Plants
The soil within the root ball shall be field capacity (1/3 atmosphere) or wetter upon
delivery to the job site. Any wilted, dry and/or lightweight plants shall be rejected. Plants
shall be planted immediately upon delivery. If not then they must be stored in shade and
root balls kept moist through periodic watering until time of planting.
The shrub species will be either 2' to 3' or 3' to 4' in height The tree species will be 8'
to 10' for the Red Maples and 7' minimum for the Willow and Sycamores. Soil and root
masses must at least meet the minimum required container size. If soil/root masses are
substantially smaller, soil around the root mass is loose, indicating the plant has not been
in the container long enough to root itself, it shall be rejected.
If growing, plants shall appear healthy with no leaf spots, leaf damage, leaf discoloration,
chlorosis, leaf wilting or curling, or evidence of insects on leaves.
For trees and shrubs, where spiraling woody roots exist on the outside of the soil/root
mass upon the removal of plants from the containers, the landscape contractor shall
separate (cutting where necessary) and spread them out prior to planting.
Planting Specifications
All areas between shrubs/trees will receive 3" of mulch. The contractor will assure
percolation of all planting beds/pits prior to installation. Large trees will be anchored into
the ground with a `Duckbill' Model No. 88-DTS-0 earth anchors or approved equal.
Evergreen trees will be anchored with three 2"x2"x8' evenly spaced stakes and tied with
recycled tire tree ties as manufactured by Grostrait or approved equal to promote a
straight growth pattern and prevent wind impacts.
Fertilization
Woody Vegetation:
Fall/Winter plantings-Use Osmocote 18-5-11, twelve to fourteen month release fertilizer,
to be placed in hole or in soil fill/amendment mix at planting. Use grams (I ounce) per I -
quart container, 90 grams (3 ounce) per I -gallon container (30 grams per each additional
gallon). Use 15 grams (I ounce) per un-rooted cutting for willow whips (if used).
Soil Amendments:
Soil amendments are required around tree and shrub plantings. The amendments used
should be leaf or pine bark compost at rates of one part compost to one part soil (from
planting hole). Fertilizer should be mixed in with soil amendment mix. No surface mulch
is required where plants are planted at or near original grade, unless tree shelters are
used to promote growth and survival percentage. A 6" soil berm will be constructed 12"
from the outer edge of the rootball to hold water.
Timetable for Restoration
Once the infrastructure within the areas proposed for restoration has been completed,
the restoration work will begin. The following timetable is presented for restoration
work once the construction is complete. Ranges are given below to allow for rain days
and other unexpected delays. Since this is a highly visible area, it will be in the best
interest of the developer to restore these areas as quickly as possible once work has
been completed.
• 2 weeks to restore the stream banks to original condition
• 1 week to install the vegetation in the spring of 2005
• flow will be allowed to return to stream beds once the fill has been removed
Depending on weather conditions, the restoration work can be completed within one
month following your approval. Photographs of the restoration area will be taken and
forwarded to the Army Corps and NC DWQ office once all restoration work is
completed.
