Thanks for getting this modified Certification out the door. I do have a question
regarding Condition No. 8 requiring an SMP. This project is essentially constructed
(roads and infrastructure in, lots graded, some homes built, etc.). The plans have not
changed since the previous 401 was issued. The site plan approved showed the impact, but
the previous consultant just inadvertently failed to call it out as an impact and
formally request it. The amount of impact is very minor (less than 1/loth), bringing the
original 0.18 acres of approved wetland impact up to 0.212 acres.
An SMP was approved for the project as per Condition No. 6 of the previous Certification.
The development and approved BMPs are being constructed as per this approved plan.
Could you please change this modified Certification to reflect this?

6. Written Storinwater Management Plan (No Further Approval Needed)
The final, written stormwater management plans (including a signed and notarized Opera
Maintenance Agreement), must be implemented and the stormwater management facilitie
be constructed and operational before any ]permanent building is occupied at the subject s
structural stormwater practices as approved by this Office as well as drainage patterns mu
maintained in perpetuity. No changes to the structural stormwater practices shall be made
written authorization from the Division of Water Quality.
