Project Description 3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project area consists of an undeveloped forested parcel, with on-site elevations ranging from 670-740 feet above mean sea level (Figure 2). Land cover within the project area consists of deciduous forest, mid -successional mixed forest, and forested wetlands (Figure 3). According to the United States Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS) Web Soil Survey of Gaston County (Figure 4) and the NRCS 1989 Soil Survey for Gaston County (Figure 5), current and historic on-site soils consist of eight different soil types (Table 1). Of the on-site soils, two are listed on the Web Soil Survey as containing hydric inclusions. 3b. List the total estimated acreage of all existing wetlands on the property: 0.525 ac. 3c. Explain the purpose of the proposed project: The purpose of this project is to construct a residential subdivision which will provide needed housing in Gastonia, NC, a rapidly growing suburb of Charlotte. Page 3 of 13 PCN Form —Version 1.4 January 2009 Describe the overall project in detail, including the type of equipment to be used: The project proposes to disturb 146 wooded acres to construct a residential development on Gaston County tax parcel 3562776203. The site will be cleared and graded in preparation for construction. Site preparation will involve the installation of a 100 ft, 60" corrugated metal pipe (CMP) culvert within intermittent Stream B that will result in 120 If of permanent impacts (S1) and 20' of temporary impacts up and downstream of the culvert due to dewatering and retaining wall construction (S2) (Attachment D). Permanent impacts to Stream B will total 120 If. Temporary impacts to Stream B will total 40 If. In accordance with regional condition for all nationwide permits 3.6.1., the culvert will be buried 1 ft below the bed of the stream. These impacts to Stream B result from the need for a road crossing that will connect the northern and southern portions of the site. Plans for proposed grading and development of the Presley Residential Site are shown in Attachment A. Erosion and sedimentation control measures will be installed. Water will be diverted around the construction area. The proposed structure will be placed in line with the stream. The new culvert structure will be a 60" CMP with retaining walls. Water will be pumped around the work area during construction by temporary flexible hose and 10' riprap pits upstream and downstream of the proposed pipe. Equipment to be used includes a track hoe, dump truck, pumps, various hand tools, possibly a crane to move construction material such as reinforced bars of steel, and concrete buckets to place concrete. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. To avoid and minimize the impacts to jurisdictional waters of the U.S., the Presley residential site was delineated and the results of that delineation informed the final site plans. The site was designed in order to minimize impacts to waters of U.S. as just one stream crossing is proposed. Reiected Alternative- No Build Ootion A 'No build' alternative was considered during the planning of this project. The purpose of the project is to construct a residential subdivision to serve Gastonia, NC, a rapidly growing suburb of Charlotte. A'No Build' alternative would not meet project goals. Therefore, this alternative was removed from consideration. Preferred Site Plan The preferred site plan has minimized impacts to Waters of US to the maximum extent practicable. Impacts to Stream B (120 If, S1; 40 If, S2) were unavoidable (Attachment D). Multiple design limitations have been imposed to the proposed development from the City of Gastonia and NCDOT. City Planning has indicated that there is future planning for Union Road to be extended beyond its intersection with Union New Hope Road as a four -lane highway. Though Union Road will be constructed as a two-lane road for this development, a future thoroughfare alignment was incorporated into the design to obtain City approval. Due to the anticipated size and traffic volume a turn signal will be installed at the Union Road and Union New Hope Road intersection and Union New Hope Road will be widened to have turn lanes for ingress and egress of the proposed subdivision. This proposed road widening and the need for BMP #3 makes re -configuring the proposed road crossing so that the proposed road does not cross Stream B not plausible under a nationwide permit. Any reconfiguration of the alignment to avoid Stream B would create impacts to Stream B from BMP #3 which is not allowable under a nationwide permit. The preferred site plan has designed the road crossing of Stream B to be at the closest angle to perpendicular as possible given design constraints. The width of the crossing was limited to the necessary area to allow traffic to pass safely in two directions. Due to sinuosity of the stream, the 100 If culvert will impact 120 If of stream. One additional impact will occur as an open cut trench sewer line crossing totaling 48 If (Attachment D, S3). A waiver of the 40 ft wide construction corridor for utility lines is requested for this activity. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Erosion and sedimentation control measures will be properly installed and inspected in accordance with the latest NPDES permit. Erosion and sedimentation BMPs will be installed prior to construction. Water will be diverted around the work area to prevent sedimentation of downstream aquatic resources and all work will be conducted in the dry. Impacts will be minimized by strict enforcement of Best Management Practices for the protection of surface waters, restrictions against the staging of equipment in or adjacent to waters of the US. This project will follow all conditions of NWP 29 and WGC 4139. All temporary impacts will be removed, and channel bed and banks will be restored to existing elevations. Equipment to be used includes a track hoe, dump truck, pumps, various hand tools, possibly a crane to move construction material such as reinforced bars of steel, and concrete buckets to place concrete. To determine which protected species are listed as occurring or potentially occurring within the project vicinity, and prior to conducting the on-site field investigation, CWS consulted the United States Fish and Wildlife Service (USFWS) Endangered and Threatened Species and Species of Concern by County for North Carolina online database for Mecklenburg County. In addition, CWS performed a data review using the North Carolina Natural Heritage Program (NCNHP) Data Explorer on February 19, 2019 to determine if any record occurrences of federally -listed, candidate endangered, threatened species, or critical habitat were located within the project limits. The results of the desktop review and habitat assessment are included in the Protected Species Habitat Assessment Report (Attachment Q. 6. Essential Fish Habitat (Corps Requirement) 6a. (CWS) to provide a protected species habitat assessment for the Presley Site. The project area includes Gaston County Tax Parcel No. 3562776203, totalling approximately 239.9 acres in extent. The project area is located north of the Union Road and Union New Hope Road intersection in Gastonia, North Carolina (Figure 1). Methods In -office Desktop Review To determine which protected species are listed as occurring or potentially occurring within the project vicinity and prior to conducting the on-site field investigation, CWS consulted the United States Fish and Wildlife Service's (USFWS) Endangered and Threatened Species and Species of Concern by County for North Carolina online database for Gaston County'. In addition, CWS performed a data review using the North Carolina Natural Heritage Program (NCNHP) Data Explorer' on July 24, 2018 to determine if any record occurrences of federally -listed, candidate endangered, threatened species, or critical habitat are located within the project limits. Typical habitat requirements for listed species was discerned from multiple USFWS3 and NCNHP4 online resources including, but not limited to, specific USFWS species profiles, recovery plans, NCNHP's Guide to Federally Listed Endangered and Threatened Species of North Carolina, and List of the Rare Plant Species of North Carolina. Potential habitat for potentially occurring federally -protected species that was identified during the desktop review was assessed in the field for the quality of physical and/or biological features essential to the conservation of the applicable species. Additionally, during the pedestrian habitat assessment, areas were reviewed for applicable federally protected species; however, formal surveys were not conducted. Identification references for natural communities include Schafale and Weakley's Third Approximation for Natural Communities of North Carolina (I 990)r' and Weakley (2015)' for plant species. Results Based on the NCNHP data explorer review, there are no current records of federally -protected species. within the project limits or within a mile of the project limits (Attachment A). The USFWS lists four federally protected species for Gaston County (Table 1). An official species list has not been obtained from the USFWS Asheville Field Office. Table 1. They can reach heights of five feet. Populations are limited to the piedmont of North and South Carolina. It has been listed as an endangered species under the Endangered Species Act (ESA) since 1991.8 The typical habitat for this plant includes roadsides, old pastures, transmission line right-of-ways, open areas, either natural or human -maintained habitats, or edges of upland woods. Major characteristics of soils associated with suitable Schweinitz's sunflower habitat include thin soils, soils on upland interstream flats or gentle slopes, soils that are clay like in both composition and texture (and often with substantial rock fragments), soils that have a high shrinkage swell capacity, and those which vary over the course of the year from very wet to very dry. Biological Analysis: A NCNHP data record review revealed that there are no current occurrences for this species within the project limits, or within a one -mile radius of the project (Attachment A). The desktop review and field survey assessment determined that the project area was forested, and lacked the maintained right-of-ways and cleared areas that Schweinitz's sunflower is typically found in (Photograph 1). On-site paths and vehicle trails were found to be narrow with thick overgrowth in the canopy and understory causing shading and competition not conducive to this species (Photograph 2). It was determined that the project area does not have the proper soils, sunlight, and occasional disturbances to support Schweinitz's sunflower. No individuals of Schweinitz's sunflower or other Helianthus species were observed during the field assessment on July 26, 2018, and supportive habitat was not present, which leads CWS to conclude that this project will have no effect on the Schweinitz's sunflower. Dwarf -flowered heartleaf (Hexastylis naniflora) Habitat Description: Dwarf -flowered heartleaf is endemic to the western Piedmont and foothills of North and South Carolina. This herbaceous evergreen is found in moist to rather dry forests along bluffs; boggy areas next to streams and creek heads; and adjacent hillsides, slopes, and ravines. Requiring acidic, sandy loam soils, the species is found in soil series such as Pacolet, Madison, and Musella, among others. Occurrences are generally found on a north facing slope. Undisturbed natural communities such as Piedmont/Coastal Plain Heath Bluff, Dry-Mesic Oak Hickory Forest, and Mesic Mixed Hardwood Forest hold the most viable occurrences. However, less viable remnant occurrences are found in disturbed habitats, including logged, grazed, mown, and residential/commercial developed lands; areas converted to pasture, orchards, and tree plantations; roadside rights-of-way; and on upland slopes surrounding man-made ponds or lakes.9 s United States Fish and Wildlife Services. 1991. The desktop review and field survey assessment determined that the majority of the project area has a thick understory and does not contain the proper slopes or soils to support the Dwarf -flowered heartleaf (Photograph 3). Stream side areas with steeper slopes and limited understory were found in the northwest portion of the project limits. The pedestrian habitat assessment revealed these soils to be composed of clay loam texture with shallow mafic rock outcrops near the surface (Photograph 4). According to Web Soil Survey, the soils in this area were of the Lloyd soil series, which are not acidic enough to provide suitable habitat. Due to lack of suitable habitat and known occurrences, CWS concludes that the project will not affect the Dwarf -flowered heartleaf. Bald eagle (Haliaeetus leucocephalus) The Bald and Golden Eagle Protection Act,10 enacted in 1940, prohibits anyone, without a permit issued, from "taking" bald eagles, including their parts, nests, or eggs. Habitat for the bald eagle includes cliffs and forested areas near estuaries, large lakes, reservoirs, rivers, seacoast, and as they become more abundant, stands of undisturbed forest. No water bodies large enough or sufficiently open to be considered potential feeding sources were identified. Since there was no foraging habitat within the review area, a survey of the project study area and the area within the project limits was not conducted. Additionally, a review of the NCNHP database on July 24, 2018 revealed no known occurrences of this species within 1.0 mile of the project study area. Due to lack of habitat and known occurrences, CWS concludes that this project will have no effect on the bald eagle. Northam long-eared bat (Mvotis septentrionalis) The northern long-eared bat (NLEB) is one of the species of bats most impacted by the white -nose syndrome disease. Summer habitat (roosting habitat) of the NLEB includes forests and woodlots containing live trees and/or dead snags greater than three inches diameter at breast height with cavities or crevices. Winter habitat (hibernacula) of the NLEB includes caves, mines, rocky areas, orstructures that mimic similar conditions such as culverts greater than 48 -inch in diameter.11 The NLEB was listed as Threatened (T) on April 2, 2015. The forested areas within the property are potential habitats for the NLEB. A Standard Local Operating Procedure for Endangered Species Act Compliance (SLOPES) was established for NLEB between the USFWS Asheville and Raleigh Ecological Offices and the United States Army Corps of Engineers (USACE), Wilmington District, on January 31, 2017.12 This SLOPES defines how the USACE will make determinations of effect to the NLEB on projects in which the USACE is the lead federal agency. The final 4(d) rule exempts incidental take of NLEB associated with activities that occur greater than 0.25 miles from a known hibernaculum site and greater than 150 feet from a known, occupied maternity roost from June 1 -July 31. In accordance with ALP 1 and the final 4(d) rule (effective as of February 16, 2016), any incidental take that may result from associated activities is exempt under the 4(d) rule. Therefore, this project is exempt under the 4(d) rule. Determinations Based on the literature search and the results of the on-site assessment for suitable habitat of federally -protected endangered, threatened, and candidate species, suitable habitat was not observed within the project limits for Schweinitz's sunflower, the Dwarf -flowered heartleaf, or the Bald eagle. Additionally, based on the project area location, no tree removal activities will occur within a 150 -foot radius of a known, occupied NLEB maternity roost from June 1 -July 31, and no trees will be removed within 0.25 miles of a known hibemaculum at any time of year. Therefore, any incidental take on NLEB that may result from associated activities is exempt under the 4(d) rule and notifications will follow the SLOPES agreement15.
