The site contains a dilipadated residence and associated outbuildings on the northeastern portion of the site. The
remainder of the site contains baseball fields, gravel/grassed parking areas, landscaped areas and wooded land. The
site is located in a residential/commercial area of Charlotte, Mecklenburg County, North Carolina.

The purpose of the project is to construct a recreational baseball complex.

The overall project consists of redevelopment of the site with a baseball complex. Currently, the recretional facility
contains two baseball fields, a small concession outbuiliding, grassed/gravel parking areas and utilizes portable toilets for
human waste. The recretional facility is proposed to be updated to construct three baseball fields with irrigation systems,
a clubhouse for teams, a concession stand, parking areas, pedestrian walkways and restroom facilities that will be
connected to the municipal wastewater system. In order to upgrade the existing recreational facility, a portion of an
intermittent stream must be filled to construct a baseball field. Graders, haulers, excavators and other heavy equipment
will be used during site construction.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Due to the proposed recretaional facility upgrades, it is necessary to fill a portion of a stream with a baseball field. Several
alternative designs were evaluated in attempts to avoid impacts to streams and wetlands. Initial designs included additional
permanent impact to the stream from post construction stormwater management BMPs and proposed temporary impact to the
stream from sediment basins. The applicant has selected the current design to avoid the aforereferenced additional impacts
to WoUS.
The proposed stream impact area is to the upper reach of a low quality stream. The stream has not contained flowing water,
evidence of aquatic life and little to absent aquatic habitat during visits by Pilot personnel. The proposed development area of
the site has been shifted as far to the north as possible to avoid additional impacts to the stream located on the site. There is
approximately 210 linear feet of intermittent stream located on the site. The remaining approximate 80 linear feet of
intermittent stream channel are being avoided.

The impact and clearing limits will be staked and silt fence or other sediment retention devices will be used.

Pilot consulted the USFWS Mecklenburg County list, dated 6.27.18 to identify protected species that could occur within
the proposed project area. The USFWS list of protected species identifes the bald eagle (BGPA), Northern long eared
bat (T), carolina heelsplitter (E), rusty -patched bumble bee (E), michaux's sumac (E), schwinitz's sunflower (E) and
smooth coneflower (E). Based on our observations, the proposed construction would not contain suitable habitat for the
carolina heelsplitter, rusty-pached bumble bee, michaux's sumac, schwinitz's sunflower and smooth coneflower due to
the current use of the site as maintained baseball fields, excessive sedimentation, lack of necessary stream
characteristics (i.e. substrate, rock crevices and sandbars) and being well shaded. The proposed project area contains
areas of suitable summer roosting habitat for northern -long eared bat (NLEB). It does not contain or is not located within
1/4 mile of hibernacula or 150 of a known summer roosting tree. Blasting or percussion activites are not proposed.
Therefore, the applicant will rely on the final 4(d) rule for NLEB is tree removal activites are necessary during summer
roosting months. Based on the size of the water bodies identified on the USGS Topographic Map in the immediate
vicinity of the site, the proposed project is not likely to disturb the bald eagle.
Based on our observations and understanding of the proposed project, it is our opinion that the proposed project will have
no effect to federally protected species that occur in Mecklenburg County.
