You have our approval, in accordance with the attached conditions, to place fill in or to
otherwise impact approximately 0.03 acre of waters and 0.003 acre of riparian buffer for the purpose
of replacing a boat dock and a seawall along approximately 50 linear feet of shoreline on Lake Tillery,
as described in your application received on January 6, 2005. After reviewing your application, we
have determined that this project is covered by Water Quality General Certification Number 3492,
which can be viewed on our web site at http://h2o,enr.state,nc,us/ncwetlands. The General
Certification allows you to use Regional Permit No. 198200030 once it is issued to you by the U.S.
Army Corps of Engineers (USACOE). Please note that you should get any other federal, state or
local permits before proceeding with your project, including those required by (but not limited to)
Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated USACOE's 404 permit expires
unless otherwise specified in the General Certification. This approval is only valid for the purpose
and design that you described in your application. If you change your project, you must notify us in
writing, and you may be required to send us a new application for a new certification. If the property
is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby
responsible for complying with all conditions.
Upon completion of the project, the applicanUresponsible party shall complete and return the
enclosed "Certificate of Completion" form to the Division of Water Quality's 401f\Netlands Unit.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition (that
conforms to Chapter 150B of the North Carolina General Statutes) to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are
final and binding unless you ask for a hearing.

existing pier and add a new boat slip on a lot at Lake Tillery. The referenced lot is on
598 Berryhill Drive, Norwood, North Carolina (Lot #340 Tillery Beach Subdivision). As
you know, I am required to get the approval of your agency before I proceed with the
project.
I am enclosing the required seven copies of the application required by the Division
of Water Quality and Progress Energy along with miscellaneous maps and sketches.
I realize it's probably more information than you need, but I didn't want to leave
anything out. I have also enclosed a check in the amount of $200.00, the certification
fee.

The following is a description of the proposed construction of new structures at 598
Berryhill Drive, Lot number 340, Tillery Beach in Norwood, North Carolina. The planned
construction is to be performed within the Progress Energy (PEC) leased area and area
over waters on Lake Tillery.
Currently, within the PEC leased property, there is a 12' x 18' deck/walkway, a 4 foot
walkway leading from the deck to an existing dock over Tillery water. I propose to remove
96 square feet (8' x 12') of the deck, leaving a 5 foot walkway plus and additional 60
square foot of deck area to be allocated towards the PEG's maximum allowed 1,200
square foot. There is an odd shaped appendage off the 4 foot walkway, over the water,
which will be removed. There are two, what are assumed to be old jet ski ramps, existing
and will be removed also. The total square footage to remain within the PEC's permitted
area and are to be included in the 1,200 square foot maximum is as follows:
315.5 sq. ft. over water
60 SQ. ft. over land
375.5 sq. ft. Total
New construction consists of widening the pier area and adding a boat slip. The
modifications will add an additional 822.9 square feet, which includes a 22.9 square foot
(4") roof overhang. Please see the attached sketch for clarification.

. The total facility area covered by PEe's facilities will be 1.198.4 sguare foot.
In addition to the above, I propose to replace a virtually non functional seawall with a new
seawall, approximately 48 feet, constructed of treated wood material. The new seawall will
be installed as close to the existing alignment as possible and approximately 18" above full
pond. Please see the attached sketch for clarification.

IX. Approval Process
· Application reviewed to determine if it is complete.
· If application is not complete or does not contain all the items and information listed in the checklist of
enclosures, applicant(s) will be contacted directly to provide the omitted information.
· If the omitted information is not received within thirty (30) days of information request, the
application will be returned to applicant(s) as incomplete and the application fee forfeited.
· Review of the application.
· A site visit on your property by a PEC representative to review your relevant drawings and discuss PEC
requirements.
· Applicant is to have PEC Building Permit posted within 20 feet of project and it must be viewable from
the water. The PEC permit must remain posted until a PEC representative inspects the project and deter-
mines the project is complete and within the application specifications.
· If approved, Progress Energy will mail a copy of the Permit Letter and PEC Building Permit to the
applicant's address or contact the applicant by phone or in writing of conditions or denial.

Your current lease with Progress Energy (PEC) and the Guidelines for the Use of leased Properties at lake Tillery
provide that, subject to certain requirements, you may construct and maintain a pier, wharf and a one-story boathouse at
lake Tillery. PEC does not object to the installation of a bulkhead or rip rap material for shoreline stabilization provided the
required permits are acquired.

NOTE: A pier, wharf and a one-story boathouse must be erected over that portion of lake Tillery immediately
adjacent to your leased premises and in the location herein approved by PEC. Encroachments that are not
promptly relocated after written notice to do so from PEC subjects your lease to possible termination.
Additionally, you may not construct or install other improvements/structures, Le., roof overhangs, driveways,
porches, decks over land, garages, buildings, storage buildings, wells or septic tanks on your leased premises.
As required under your lease, you must permit PEC, its officers, agents, employees and other authorized
persons to enter the leased premises at any and all times for the purpose of inspecting the leased premises
and your compliance with the terms and conditions of your lease.
The United States Army Corps of Engineers has issued a regional general permit covering this type of authorized work - a
copy of which is attached for your assistance and information. Please be advised of the requirement in paragraph 2.a. of
said Permit (page 5) regarding the need to apply for and obtain a Water Quality Certification from the North Carolina Division
of Water Quality in accordance with Section 401 of the Clean Water Act.
You may use this letter as PEC's permission in your application for a building permit from the appropriate Montgomery County
Inspection Office/Stanly County Planning Departmentto constructthe specific facilities set forth above and in applying for the
appropriate certification from the state. If you have not completed construction of your facilities within the next three (3)
months from the date of this letter, PEC's permission shall expire, requiring you to submit another application to PEC, along
with an additional $100 nonrefundable application fee. PEC's approval hereunder is subject to your compliance with the
terms and conditions of your lease and Guidelines for the Use of leased Properties at lake Tillery (as they may be amended from
time to time). A copy of the guidelines is attached for your reference.
Please see the reverse side of this document to describe the improvements you plan to construct.
