Dear Mr. Earnhardt:
On April 8, 2019, the Division issued a Notice of Violation (NOV) against RDH Tire & Retread.
The NOV was based upon a violation of the reporting requirement by failing to submit a
discharge monitoring report (DMR) for November 2018. Subsequent to your receipt of the NOV,
Gary Earnhardt with RDH Tire & Retread contacted the Division indicating that the DMR for
the 4 h Calendar Quarter had been submitted for December 2019.
Review of our database indicated that a violation was generated based on no submission of a
DMR for three-month span of September, October and November. Additionally, it was noted
that a DMR was submitted for the 3rd Calendar Quarter for August 2018. Review of the permit
monitoring requirements indicated that only quarterly monitoring and reporting was required.
Furthermore, the NPDES Permit Standards Conditions Part II, Section A. defines a "Calendar
Quarter" as one of the following distinct periods: January through March, April through June,
July through September, and October through December. Therefore, based on the definition of a
Calendar Quarter it has been determined that RDH Tire & Retread is in compliance with
quarterly monitoring and reporting.
Since RDH Tire & Retread is in compliance with quarterly monitoring and reporting for NPDES
permit NC0075523, I have withdrawn the NOV against RDH Tire & Retread for the cited
violation and directed that the record of this violation be removed from our files.
