Division of Water Quality (DWQ) on July 6, 2005. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3404 (GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps of Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, and Non-discharge regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: 1. Erosion & Sediment Control Practices Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No Waste, Spoil, Solids, or Fill of Any Kind No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 4. No Sediment & Erosion Control Measures w/n Wetlands or Waters Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 5. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 6. Sedimentation Sedimentation issues for this project shall be addressed as outlined in the "Proposed Mitigation Measures" plan dated July 1, 2005 prepared by your consultants, Ms. Melanie McKinney except that sediment shallower than six (6) inches does not need to be removed from the wetland unless so required by the US Army Corps of Engineers. The sedimentation in the stream and wetland must be removed by hand by October 15, 2005. Written notification must be sent to the Fayetteville Regional Office and Central Office of DWQ once that material has been removed. DWQ will be conducting additional site visits in the future to determine if other off-site r Michael Harris Page 3 of 3 September 6, 2005 sedimentation issues exist and whether they need to be addressed through DWQ's compliance and enforcement procedures. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. I have issues (that should have been addressed long ago) but now may have to make conditions out of them. In phase one of this development, there is a "sediment in wetlands" concern that Brad Shaver and I want resolved. However, the land is now sold to homeowners and we can't squeeze Harris but so hard on it. #1.Can I make a condition requiring resolution of this issue by restoration of the site by a given date? #2. Also, he has two now vacant lots (w/wetlands on them) proposed for mitigation. r. They have been covered by wood mulch (why??) WL Restoration of these lots will be a requirement as mitigation by the COE. Can I give him a time frame, with wording that a ? the 401 will be void if not done within the allotted time, and that he will certainly, be facing enforcement if he fails to do this? _The requested impacts are NOT large enough for us to require mitigation under normal circumstances. U. I believe there are other erosion/sediment issues on the site getting into the stream. (can't travel right now) I heard this from DLR. I want to state in the 401 that any future unauthorized fill will void the 401. Can I do this? or will I just pursue enforcement at that time?. I have just about let this one slip through the cracks, although we did send a NOV in June. I guess we could, if necessary, proceed to enforcement based on his limited success in resolving the issues in the NOV. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject application for impacts to wildlife and fishery resources. A site visit was made on August 8, 2005. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as amended). The project is located west of Rockfish off McPhaul Road. The site is located in a rural residential area and was wooded prior to development. The infrastructure and many of the homes in the subdivision have already been completed. The purpose of the application is to address the existing soils deposition within the active channel of an un-named tributary of Puppy Creek. Construction has resulted in wetland impacts of 0.017 acres and stream impacts of 69 linear feet from a road crossing. The applicant proposes to remove the sediments from the stream and surrounding wetlands by hand from the point where the sediments entered the stream to 180 feet downstream from the crossing. Planting of native species will occur as needed within the wetland areas. Stabilization measures will prevent further sediment deposition. Mitigation will include enhancement of 0.962 acres of wetland in Phase I of the subdivision. The applicant is willing to discuss further means by which wetland preservation may be accomplished in the subdivision. The Wildlife Resources Commission does not object to this project as proposed. However, we do recommend that the culvert for the stream crossing be embedded to enable natural stream materials to be deposited and allow for the passage of aquatic organisms. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Mitigation DWQ - In accordance with 15A NCAC 2H .0500 mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. I look forward to speaking with you about this and proceeding with the mitigation measures. Mitigation Measures Based on a phone conversation between Matthew O'Brien with S&ME, Inc. and Brad Shaver with the USACE Wilmington Regulatory Field Office on June 15, 2005, the following outlines the required components of mitigation for sediment impacts to the stream and wetlands as discussed with Mr. Shaver. Task 1: Sediment Removal Based on correspondence with both DWQ and USACE and due to the volume of sediment that has recently been transported to the stream system and its adjacent wetlands, it is imperative to physically remove as much as practicable without disturbing the vegetative community and stream substrate. Task 1A: In-Stream Sediment Removal Staff will remove sediment accumulations within the active stream channel by hand in areas that exhibit 2 inches or greater of upland soil deposition. This activity will occur Proposed Mitigation Measures July 1, 2005 Woods Edge Subdivision, Phase II DRAFT throughout the entire course of the stream system beginning at the point where sediment entered the system and continuing to the extent of 180 feet downstream from the crossing. A natural resources professional will observe and direct sediment removal activities to ensure that the natural stream substrate is not significantly disturbed during this effort. Task 1B: Wetland Sediment Removal Staff will remove sediment accumulations within the adjacent wetland areas that have accumulated sediment from construction activities and erosion. Removal will be by hand. This effort will concentrate on low-lying areas with significant deposition of upland soils. Areas where the sediment is greater than 2 inches in depth will be addressed initially, with emphasis placed on dry swales and other depressions. Impacts to existing wetland vegetation will be minimized by concentrating on less densely vegetated areas that have large sediment deposits. The intent of this effort is to remove the gross accumulations of upland sediment. Planting of native species will occur as needed within wetland areas to enhance vegetation that has been impacted by sediment. Task 2: Sediment Stabilization Through the combination of engineered controls (silt fencing, erosion control matting) and erosion control planting efforts, staff will minimize the transport of sediment by stabilizing the road's shoulders. Erosion control matting with an appropriate seed mix will be placed and maintained until sufficient coverage has been established on the slopes adjacent to the road crossing. Drainage structures running parallel to the road crossing will be repaired along with silt fencing. Erosion control matting with an appropriate seed mix will be placed as needed on slopes of banks along the 180 feet of impacted stream and wetland areas. Task 3: Wetland Enhancement Mitigation shall include enhancement of the 0.962 acre wetland from Phase I of the Subdivision. This area is now included in Phase II, as shown on the attached drawings, rather than Phase 1. A mixture of subcanopy and shrub species will be planted throughout this area The species composition will be based upon plant availability at the time of project commencement. Proposed Mitigation Measures July 1, 2005 Woods Edge Subdivision, Phase II DRAFT The planting density of subcanopy/shrub species will consist of 320 stems/acres at maturity. Additional planting of herbaceous species is proposed at a density of 500 plants/acre to allow time for establishment of the subcanopy and shrub species. Trained staff will observe the plant material vigor prior to planting and monitor its placement during mitigation activities. The final vegetative planting plan will be subject change after discussions with USACE and DWQ staff and site/location specifics. Preservation of Mitigation Property In order to prevent future or secondary impacts to the tributary and its adjacent wetlands S&ME looks forward to discussing with you potential preservation scenarios that are both practicable for the landowner and meet the needs of USACE mitigation requirements. Summary The intent of this plan is to address the existing upland soils deposition within the active channel and associated deposition on the wetlands. The goal is to minimize any further transport of upland sediment in the system. We propose a combination of engineered controls, erosion control measures, and herbaceous seeding to prevent further transport of sediment. Enhancement planting is also proposed to promote vegetative growth in areas that have been impacted by sediment. Please note that mitigative measures outlined in this document are based upon conversations with USACE staff and rely on their approval prior to commencement. We hope that a site meeting can take place at the earliest opportunity to ensure that mitigation goals will be met through implementation of this plan. Page 1 of 12 Coastal Area Management Act (CAMA) Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on page 4) the applicant should contact the North Carolina Division of Coastal Management (DCM). DCM will determine whether or not the project is within a designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency. In such cases, DCM will require a CAMA Permit and will-coordinate the 404/401 Permits. The applicant may also choose to coordinate with the United States Fish and Wildlife Service to ensure that the proposed project will have no impact upon any endangered or threatened species or critical habitat as regulated by the Endangered Species Act, and the State Historic Preservation Office, North Carolina Department of Cultural Resources to ensure that the proposed project will have no impact upon any properties listed or eligible for listing on the National Register of Historic Places. If either of these thresholds is exceeded, then a fee of $475 is required. A check made out to the North Carolina Division of Water Quality, with the specific name of the project or applicant identified, should be stapled to the front of the application package. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. The work was performed in accordance with the After-the-Fact Permit Request submitted by S&ME, dated July 5, 2005. The purpose of this effort was to remove sediment from the impacted stream and wetlands, stabilize upland soils, and enhance the wetland restoration areas through planting of native species. Task I: Sediment Removal Efforts were made to remove sediment by hand using a crew of approximately 7 individuals directed by Melanie McKinney with S&ME, Inc. In areas that allowed for mechanical access, sediment was hand removed and placed within the bucket of a backhoe prior to being deposited into a dump truck and hauled offsite. S&ME, Inc. This activity began just north of the crossing on Antiqua Drive and continued throughout the stream's reach as needed, to a point where the stream meets McPhail Road. Task IB: Wetland Sediment Removal Sediment was removed by hand in wetland areas adjacent to the impacted stream reach. Efforts were concentrated in less vegetated areas with greater than 6 inches of upland soil deposition. Sediment was also removed by hand in areas along Lots 4,5,6, and 7 of Woods Edge Phase I. Efforts were concentrated in less vegetated areas with greater than 6 inches of upland soil deposition. Task II: Sediment Stabilization A combination of engineered controls was used to stabilize the slopes of the Antiqua Drive crossing. A rye grain seed mix was placed along the banks of the crossing and a temporary erosion control matting designed for 1:1 slopes was placed in areas devoid of vegetation. Erosion control matting along with the rye grain seed mix was placed in an area behind Lot 94, just east of McPhail Road. Silt fencing was restored in this area and additional fencing was added just upslope of the erosion control matting. 2 Report of Restoration Activities Woods Edge Phase I & II S&ME Project No. 1588-05-088 September 23, 2005 Task III: Wetland Enhancement The boundaries of the 0.962 acre wetland from Phase I of the Subdivision were surveyed and marked with stakes by M.A.P.S. Surveying, Inc. (Photo 6). This area was restored to its pre-existing grade through the mechanical removal of mulch material. Rye grain seed was placed with a broadcast spreader to provide some cover for this area. Ten containerized wax myrtle (Myrica cerifera) and ten containerized sweet shrub (Calycanthus floridus) were installed in a scattered pattern throughout the wetland area. Silt fencing was placed along the perimeter of the feature to protect it from future sediment deposition. The restored area is shown in Photos 7 and 8. Additional Restoration Activities Approximately 30 black willow (Salix nigra) and 30 elderberry (Sanibucus Canadensis) live stakes will be planted on slopes and along wetland boundaries in November, 2005. Planting dates will be based on recommendations from the nursery. Based on the erodibility of the site's upland sand, stream monitoring after large rain events was proposed. Attention should be given to any additional sediment deposition that occurs, to prevent future impacts. We hope that this report satisfies your restoration requests.
