Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is an existing single-family residential lot along the banks of the Roanoke River. An unnamed tributary channel flows along River Road and along the western and southern portions of the property. The tributary channel was unstable with failing banks. Riprap armoring exists along the Roanoke River bank and portions of the tributary channel. The land uses within the vicinity of the project include single-family residential lots along River Road to the north, the Roanoke Canal Trail and City sewer main and easement to the west, and the Roanoke River to the east. 4b. Explain the purpose of the proposed project:* The purpose of the proposed project is to stabilize the tributary channel and to construct other landscape appurtenances. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The overall project includes the existing stabilization measures and modifications as required by the USACE and DWR in order for the project to be eligible for after -the -fact approval under NWP13 & 18 along approximately 143 linear feet (LF) of the tributary channel. Please refer to the attached plans and impact exhibits. The modifications include: (a) lowering of the wasting concrete/stone impoundment weir (a.k.a. sill) under the pedestrian bridge to reduce the depth of upstream impoundment during low flow conditions; (b) closure/cut-off (grouting) of the existing PVC bypass pipe under the stream channel to allow surface stream flowthrough the channel; (c) modification and/or removal of a portion of the downstream end of the existing instream stabilization (by means of the proposed constructed riffle) to allowfor a more gradual transition from the bed of the tributary to the river (not to extend any further downstream than currently exists); (d) replacement of pre-existing riprap/rock armoring of portions of the downstream tributary channel banks and adjacent Roanoke River banks near the downstream end of the structure; and (e) installation landscape appurtenances to include vegetated plantings and hardscape elements (boulder walls, boulder garden, waterfall features, firepit area, pedestrian bridge, 'river deck" and floating dock. Heavy equipment such as excavators will be used. (Note the pre-existing water intake pipes will remain and will be properly registered with DEQ.) The "river deck" will be located outside of the jurisdictional limits of the Section 10 waters. The ramp and floating dock are proposed within the jurisdictional limits of the Section 10 waters. 4j. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: This after -the -fact application is submitted in response to the violation notices sent to the applicant. The applicant was unaware that the tributary channel was a jurisdictional WOTUS and required permits to stabilize it. The applicant hired a contractor to stabilize the channel in an aesthetically pleasing way. Once the applicant was made aware of the violation, he hired S&EC, PA to assist him in resolving the matter. S&EC, PA and the applicant met with the USACE, DWR and City onsite to discuss options available to bring the project back into compliance with 404/401 regulations. The applicant agreed to modifications to the work that was done that included returning surface flow (both low and high flows) through the stabilized channel and other measures described above. Flo also revised other landscaping appurtenances to limit potential direct and indirect impacts to the WOTUS and Section 10 waters. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The applicant will utilize acceptable erosion control devices (silt fencing, etc.) as approved by the City during construction to protect downstream waters. The proposed work will occur at lowflow conditions within both the tributray stream and river. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. All listed element occurances of protected species are located within the Roanoke River outside of the propose project area. Bald Eagles do epst within the river area, but there are no known nests within 600 feet of the project area. Two bald eagle nests (NHP No. EO38064; "Northampton #4) are identified approbmately 1/2 mile from the project area. No effect to these eagles or nest are anticipated to occur from this project. Jack hammers (percussive activity) may be used to remove the eAsting sill under the pedestrian bridge, however this will only require a short period of time (day or two) if needed and is not anticipated to have any effect to the NLEB.
