The site is currently wooded with cleared areas with brush in the old landfill area. The landfill area is at the back of the site and extends all the way to
the Travis Creek banks. The banks of Travis Creek are wooded with underbrush.

The landfill remediation will have an aggressive erosion control plan. In addition only those areas that have landfill waste as well as the minimum
access required will be utilized. All access roads and construction pathways will be in the interior of the graded area.

All construction on the Travis Creek banks will be from the top down thus minimizing Impacts to the creek itself. All access and construction roads to
the creek will be on the interior of the construction area to minimize clearing as well as sedimentation. Vegetation will be left as long as possible and
sediment controls will be immediately added when vegetation is cleared.

The following is the most critical of all the information that you must provide. The quality and
detail of the information will often determine the expeditiousness of the review. The following is
a checklist of the types of pertinent information required at a minimum:

delineate the site boundaries on the topographic map.
2"" The most recent version of the bound and published County NRCS Soil Survey Map -
(required for projects within the Neuse River Basin, Tar -Pamlico River Basin, Randleman
Lake Watershed and the Catawba River Basin, also recommended for all projects) -
Please clearly delineate the site boundaries, etc. on the map. If the delineation obscures
any of the features, it is recommended that a clean copy be provided. Copies of the

current soil survey and/or soil survey map sheets can be obtained from the local NRCS
County Office (http://www.nc.nres.usda.gov/). GIS soil layers are not acceptable.
Vicinity map - Please clearly mark the location and approximate boundaries of the property
and project on the map. Please indicate north arrow and scale. Please include applicable
road names or State Road numbers.
P/The Site Plan - The most critical map to be provided is the site plan. You must provide full
sized plans. The following is the minimum list of plans that are typically needed.
[Pre-construction/Pre-existing conditions - This sheet (or sheets) must include:
• All jurisdictional and non -jurisdictional wetland, stream, water features, State regulated
buffers (delineated into Zones 1 and 2)
• Topographic contours with elevations
• Any existing structures and impervious areas
• Existing utility lines and easements
• Existing roads, culverts, and other pertinent features
• North arrow and the scale (1":50' scale is recommended).
[�Proposed conditions - This sheet (or sheets) must include:
• All jurisdictional and non -jurisdictional wetland, stream, water features, State regulated
buffers (delineated into Zones 1 and 2)
• Lot layout (if a subdivision or commercial development is proposed) - lots must be
developable without further impacts to iurisdictional and non -jurisdictional wetlands
streams, water features, and State regulated buffers Building envelopes must be
provided when streams, wetlands, riparian buffers, or water features exist on a lot
• All built -out structures and impervious cover
• Final grading contours with elevations
• All utilities and easements (including septic fields on all lots within 100 feet of stream,
wetland, or water features - if applicable)
• Impacted areas — these should correspond with the Impact numbers listed on your PCN
form.
Drainage Plans - Final drainage plans must include the following:
• Locations and pertinent elevations and sizes of the stormwater collection system and
drainage ways
• All inlets and outlets must also be shown with pertinent elevations (All outlets to
wetlands must be at a non-erosive velocity, generally less than 2 ft/sec during the peak
flow from the 10 -yr storm)
• Scaled stormwater BMPs must also be indicated as required by DWR rules and policies
• In certain cases (see Section E of PCN form), final stormwater management plans must
also be provided (see Stormwater Management Plan Checklist)
[Proposed Impacts - All impacts to jurisdictional and non -jurisdictional wetland, stream,
water features, and State regulated buffers must be shown and labeled on the site plans at
a scale no smaller than 1" = 50'. All excavation, fill, flooding, stabilization, and other impacts
that will be conducted in or near jurisdictional and non -jurisdictional wetland, stream, water
features, and State regulated buffers must be indicated. Please provide cross sectional
details showing the provisions for aquatic life passage (burial of culvert 20% for culverts <_ 48
inches, and 1 -foot for culverts > 48 inches).

Wetland Impacts:
Precise grading and final elevation contours must be provided. Existing
vegetation and any clearing must be specified.

Construction detail for anti -seep collars must be provided.
❑ V6"Roadway or other crossings of riparian wetlands may require floodway culverts to
maintain existing hydrological conditions.
Plans should show that the hydrology of remaining wetlands on the site will be
maintained.

Stream impacts must be clearly shown on the plans. The centerline as well as
the banks of the stream must be surveyed or located by GPS for the portion of
the stream to be impacted.
❑ A/a The inlet and the outlet of all culverts should be aligned with the stream as
much as possible. Inlet and outlet elevations and streambed elevations should
be indicated. Any inlet or outlet protection must be shown and enumerated on
the impact map(s).
❑ ,JA For bottomless culverts or other spans, a vertical cross section should be
provided that shows the minimum distance from each span to each stream bank,
the stream cross section, the height of the span above the stream and the
minimum distance from the edge of each footer to each stream bank.
Additionally, please provide a signed and sealed geotechnical report of
subsurface soils at the proposed bottomless culvert location. The report must
comply with the Division of Highways — Guidelines for Drainage Studies and
Hydraulic Design, prepared by A.L. Hankins, Jr., State Hydraulics Engineer -
1999.
❑ NA Multiple culverts or sectioned box culverts typically require the use of sills, off-
setting or other means to match the cross section of the existing stream (in order
to maintain stream stability and provide aquatic life passage). A vertical cross
section of the culverts should be shown overlain with the up and downstream
stream cross section including the stream flood -prone area.
❑' Impacts associated with dam construction must indicate and enumerate all fill
associated with the dam footprint, spillway and any bank stream bank
stabilization. The length of stream impounded must also be indicated and
enumerated.

Army permit may constitute a violation of Sections 9 and/or 10 of the Rivers and Harbors Act (33 USC § 401 and/or 403). If

C. Basis For Determination '
The pro!ect area exhibits water bodies.with bed and banks and indicators of ordinary high water marks - including
clear, natural line impressed on the bank, chanties insoil character, vegetation matted down; bent, or absent, leaf litter
disturbed or washed away, sediment deposition, the presence of wrack •line and sediment sorting - and wetland criteria
as defined in the "Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Eastern Mountains
and Piedmont Region (Version 20):1. The water bodies on the site include Travis Creels and an unnamed tributary
(UT) to Travis Creels - both Relatively Permanent Waters (RPWs)'that flow via Travis Creek (RPW) to the Haw River,
a Traditionally Navigable Water —.and abutting wetlands. This determination is based a site visit and verification by
David E. Bailey (USACE) on 10/5/2016. The full Basis for Determination is described on the "Approved Jurisdictional
Determination Form" in the Administrative Record.
D. Remarks
The waters of the US within the •Proiect Area were flagged by ATC Associates of N.C., P.C., with changes made in the
field by David E. Bailey (USACE) and are approximated on the attached map labeled "Elon College LDFL."
E. Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the
particular site identified in this request. The delineation/determination may not be valid for the wetland conservation
provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation

Dear Mr. Wilson:
On October 5 2016, at your request and in your attendance, Sue Homewood conducted an on-site
determination to review features located on the subject project for stream determinations with regards
to the above noted state regulations. David Bailey with the US Army Corps of Engineers was also present
during the site visit.
The Division acknowledges the areas and boundaries identified as jurisdictional wetlands by the USACE.
The attached map accurately depicts all stream determinations conducted during the site visit.
Please note that at the time of this letter, all perennial stream channels and jurisdictional wetlands found
on the property are subject to the mitigation rules cited above. These regulations are subject to change
in the future. In addition, the Jordan Lake Buffer Rules applies to streams as indicated on this map.
The owner (or future owners) should notify the Division (and other relevant agencies) of this decision in
any future correspondences concerning this property. This on-site determination shall expire five (5)
years from the date of this letter.

Landowners or affected parties that dispute a determination made by the Division or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a determination
by the Director. A request for a determination by the Director shall be referred to the Director in writing
c/o 401 & Buffer Permitting Branch, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that
dispute a determination by the Division or Delegated Local Authority that "exempts" surface water from
the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision. The
Division recommends that the applicant conduct this notification in order to be certain that third party

ATC Associates of North Carolina, P.C. (ATC) has completed the final wetlands and stream
determination for the above referenced site. This report documents field work associated with the
stream and wetlands determination on-site and serves as requested. ATC met with Sue Homewood
of NCDENR and David Bailey of the USACE on October 5, 2016 and final flagging and surveys
based on the field confirmation by the US Army Corp of Engineers and the NCDEQ Division of
Water Quality was field verified.

1.0 File Review
Prior to initiation of field activities, ATC conducted a desktop review of published references. The
references included the U.S. Fish & Wildlife Service National Wetlands Inventory (National
Wetlands Inventory), United States Geological Survey records, and the Alamance County Soil
Survey.
U.S. Fish & Wildlife Service National Wetlands Inventory
According to the National Wetlands Inventory, the southern end of the site of the site has a stream
that is forested shrub wetlands (Stream) from bank to bank on Travis Creek at the sotith end of the
site. There are no other wetlands shown on the site on the National Wetlands Inventory.
Information provided by the National Wetlands Inventory is included inAppendix'A.
United States Geological Survey Records
ATC reviewed the Ossipee USGS 7.5 Minute Topographic Map which shows no wetlands on the
site but does show Travis Creek which transects the south end of the site.
Alamance County Soil Survey
According to the Alamance County Soil Survey, the northern portion of the site is underlain by
Appling (b) and Helena (Ha) .soils. The central and southern portions are underlain by Iredell (Ib)
soils. These soils are nota listed hydric soil. However, the southern portion of the site is bounded
by Travis Creek which drains into the Haw River, a tributary'of•the Cape Fear River which is
shown on the published soils survey. - Travis Creek is a WS -V (upstream water supply) NSW
(nutrient sensitive) surface water body as defined by the North Carolina Division of Water
Resources.
2.0 Field Survey
On June 20, 2016, ATC mobilized to the site to determine if a wetland areas- are present at the site.
The survey involved observing the hydrology, vegetation, and'soils from three locations (W-1 and
U-1 and U-2). In addition, an evaluation of the area was completed in accordance with the U.S.
Army Corps of Engineers (COE) 1987 Wetlands Manual using the routine method and the
Regional Supplement to the COE Wetland Delineation Manual: Eastern Mountains and Piedmont
Region (Version 2.0) Environmental Laboratory by the COE (April 2012) and the North Carolina
Wetlands Assessment Method (Version 4.1 - October - 20 10) which is currently the accepted
methodology. Wetland determination data forms are included in Appendix B.
The site was also observed to determine if there are stream's ori the site for 401 Permitting and
Determination of Stream Buffers by the North Carolina Division of Water Quality (NCDWQ). A
determination was made'of any potential streams using the NCDWQ stream determination form
method. The- site is ' located in the Travis Creek/Haw River/Cape Fear River' Basinin Alamance
Wetlands and Stream Determination Report -Task Order 73013P-6E1on College LDFL

County, North Carolina. A perennial stream (Travis Creek) was observed at the south boundary
of the property and an unnamed intermittent stream with a tributary was observed in the central
section of the site during the field survey. The tributary is an ephemeral stream according to the
USACE procedures that connects to the wetlands north of the wetlands in the central area of the
site. Travis Creek drains into the Haw River, a tributary of the Cape Fear River which is shown on
the published soils survey. Travis Creek is a WS -V (upstream water supply) NSW (nutrient
sensitive) surface water body as defined by the North Carolina Division of Water Resources. This
section of the Haw River lies in the Jordan Lake Watershed.
Travis Creek at the south boundary of the site is subject to the Jordan Water Supply buffer rules
in accordance with 15A NCAC 02B .0267. Therefore a 50 feet buffer applies around this stream.
No buffer is associated with the stream or tributary at the center of the site.
The results of the desktop review and field survey indicate that an area of wetlands approximately
0. 178 acres in size exists at the site. The wetland area was identified in the central portion of the
site and is shown on Figure 1. Two streams were observed at the site that could be subject to 401
or 404 Permitting by the COE or NCDENR if impacted.
