I'm sure the UT includes backwaters from the lake, but the work was not performed along the shoreline of lake lure. They added a dry stack boulder wall to the outside of an existing concrete sea wall with existing rip rap at toe (in the UT), that also included adding dry stack boulder wall to an existing impoundment. The drawings are attached. This area is in a designated trout watershed and DWR classified trout waters. Would this work fall under GP30 or a NW3? Because the work is in DWR trout waters, permits are triggered with DWR if the Corps determines this is non -notifying. This application is currently on hold with DWR. Please let me know what permit this work falls under and whether it is notifying/non-notifying or exempt from the corps. The work that was described to us was that they would be basically adding capstones and veneer to the existing wall. This was upstream out of the lake bed so didn't require anything from us. My understanding was that the work would be above the high water mark. I was not aware of any additional stabilization work beyond what was described. Thanks, Clint From: Annino, Amy M [mailto:amy.annino@ncdenr.gov] Sent: Wednesday, July 11, 2018 9:54 AM To: Clint Calhoun <eco@townoflakelure.com <mailto:eco@townoflakelure.com> > Subject: Simon property - 103 Lakeview Rd Hi Clint, Are you aware of the bank stabilization work that occurred on the Simon property in Lake Lure? The project took place upstream from an impoundment of Lake Lure. The applicants (Shurburtt Group) proposed a dry stack boulder wall to be added to the outside of an existing seawall, but may have built a new section of dry stack boulder wall along the stream bank (with no pre-existing sea wall). This application never reached my desk because the applicant did not submit payment, and it was put on hold, but they did the work without a permit. I'm not even sure this work would fall under a GP 30 because it didn't occur along the shoreline of Lake Lure. Let me know if you are familiar with this project at all.
