REGAN Secretary LINDA CULPEPPER Director John Hutton Wildlands Holdings IV, LLC 312 West Millbrook Rd, Suite 225 Raleigh, NC 27609 NORTH CAROLINA Environmental Quality May 1, 2019 DWR Project #: 2016-0225v2 Alamance County Re: Cane Creek Umbrella Mitigation Banking Instrument (LIMBI) South Fork Nutrient Offset & Buffer Mitigation Bank Credit Release— Task 2 Dear Mr. Hutton: On February 28, 2019, the Division of Water Resources (DWR) received documentation from Wildlands Holdings IV, LLC (Wildlands) that the subject site had been constructed in its entirety and monitoring plots had been installed. On March 26, 2019, Ms. Merritt, with assistance from Daniel Taylor and Daniel Dixon with Wildlands, inspected the site and confirmed that the subject site had been completely planted, all monitoring plots were installed, and all stream restoration and enhancement activities appeared to be completed with all riparian areas, including the stream banks, seeded and stabilized. Cattle exclusion fencing was installed throughout the project. However, it was not immediately adjacent to the conservation easement boundary as originally shown in maps provided with the approved Bank Parcel Development Package. This coupled with the absence of visible conservation easement markers and placards made it difficult to identify the conservation easement boundary on the site. It was discussed onsite and in correspondence from Ms. Merritt on April 10, 2019, that Wildlands will include a map showing the actual boundary of the cattle exclusion fencing with the As -Built Report. Ms. Merritt also highly recommended onsite that Wildlands provide additional markings (tree paint, t -post, flagging) within the fenced area to provide a better visual boundary of the actual conservation easement. Lastly, recent cattle hoof prints and manure were observed within the easement below the crossing along reach 4 of South Fork. The access point was located onsite. On April 22, 2019, Wildlands provided confirmation to Ms. Merritt via email, that all easement placards had been installed and additional electrical wiring had been attached to the existing fence at the cattle access point found on reach 4 to prevent future access. In accordance with the UMBI, signed on March 6, 2018, the following Project Milestones have been met and the corresponding credits shall be released: North Carolina Department of Environmental Quality 1 Division of Water Resources 512 North Salisbury Street 1 1617 Mail Service Center I Raleigh, North Carolina 27699-1617 Task/Milestones South Fork Wildlands May 1, 2019 Credit 2) Mitigation Site Earthwork, Planting and Installation of Monitoring Devices 20% Completed TOTAL: 20% By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract. Therefore, 20% of your Jordan Lake riparian buffer Restoration and Enhancement credits (0.20 x 23,086.80 ft' = 4,617.36 ft) and 20% of your Jordan Lake riparian buffer Enhancement (via cattle exclusion) and Preservation credits (0.20 x 194,713.20 ft2 = 38,942.64 ft) are now released. Additionally, 20% of your generated nitrogen offset credits (0.20 x 11,719.16 = 2,343.831b -N) and 20% of your generated phosphorus credits (0.20 x 749.25 = 149.85 lb -P) are now released. Generated credits are credits that have not been applied to the appropriate delivery factor. The delivery factors applied to this bank due to its location in the 14 -digit HUC 03030002050050 are 71 % for nitrogen and 67% for phosphorous. Therefore, the total amounts of delivered nutrient offset credits for this site are 8,320.60 lb -N and 502 lb -P. By copy of this correspondence, 20% of your delivered nitrogen offset credits (0.20 x 8,320.60 lb -N = 1,664.12 lb -N) and 20% of your delivered phosphorus credits (0.20 x 502 = 100.4 lb -P) are now available for sale. Please note that of the nutrient offsets, only the delivered nutrient offset credits can be sold from this bank and used for impacts in the Haw River Arm of Jordan Lake within the Cape Fear River Basin. Additionally, riparian buffer credits can only be used to offset impacts located in the Haw River Sub Watershed of Jordan Lake according to 15A NCAC 02B .0295, which became effective on November 1, 2015.
