Department of Transportation, 5501 Barbados Boulevard, Castle Hayne, NC 28429 Authorizing development in Pender County at Topsail Sound and AIWW. Bridge No. 16 on NC-50/NC-210 , as requested in the permittee's application letter dated 2/18/19, including the attached workplan drawings (3): 1 dated 2/13/19, and 2 dated as received 2/18/19, This permit, issued on 3/4/19 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the following: (a) placement of approximately 100 linear feet of riprap along the south bank of the AIWW above normal high water for shoreline stabilization within the NCDOT Right -of -Way, (b) removal of accumulated sediments at the end of an existing drainage pipe at Station 40+10 -Y 1-RT, and (c) reduction in the elevation of the existing riprapped areas to allow positive flow at the previously authorized stormwater outfall at Station 42+90-Y1-LT, all as depicted on the attached workplan drawings. 2) In accordance with commitments made by the permittee, due to the classification of the waters of Topsail Sound as a Primary Nursery Area, all bottom -disturbing activities shall occur outside the in - water work moratorium of April 1 to September 30 of any year without prior approval of the N.C. Division of Coastal Management (DCM), in consultation with the appropriate resource agencies. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on No expiration date, pursuant to GS 136-44.713 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation Permit #60-16 Page 2 of 2 ADDITIONAL CONDITIONS NOTE: The activities authorized by this Minor Modification will permanently impact approximately 48 square feet of 404 Wetlands and will permanently impact approximately 40 square feet of existing riprapped shoreline below normal high water. 3) The placement of riprap shall be limited to the areas as indicated on the attached workplan drawings. The riprap material shall be clean and free from loose dirt or any pollutant except in trace quantities. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 4) All excavated materials shall be confined above normal water level and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 5) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 6) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. 7) This Minor Modification shall be attached to the original of Permit No. 60-16, which was issued on 5/27/16, as well as the amendment issued on 6/2/16, and all subsequent modifications and letters of refinement, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 8) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. NOTE: A minor modification application processing fee of $100 was received by DCM for this project.
