On behalf of DR Horton, Inc., Timmons Group is requesting comment from the U.S. Fish and Wildlife
Service (USFWS) regarding the proposed construction of the Windrow Chase residential development
project (Site), located in the City of Fuquay-Varina, North Carolina. The proposed project comprises
approximately 119.1 acres of land extending from US 401 to forested land and open field (Appendix A,
Figure 1. Vicinity Map). Areas surrounding the site are residential interspersed with undeveloped forested
lands to the south and west, open field and forested lands to the north, and forested lands to the west.
The Project Site is located within the Cape Fear River Basin (HUC 030300040501) and drains to Neills
Creek (NC DWR Stream Index Number 18-16-(0.7); Stream Classification WS -IV. The project site does
not contain a floodplain or floodway according to NC FIRM Map 3720064200J (map revised October 3,
2006). Approximately 25% of the project site is comprised of agriculture fields while approximately 75% is
a forested area located along the northern, eastern and southern property boundary. Approximately 5,699
linear feet of unnamed tributaries were delineated within the southern, western and eastern portions of the
Site (Figure 2. Preliminary Jurisdictional Waters of the U.S. Delineation Map). Approximately 2.45 acres of
wetland were also delineated that are primarily associated with the unnamed intermittent tributaries. The
U.S. Army Corps of Engineers (USACE) confirmed the wetland delineation on May 9, 2018 (USACE Action
ID: SAW -2008-01427).
August 15, 2018, a USFWS IPaC database review was conducted (Appendix B, USFWS Consultation
Code: 04EN2000-2018-SLI-1181; Event Code: 04EN 2000-2018-E-02400) to determine a species list for
the project Site. Based on the IPaC database, the following three species were generated for the Project
Site: red -cockaded woodpecker (Picoides borealis; Endangered), Caper Fear shiner (Notropis
mekistocholas; Endangered), and rough -leaved loosestrife (Lysimachia asperulaefolia; Endangered). It
was determined that the Site was located outside the critical habitat for the Caper Fear shiner.

location, and/or may be affected by your proposed project
To Whom It May Concern:
The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

evaluation and can be found on our web page at http://www.fws.gov/raleigh. Please check the
web site often for updated information or changes
If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.

towers (e.g., cellular, digital television, radio, and emergency broadcast) can be found at: http://

Not all Threatened and Endangered Species that occur in North Carolina are subject to section 7
consultation with the U.S Fish and Wildlife Service. Atlantic and shortnose sturgeon, sea
turtles,when in the water, and certain marine mammals are under purview of the National Marine
Fisheries Service. If your project occurs in marine, estuarine, or coastal river systems you should
also contact the National Marine Fisheries Service, http://www.nmfs.noaa.gov/
We appreciate your concern for threatened and endangered species. The Service encourages
Federal agencies to include conservation of threatened and endangered species into their project
planning to further the purposes of the Act. Please include the Consultation Tracking Number in
the header of this letter with any request for consultation or correspondence about your project

This letter is to inform you that the Service has established an on-line project planning and
consultation process. which assists developers and consultants in determining whether a
federally -listed. species. or designated critical habitat. maybe affected by a proposed project. For

present in the proj ect's Action Area, then you may use the -Service's Information, Planning, and
Consultation System (IPaQ website to determine if any listed, proposed, or candidate species
may be present in the Action Area and generate a species list. The IPaC website may be viewed
at https:llecos.fws.gov/il2ac/. The IPaC web site contains a complete and frequently updated list
of all endangered and threatened species protected by the provisions of the Endangered -Species
Act of 1973, as amended (16 U.S.C. 1531 et seq.)(Act), a list of federal species of concern that
are known to occur in each county in North Carolina, and other resources.
Section 7 cif the Act requires that all federal agencies (or their des gnated n,on-fe-de.ral .
representative), in consultation with the Service, insure that any action. federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

web site often for updated information or changes.
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
With regard to the above -referenced project, we offer the following remarks. Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided and other information available, it appears that the proposed
action is not likely to adversely affect any federally -listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for
your project. Please remember that obligations under section 7 consultation must be
reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a manner that was not considered in this review; or, (3) a new species
is listed or critical habitat determined that may be affected by the identified action.
However, the Service is concerned about the potential impacts the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we
recommend that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down -gradient surface waters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent to the project site.
The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a
copy can be found on our website at (http://www.fws.gov/raleigh) to address and mitigate
secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.

We recommend that you consider this document in the development of your projects and in
completing an initiation package for consultation (if necessary).

On behalf of DR Horton, Inc., Timmons Group is requesting comment from the North Carolina State Historic
Preservation Office (SHPO) regarding the proposed construction of the Windrow Chase residential
development project (Site), located in the City of Fuquay-Varina, North Carolina. The proposed project
comprises approximately 119.1 acres of land extending from US 401 to forested land and open field
(Appendix A, Figure 1. Vicinity Map). Areas surrounding the site are residential interspersed with
undeveloped forested lands to the south and west, open field and forested lands to the north, and forested
lands to the west.
The Project Site is located within the Cape Fear River Basin (HUC 030300040501) and drains to Neills
Creek (NC DWR Stream Index Number 18-16-(0.7); Stream Classification WS -IV. The project site does
not contain a floodplain or floodway according to NC FIRM Map 3720064200J (map revised October 3,
2006). Approximately 25% of the project site is comprised of agriculture fields while approximately 75% is
a forested area located along the northern, eastern and southern property boundary. Approximately 5,699
linear feet of unnamed tributaries were delineated within the southern, western and eastern portions of the
Site (Figure 2. Preliminary Jurisdictional Waters of the U.S. Delineation Map). Approximately 2.45 acres of
wetland were also delineated that are primarily associated with the unnamed intermittent tributaries. The
U.S. Army Corps of Engineers (USACE) confirmed the wetland delineation on May 9, 2018 (USACE Action
ID: SAW -2008-01427).
On August 15, 2018, a review of the North Carolina State Historic Preservation Office (HPOWEB GIS
Service) was conducted. Based on the review, there are no historic sites listed within the National Register
and there are no historic site on the Study List within a one mile radius of the project Site. There are two
historic sites (HT0174 David Henry Senter house 2013, and HT0818 A. A. Johnson house 2013) located
within a 0.5 mile to the west of the project Site and one historic site (HT0807 Farmstead 2013) located
within one mile to the south that are Determined Eligible.

Dear Mr. Pursglove:
Thank you for your submission of August 16, 2018, concerning the above referenced project. We have
reviewed the information provided and offer the following comments.
While no sites have been previously recorded for the project area, the project area has never been systematically
surveyed to determine the presence or significance of archaeological resources. Based on the presence of
several unassessed sites in the immediate vicinity and the topographic and hydrological setting of the project
area, we expect this area could contain intact, significant archaeological sites.
Prior to the initiation of any ground disturbing activities within the project area, we recommend that a
comprehensive archaeological survey be conducted by an experienced archaeologist. The purpose of this
survey will be to identify and evaluate the significance of archaeological sites that may be damaged or destroyed
by the proposed project. Potential effects on unknown resources must be assessed prior to the initiation of
construction activities. Please note that our office now requests consultation with the Office of State
Archaeology Review Archaeologist to discuss appropriate field methodologies prior to the archaeological field
investigation.
One paper copy and one digital copy (PDF) of all resulting archaeological reports, as well as one paper
copy and one digital copy (MS Word) of the North Carolina site form for each site recorded, should be
forwarded to the Office of State Archaeology through this office for review and comment as soon as
they are available and in advance of any construction or ground disturbance activities.
A list of archaeological consultants who have conducted or expressed an interest in contract work in
North Carolina is available at www.archaeology.ncdcr.gov/ncarch/resource/consultants.htm. The
archaeologists listed, or any other experienced archaeologist, may be contacted to conduct the
recommended survey.
We are unable to accurately assess impacts to historic properties within the vicinity of your project without
further information. Please provide photographs and architectural descriptions, including dates of construction,
for structures over 50 years of age within the project area. Also, indicate the intention regarding these
structures, e.g., demolition, rehabilitation, relocation, etc.
Documentation requirements for submittals can be found in our Project Review Checklist
(http://www.hpo.ncdcr.gov/er/er_email_submittal.html). A determination will be made once we have
received the requested information.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation’s Regulations for Compliance with Section 106 codified at 36 CFR
Part 800.

Sorry, I couldn't quite catch your full phone number on the VM. Anyway, nothing has changed regarding the JD forms. I
said whichever form is appropriate, so in this case the fillable pdf of the PJD form is appropriate. You just can't print it to
pdf after you fill it out and sign it because that removes the ability for us to work within the document. Same for
Rapanos but there's only the Word version for that form as you know. You just have to attached these as stand-alone
documents when you email your submittals. Hope that clears things up but let me know if you have further questions.

Dear Ms. Greer,
On behalf of the DR Horton, Inc, Timmons Group conducted a wetland delineation on January 11, 2018 to identify
Waters of the U.S., including stream and wetland boundaries. Additional analysis was conducted on February 22, 2018
within a section of land located immediately adjacent to Lafayette Road. The project site encompasses approximately
119.1 acres and is located at 166 Kitt Stewart Lane in Fuquay Varina, North Carolina within Harnett County. The project
site is further described as Harnett County Parcel Identification Number (PIN) 0653-77-4878.000. The project site is

located within the Cape Fear River Basin (HUC 030300040501) within the Neills Creek watershed. The project site drains
South East to Neills Creek which has a NC Division of Water Resources Stream Index Number of 18-16-(0.7) and a Stream
Classification of Class WS-IV. The project site does not contain a floodplain or floodway according to NC FIRM Map
3720064200J (map revised October 3, 2006). Approximately 25% of the project site is comprised of agriculture fields
while approximately 75% is a forested area located along the northern, eastern and southern property boundary.
Based on our field investigations conducted on January 11, 2018 and February 22, 2018. Based on our field
investigations, four (4) forested (PFO) wetland features and two (2) palustrine emergent (PEM) wetland features were
identified within the project site. A total of approximately 2.28 acres (99,167 square feet) of PFO and PEM wetlands
were flagged within the project site. One (1) palustrine open water (POW) wetland feature was identified within the
project site. A total of approximately 0.17 acres (7,542 square feet) of POW wetlands were flagged within the project
site. Four (4) perennial (PER) stream features and two (2) intermittent (INT) stream features were identified within the
project site. A total of approximately 5,699 linear feet of stream was flagged within the project site. The delineated
wetland and stream features are depicted on Figure 6. Wetland and Waters of the U.S. Delineation Map.
