DISCHARGE HISTORY
Fulcher's Point Pride [Fulcher's], is a seafood packing and processing facility historically employing
approximately 60 people seasonally. It was first permitted in 1980 but destroyed by fire in year 2000.
Since then, the Permittee has regularly requested permit renewal, but operations have remained dormant
through three permit cycles until recently.
Fulcher's historically processed and/or packed crab, shrimp and fish, in addition discharging boiler
blowdown and non -contact cooling water, via four (4) designated outfalls [species -specific under 40CFR
§408 Subparts L, B, and U]. Seasonal operations depend on the catch, most recently reported only at
Outfalls 001 and 002 [Outfalls 003 & 004 to date remain dormant]. However, recent reporting under the
permit suggests compliance compromises.
RECEIVING STREAM
This facility discharges under tidal conditions to the south side of Oriental Harbor [mouth of Raccoon
Creek, segment 27-129-8], ultimately flowing into the Neuse River Estuary. Raccoon Creek is located
within Oriental Restricted Area No. 2 and is classified SC; NSW; HQW (see permit map).

COMPLIANCE
Recently without prior notice to the Division, Fulcher's accepted seafood for processing and packing and
reported discharging for two days during November and December 2017 [see BIMS database Jan2014-
Aug2018]. Fulcher's thereby ignored permit instructions to notify the Washington Regional Office
(WaRO) prior to startup.
Reporting was further non -compliant in that the Permittee submitted eDMRs that confused the
appropriate outfall with its permitted species. Confusion may have in part stemmed from several outfalls
listed as inactive due to long hiatus in seafood production (see Renewal Strategy).
On 17Aug2018 WaRO issued two Notices of Violation (NOVs) of monitoring frequency related to the
November and December discharges — "failure to monitor" Total Residual Chlorine (TRC) and pH at
Outfalls 001 and 002. While they were previously granted a DMR reporting waver, this waver expired
with the new discharge, and the Division has issued NOVs for Failure to Report DMRs during 2018
months since startup. BIMS records WaRO's civil -penalty assessments for these violations.
Fulcher's recent DMRs (Nov & Dec 2017) report seafood packing and processing activities that do not
match species -specific outfalls permitted under 40 CFR 408. Because these outfalls are located at
intervals along the same loading dock, DWR acknowledges that a change in activity location does not
likely impact the receiving stream. However, reporting discharge activity via eDMR at the wrong outfall
compromises species -specific compliance with state and Federal 40CFR regulations. DWR hereby
revises the permit to address this issue, i.e., reestablishing all four (4) outfalls (see Renewal Strategy).
RENEWAL STRATEGY:
Limits and monitoring calculations presented herein consider the Permittee's reported seafood
production and wastewater characterization (see renewal application received 15Jan2018). Applicable
state regulations and categorical federal guidelines include 40 CFR §408 as summarized below.
Having as reference the renewal application and a two-day discharge record, the NPDES Permitting Unit
has opted to renew this permit based on past and recent limited production. Renewal hereby reinstates
four (4) outfalls (revising a previous permits), each outfall specific to seafood packing and processing
activities under 40CFR 408.22(b) as follows:
Outfall 001 — Boiler Blowdown; Seafood Washing and Packing Only [non -process wastewater]
Outfall 002 — Non -Breaded Shrimp Processing, Subpart L
Outfall 003 — Manually -Processed Bottom Fish, Subpart U.
Outfall 004 — Manually -Processed Blue Crab per, Subpart B
The permittee is admonished to report future species -specific activities in accord with the above.
CALCULATING PERMIT LIMITS:
OUtfall 00 1 — Boiler Blowdown & Seafood Washing and Packing only [no process wastewater].
Discharges shall be limited monitored and reported by the Permittee considering the
parameters Flow, Oil & Grease, pH, and Temperature (effluent and upstream), see
permit section A (1.).
