Answer questions for Parts A through C by checking either "Yes" or "No". Complete Part D of the checklist when Minimum Criteria Rule categories #8, #12(i), or #15 are used. TIP Project No.: State Project No.: 80047 Project Location: East Vineyard Road (SR 1353) Clay County, North Carolina. Project Description: Road improvement project that will widen and pave approximately 0.83 miles of current gravel secondary state road. The project will utilize stage construction methods during construction. Anticipated Permit or Consultation Requirements: 1. Outside river corridor = Yes. 2. Below impact threshold for applicable NWP = No. NWP 14 Required. 3. Tree clearing = Yes (poplar, walnut, pine) —(follow moratorium). 4. Trout watershed = Yes. Moratarium Required. 5. NLEB HUC = No. Greater than 1.0 miles from Red HUC. Special Project Information: The East Vineyard Road and surrounding area were surveyed on 2.5.18, 3.28.18, 4.18.18, 7.27.18, 10.23.18, 130.19 and 3.21.19 for presence of rare plants, respectively and no specimens or evidence were found. Potentially suitable habitat near the roadway project was intensively surveyed but on specimens were detected. There will be approximately 20-25 trees (Poplar, Black Walnut, & W. Pine) removed within the project limits. There will be approximately 121 linear feet of permanent stream impacts and 600 liner feet of temparary stream impacts to UT's of Shooting Creek. There will also be 0.13 acres of wetland fill for road widening. Mitigation will be acquired for project impacts. 03/26/19 1 of4 PART A: MINIMUM CRITERIA Item 1 to be completed by the Engineer 1. Is the proposed project listed as a type and class of activity allowed under the Minimum Criteria Rule in which environmental documentation is not required? If the answer to number 1 is "no", then the project does not qualify as a minimum criteria project. A state environmental assessment is required. If yes, under which category? (8) Highwav or Railwav Modernization. If either category #8, #12(i) or #15 is used complete Part D of this checklist. PART B: MINIMUM CRITERIA EXCEPTIONS Items 2— 4 to be completed by the Engineer: 2. Could the proposed activity cause significant changes in land use concentrations that would be expected to create adverse air quality impacts? 3, Will the proposed activity have secondary impacts or cumulative impacts that may result in a significant adverse impact to human health or the environment? 4. Is the proposed activity of such an unusual nature or does the proposed activity have such widespread implications, that an uncommon concern for its environmental effects has been expressed to the Department? WBS No. (80047) • Contractor will adhere to USACE 404 Permit, NCDWR 401 Permit and NCWRC Comments. • Project will adhere to NCDOT best management practices to ensure erosion and sedimentation does not occur off-site. • No work shall occur in any tributaries or within the 25 ft. trout buffer during October 15t" — April 15tn • All tree removal will occur during October 15t" — April 15th to avoid potential effects to Indiana Bat habitat. • All clearing, construction and staging shall not extend past the archaeological area of potential effect (APE), which is 25 ft. from centerline of existing roadway. If resources are discovered during construction the contact will be made immediately with the Division Environmental Office and the NCDOT Human Environment Unit. • Orange safety fencing will be installed along entire western portion of project limits to prevent disturbance of potential archaeological resources. • An on-site pre-construction meeting will be required with Division Environmental Staff to discuss project limits, permits and archaeological resources.
