Sullins Director March 28, 2011 Dee Freeman Re: Notice of Regulatory Requirements North Carolina Administrative Code Title 15A Subchapter 2L Classifications and Water Quality Standards Applicable to the Groundwaters of North Carolina (15A NCAC 2L) Contentnea Metropolitan Sewerage District, Land Application of Residual Solids (503) Permit No: WQ0001048 Pitt County NORR No. NORR-201 1 -LV-0098 Dear Mr. Smithwick: On February 18, 2006, Contentnea Metropolitan Sewerage District (CMSD) was issued Non -Discharge Permit NO.WQ0001048 for the operation of a Land Application of Residual Solids facility. Title 15A NCAC 2L .0107 and .0108 establish a compliance and review boundary for your facility and outline the appropriate actions to be taken when the concentration of any substance exceeds the maximum allowable concentration established in 15A NCAC 2L .0202 (a copy of the regulations is attached for your reference). The following chart and graph reflect chromium levels from groundwater monitoring samples taken from the required monitoring wells under Permit #WO0001048, as reported in CMSD's 2006 through 2010 Annual Report. Chromium Levels are reported in ug/L. Based on a review of available monitoring data, a trend of groundwater quality exceeding the 2L Standard for chromium (of 10 ug/L) has been noted. As such, additional action is required. 15A NCAC 2L .0106(d)(1) - Corrective Action - states that any person conducting or controlling an activity which is conducted under the authority of a permit issued by the Division and which results in an increase in concentration of a substance in excess of the standards at or beyond the review boundary, shall demonstrate, through predictive calculations or modeling, that natural site conditions, facility design and operational controls will prevent a violation of the standards at the compliance boundary; or submit a plan for alteration of existing site conditions, facility design or operational controls that will prevent a violation at the compliance boundary, and implement that plan upon approval by the Director. The Washington Regional Office is requesting Contentnea Metropolitan Sewage District to fulfill the above noted requirements and submit the results of any predictive calculations or modeling within ninety (90) days of receipt of this notice. Failure to do so may result in further enforcement actions and possible civil penalties. Our office would appreciate your cooperation in this matter.
