Dear Mr. Smithwick:
On March 28, 2011, the Water Quality Regional Operations Section, Washington Regional
Office issued the attached Notice of Regulatory Requirements (NORR) to Contentnea
Metropolitan Sewerage District (CMSD) to address exceedances of the North Carolina
Groundwater Standards detected during groundwater monitoring being performed under Permit
No. WQ0001048. On June 28, 2011, CMSD provided the attached response to the NORR in
which it was proposed that as part of the planned upgrades to the wastewater treatment system,
land application of residual solids under Permit No. WQ0001048 would cease. However, the
facility is still performing land application of residual solids under Permit No. WQ0001048; and,
as evidenced by the groundwater monitoring results presented in the 2018 Annual Report
received by the Washington Regional Office on March 11, 2019, there continue to be
exceedances of the North Carolina Groundwater Standards at the facility. Therefore, the
Washington Regional Office requests that CMSD fulfill the requirements of 15A NCAC
2L .0106(d)(1) originally outlined in the attached March 28, 2011 NORR and submit the results
of any predictive calculations or modeling within ninety (90) days of receipt of this letter.
