A review has been conducted of the self-reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by City
of Graham. This review has shown the City of Graham to be in violation of the requirements found in the subject
permit and/or North Carolina G.S. 143-215.1(a)(1). The violations that occurred are summarized below:

SSOs which occurred as a direct result of severe natural conditions in November, 2018, have been given special
consideration. The Division has decided against taking enforcement action for some of these SSOs based on
several specific exceptional weather-related conditions surrounding each individual event.
Remedial actions, if not already implemented, should be taken to correct the above noncompliance. Please note
that the Division of Water Resources (DWR) began assessing civil penalties for severe and/or repeat SSOs
starting December 1, 2007. Enforcement decisions are based on volume spilled, volume reaching surface waters,
duration, gravity, impacts to public health, fish kills and other factors.
