The original questions/requests are copied below as they appear within the letter and are then followed by our response. Additional Information Requested. Please provide documentation indicating that the NC D WQ or NC Forest Resources has made intermittent/perennial stream determinations at the site. On July 26, 2005 and on November 14, 2005 staff of the NC DWQ visited the site making riparian buffer determinations. On both occasions, the segment of stream in question (PCN Section VI.4, Impact Area #2) was determined to be not buffered. As per 15A NCAC 02B .0259(3)(a), this on-site determination indicated that the feature identified as feature "E" on the attached DWQ On-Site Determination letters (DWQ EXP# OS-1278 & TPBRRO #OS-343) as "ephemeral". However, if the DWQ still feels it is necessary to conduct an Intercnittent/Perennial Determination for this site, a meeting has been scheduled for March 1, 2007 with Mike Horan of the Raleigh Regional Office. We anticipate that this answers all of the DWQ's questions in order to complete the final review process fora 401 Water Quality Certification. The features are labeled as "B, C, D and E" on the attached maps initialed by me on July 26, 2005. The Division of Water Quality (DWQ) has determined that the features labeled as "B, C, D and E" on the attached maps are subject to the Tar-Pamlico Buffer Rule. The origin of these features have been delineated and identified in the field as the following: Feature B starts at pond #1 and remains subject through to the confluence of feature A; Feature C starts at flag "start CL C" and remains subject through to the confluence of feature B; Feature D starts at flag "start CL D and remains subject through to the confluence of feature A (including pond #3); and Feature E starts at pond #2 and remains subject approximately 130' below the base of the dam of pond 2 at the flag "stop E", the channel then falls apart an is not subject through to the floodplain of feature A. These stream features and their associated buffers should be identified on any future plans for this property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a surface water exists and that it is subject to the buffer rule may request a deternnation by the Director. A request for a determination by the Director shall be referred to the Director in writing c/o John Domey, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. Individuals that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is notified of this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third-party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714.
