Dear Mr. Brown:
On August 10, 2018, The Division of Water Resources (Division) received your request to
modify the 401 Water Quality Certification issued to you on March 5, 2018 for a water intake
structure. The purpose of the project is to test the safety and efficacy of a water intake structure
to supply water to a trout farm. The Division has reviewed the additional information and has
determined the application is incomplete and cannot be processed. The modification request will
be placed on hold until the following items are addressed:
The modification request does not mention how much water will be required from the
stream to operate the proposed trout farm. The Division is concerned that the proposed
intake for a trout farm could dewater the stream reach during drought conditions, thereby
removing the existing use. Please provide the Division with a proposed water withdrawal
plan indicating the anticipated amount of flow required to operate the proposed facility.

2. Please indicate the proposed length of the by-pass reach (i.e., length of stream between
the intake and return discharge) for all potential trout farm site plans. [ 15A NCAC 02H

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is
not received within 30 days, the Division will be unable to approve the application and it will be
returned.
