Dear Mr. Brown, After receiving and reviewing my 404 and 401 Permits, it has become apparent that a redesign of the intake structure is required for two reasons. First, there is a requirement in the 401 Certification that stream flow be measured. This makes it necessary for me to either install the intake structure and a measuring device separately or combine the two into one structure. I have chosen the latter. Second, to achieve enough height for the weir, it is necessary to raise the height of the intake structure off the stream bed. My redesign will raise the height of the weir about 10 inches off the bottom of the stream bed and raise the intake structure about 6 inches off the bottom of the stream bed. It is my opinion that this will greatly increase the chances that this new structure will succeed. Enclosed with this letter is a drawing depicting the new configuration of the proposed intake structure. Please accept this letter as request to modify the General Permit issued to C.R. Brown Enterprises on April 10, 2018 and the 401 Water Quality Certification issued by the North Carolina Division of Water Resources on March 5, 2018. The specific modifications requested are: Section 3c. On page 3 of the application dated 11/13/17 is modified to read as follows: The purpose of the project, if approved, is to test the safety and efficacy of a very low (non - impounding structure) water intake structure in the stream bed. If the study proves the intake structure is safe enough to supply water to a trout farm, it is anticipated that the applicant will apply for a discharge permit for a trout farm. Section 3e. also on page 3 of the application dated 11/13/17, is modified to read as follows: If approved, the project will test the feasibility of a very low water intake structure while also using the structure as a water flow rate weir. A water intake system must be highly dependable. Dependable means the intake must be indestructible and not subject to R&S 2073919_1 plugging. A safe water flow rate through the intake screen must be determined especially during periods of high flow. A 12 inch pipe will connect to the intake structure and transport water down the creek approximately 150 feet to a measuring box before the water is released back into the creek. There will be a valve inside the measuring box to control the volume of water that flows through the intake screen. The measuring box will also have an adjustable weir for measuring flow rate through the intake screen. Results of stream flow measurements will be made available to the US Army Corps of Engineers and the Division of Environmental Quality.
