On behalf of the current owners, Marshall & Sarah Wiggins, please find attached a complete PCN form
and supplemental information notifying you of proposed plans revisions and requesting the removal of
stream mitigation requirements that were contained in a previously issued USACE Nationwide permit
(#200321403-04 issued 2/27/2004, copy attached) and associated 401 Water Quality Certification and
Buffer Authorization from N.C. Division of Water Resources (NCDWR) issued 5/28/04, #03-1146 (copy
attached). This request is only related to Impact area 5 on the attached plans which requires 80 If of
stream impact for culvert and 42 If for rip rap installed so that the top is level with the preexisting stream
bed elevation, therefore total impacts at this crossing will be 148'. Upon removing the existing culvert and
riprap and subsequently reinstalling a culvert and rip rap as proposed, there will be 80' of stream bed loss
at this location. Previously, at Impact Area 2 on the attached plans, 68' of stream loss occurred due to
placement of a culvert, bringing the total project stream bed loss to 148'. This is significantly less than the
292' of stream bed loss originally permitted.
The project is the final phase of a residential subdivision. For more details see the attached site plans,
maps and PCN form. This project sat dormant during the recession, the impacts are done but are
significantly less than permitted. The original LLC that was the permittee (Wiggins Farms LLC) was
dissolved in 2011 and did not pay for the mitigation required by the permit (see attached letter of
dissolution from the NC Secretary of State). By redesign of the final road crossing that has been installed
but not paved (Impact area 5 on the enclosed plans), the total project cumulative stream loss can be
reduced below 150' and therefore no stream mitigation would be required. The attached plans show all
project related impacts that have been completed. Contrary to the original permit application, all sewer
line crossings that have been completed are aerial. All impacts have occurred except for one aerial sewer
line crossing (Impact area 4 on the attached plans). Andy Williams of the Corps of Engineers evaluated
the site with Kevin Martin of S&EC on 9/25/18 to inspect prior impact locations and discuss the redesign
of the road crossing at Impact area 5 so that the mitigation requirement could be removed. All impacts
that have or will occur on the project are shown on the attached plans so that cumulative impacts are
clear to the reviewing agencies.

The original permit required mitigation, but the developer did not make the payment and proceeded to develop the project any way. In 2011 that
developer, Wiggins Farm LLC, was administratively dissolved by the Secretary of State (see attached of dissolution) and the original owner, Marshall
Wiggins, took over responsibility of the remaining undeveloped land. Upon application for an erosion control permit to complete development of phase
5, the engineer was asked for copies of current Corps and state permits. At that time S&EC was reengaged and discovered that the original developer
had not made the required mitigation payment. S&EC then met onsite with Andy Williams of the Corps if Engineers to determine how to move forward.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. Holden Farm (formerly Brookfield) is a residential subdivision.

Reference is made to the application of September 11, 2003, and December 19, 2003,
submitted on your behalf by Mr. Sean Clark of Soil & Environmental Consultants, P.A., for
Department of the Army (DA) nationwide permit authorization for the proposed discharge of fill
material into 292 linear feet of stream channel associated with the construction of Brookfield
Subdivision. The property is located immediately west of the intersection of SR 1117 and SR
1116, adjacent to an unnamed tributary to Brandy Creek, east of Youngsville, Franklin County,
North Carolina.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed
a memorandum of agreement (MOA) establishing procedures to determine the type and level of
mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This
MOA provides for first, avoiding impacts to waters and wetlands through the selection of the
least damaging, practical alternative; second, taking appropriate and practical steps to reduce
impacts on waters and wetlands; and finally, compensating for any remaining unavoidable
impacts to the extent appropriate and practical. To enable us to process your application in full
compliance with this MOA, we requested that you explore alternative subdivision layouts.
Nationwide Permit General Condition 19 mandates that projects must be designed to avoid
and minimize adverse effects to waters of the United States to the maximum extent practicable at
the project site. In your application dated December 19, 2003, you proposed to remove a road
crossing presently located between Lots 79 and 106 (Impact Area 5), which resulted in a
reduction of jurisdictional stream impacts from 396 linear feet to 292 linear feet of stream
channel. It appears that modifying the subdivision design from a crossing to a cul de sac has
minimized proposed impacts to waters on the property, therefore complying with the MOA and
General Condition 19.

The permittee shall make payment to the North Carolina Ecosystem Enhancement
Program (NCEEP) in the amount determined by the NCEEP, sufficient to perform the
restoration of 584 linear feet of warm water stream Tar River Basin, Cataloging Unit
03020101. Construction within jurisdictional areas on the property shall begin only after
the permittee has made full payment to the NCEEP and provided a copy of the payment
documentation to the Corps, and the NCEEP has provided written confirmation to the
Corps that it agrees to accept responsibility for the mitigation work required, in
compliance with the MOU between the North Carolina Department of Environment and
Natural Resources and the United States Army Corps of Engineers, Wilmington District,
dated November 4, 1998.

reviewing your appliciation, we have detdded that the impacts are covered by the N.C. Division of Water Quality (DWO)
Genaral Water Quality Certification Number $402 (GC3402). The Certification allows you to use Nationwide Permit 39 when
Issued by the US Army Corps of Engineers (USACE).
You have our approval, In accordance with the attached conditions and those listed below, to temporarily place fill within
or otherwise impact 60 linear feet of streams and 5,399 square frost (ftp) of protected riparian buffers gr the purpose of 3
sanitary sewer line crossings (one not buffered) at the subject property, as described within your application dated
September 10, 2003 and in your additional Information submitted November 6, 2033, January 22, 2004, March 19, 2004,
Apdi 28, 2004 and May 27, 2004. After reviewing your application, we have decided that the impac°,s are covered by the
N.C. Division of Water Quality (DWO) General Water Quality Certification Number 3374 (CC3374). The Certifications)
allows you to use Nationwide Permit 12 when issued by the US Army Corps of Engineers (USACE). This letter shall also
act as your approved Authorization Certificate for Impacts to the protected ripadar, buffers per 15A NCAC 28.0259. In
addition, you should obtain or otheiwiss comply with any other required federal, state or local permits beforp you go
ahead with your project including (but not limited to) Erosion and Sediment Control and Non -discharge regulations. Also,

maintained above and below iocatlons of each culvert. The culverts shall be designed and installed to allow for squats
Iffe movement as well as to prevent head cutting of the streams. I any of the existing pipes are or become perched,
the appropriate stream grade shall be re-established or, H the pipes installer.; in a perc h d manner, the pipes shall b6
removed and re -installed correctly.
5. Stream Mitigation (EEP)
You are required to mitigate for permanent impacts to the streams.. Tha required length of stream mitigation to
compensate for Impacts to the streams is 292 feet as required under GC3402' and 1 EA NCAC 02H .0506. We
understand that you with to make a payment into the Ecosystem Enhancem€=nt Fund adrninlstered by the NO
Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has been determined by the DWO to
be a suitable method to meet the mitigation requirement. In accordance with 15A NCAG 02H .0506, this contribtution will
satisfy our compensatory mitigation requirements under this certification. Un1l the EEP receives and clears your check
(made payable to: DENR — Ecosystem Enhancement Program Office), no impacts specified in this certification shall

Dead notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective
buffers in order to assure compliance for future watland, weer and buffer impact. These mechanisms shall be put In
place prior to impacting any wetlands. waters and/or buffers approved for impact under this Certification Approval and
Authorization Cortifficate.
e. Protective Fencing
The outside buffer, wetland or water boundary and along the construction wrldor within these boundaries approved
under this authod2ation shall be clearly marked by orange fabric fencing for the areas that have been approved to
infringe within the buffer, we►land or water prior to any land disturbing activities to ensure oompliance with 15A NCAC 2B
159 and GC 3402.
9. Sewer Systems
The project shall comply with 15A NCAC 2H .0219(l)(2)(G) and all other State, Federal and local sower system
regulations.
10. Certificate of CompteAon
Upon completlon of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is rewired to return the attached certftate of completion to the 401/Wetlands
Unit, North Carolina Division of Water Qvakty, 1650 Mail Service Center, Raleigh, NC, 27699 -Mo.
Violations of any candidon herein set forth may result in revocation of 1111i Certific allon and may rescft in criminal and/or
civil penalties. This Certification shall become mull and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
GAMMA permit
if you do not accept any of the oond>tlons of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjuftatory hearing. You must act within 60 days of the date that you recelvo this letter. To ask for a
