Authorization Statement: 1) The Permittee is hereby authorized to discharge wastewater in accordance with the effluent limitations, monitoring requirements, and all other conditions set forth in this Industrial User Pretreatment Permit (IUP) into the sewer collection system and wastewater treatment facility of WSACC. 2) The Permittee is hereby authorized to continue operation of and discharge wastewater from the following treatment or pretreatment facilities, consisting of: • a 250,000-gallon equalization tank, a 100,000-gallon heated equalization tank, and two 200,000-gallon equalization tanks equipped with heaters and/or aeration; • emulsion(oil)break system with high level alarm; • a 2000-gallon chemical addition tank; • a 3000-gallon flocculant tank; • a 13,500-gallon clarifier/DAF system; • glass filters; • three carbon absorption units; • a 25,000-gallon oil break pretreatment tank with ferric chloride, coagulant and tannic acid; • a 14,000-gallon pretreatment tank with ferric chloride and lime carbamate addition; • a sludge conditioning tank; • plate and frame press; • a 30,000-gallon effluent equalization/holding tank; • high level alarms for the process tanks; • gas monitor with alarm located at the metering station; • effluent flowmeter; and • effluent sampler. 3 Permit No. 1030 PartI 3) The Permittee is hereby authorized to, if required by WSACC and after receiving Authorization to Construct (A to C) from WSACC, construct and operate additional pretreatment units as needed to meet final effluent limitations,monitoring requirements and all other conditions set forth in Parts I, II, and III hereof. D. Description of IUP Discharge(s): 1. Describe the discharge(s) from all regulated pipes. Pipe# 01 , Description of Discharge: Pretreated wastewater from off-site industrial wastewater collections of various oily and organic wastestreams, in-house used oil processing wastewater, stormwater from tank farm and limited runoff, truck wash waters, and other wastestreams collected which are not oily in nature. All wastestreams are combined and pretreated prior to equalization and discharge through pipe 01 which is designated as the Parshall flume located inside the effluent monitoring site just south of the main truck entrance to the facility. Effluent discharge sewer lateral, process discharge only, connects to WSACC sewer collection system in Speedrail Court directly in front of the flume. No domestic sewage or any other dilution waste flows. Definitions and Limit Page notes: In addition to the definitions in WSACC's Sewer Use Ordinance, the following definitions and requirements apply: 1. Maximum Monthly Average: The maximum monthly average discharge is the arithmetic mean of all the samples received, evaluated and accepted by WSACC for a calendar month. 2. Daily Maximum: The daily maximum discharge means the total discharge from all production periods during a 24-hour calendar day. 3. Continuous: Continuous for the purpose of flow monitoring is defined as the measure of discharge flow from the facility which is documented in the foul).of permanent flow records and occurs without interruption. See Part I (H)for more details. 4. "Every Sample"Monitoring Frequency: A monitoring frequency of"every sample" as specified in this IUP shall mean each time a composite or grab sample is collected. 5. Composite Sample: A composite sample for the monitoring requirements of this IUP is defined as the automatic or manual collection of one grab sample of constant volume,not less than 100 ml, collected every hour during the entire discharge period on the sampling day. Sampling day shall be a typical production and discharge day. 6. Grab Sample: A grab sample for the monitoring requirements of this IUP is defined as a single "dip and take" sample collected at a representative time in the discharge day. 7. Monthly or 4/Month Monitoring Frequency: The monthly monitoring frequency shall mean composite or grab samples collected over four (4) consecutive discharge days per month at the designated monitoring site, except for oil and grease. 8 Permit No. 103 0 Part I 8. Quarterly or 4/Quarter Monitoring Frequency: The quarterly or 4/quarter monitoring frequency shall mean composite samples collected over four (4) consecutive discharge days per quarter at the designated monitoring site. For purposes of this permit,the quarterly periods shall be January— March,April—June, July—September, and October-December. 9. Semiannually or 4/6 Months Monitoring Frequency: The semiannually or 4/6 months monitoring frequency shall mean composite samples collected over four (4) consecutive discharge days per six months at the designated monitoring site. For purposes of this permit,the semiannual periods shall be January—June and July—December. 10. Annually or 4/Year Monitoring Frequency: The annual or 4/year monitoring frequency shall mean composite samples collected over four (4) consecutive discharge days per year at the designated monitoring site. For purposes of this permit,the annual period shall be January—December. H. Flow Measurement, Gas Meter and Monitoring Point: 1. The Permittee shall provide and operate monitoring facilities for the inspection, sampling and flow measurement of the Permittee's process wastewater discharges. 2. The approved wastewater meter and gas meter shall be calibrated, at a minimum, once every six months by the manufacturer's authorized service representative. 3. The Permittee is responsible for the periodic maintenance and calibration of the meters and primary measuring device to assure accuracy. The Permittee shall, upon request of WSACC,furnish maintenance and calibration records. 4. There shall be interface capability with an Isco model sampler (contact closure); the Permittee shall purchase the interface line. WSACC shall take precedence; therefore, a splitter cable,purchased by the Permittee,will enable both WSACC and the Permittee to monitor at the same time and insure no interruption occurs in the Permittee's self-monitoring event. 5. The wastewater meter must have a non-resettable mechanical totalizer that reads in cubic feet or gallons. 9 Peimit No. 1030 Part I 6. If the wastewater meter is being used for billing or compliance, it must have permanent flow records (i.e. strip chart recordings) that include at minimum the following basic information: date, time, totalizer reading (with units), interval flow (with units), maximum flow rate (with units), primary measuring device type, and if there is a graph, a scale with units on both axis. Any interruption in such records is a violation of this permit and may result in a fine of at least $100.00 each day the interruption is allowed to continue. 7. Flow monitoring equipment and the sampling point shall be located in an area accessible to WSACC personnel without prior notification. WSACC must be supplied with any keys and/or other tools necessary to perform the aforementioned. 8. There shall be no by-pass capability of the wastewater metering devices and monitoring point(s). 9. The wastewater meter shall have a back-up power source (battery or generator) to insure uninterrupted measurement of the discharge flow in the event of a power failure. The back-up source shall provide power to the wastewater meter's sensor and permanent flow records for a minimum of 12 hours. 10. The Permittee shall maintain permanent flow records and maintenance and calibration records for a minimum of three years. 11. The daily wastewater meter readings shall be recorded in a binder which is to be located in the immediate area of the wastewater meter. A copy of these readings shall be submitted to WSACC by the second day of the following month. Waste/Wastewater Records: The Permittee shall keep records on all wastes/wastewaters brought on-site for pretreatment and discharge. These records shall include: 1. An analysis report of each wastestream to include fingerprint laboratory data from the Permittee and the date of arrival of the waste/wastewater. This report shall be completed before any wastestream is discharged to WSACC. 2. Source of the waste including company name and address. 3. Any laboratory analyses conducted on the waste/wastewater before and/or after treatment. 10 Permit No. 1030 Part I J. Detection Limits and Matrix Interferences: Proof of efforts to resolve effluent sample detection limits reported higher than permit limits issued herein [due to matrix interference] shall consist of the information included in "Chapter 1 — Checklist of Laboratory Data Required to Support a Claim that the Permittee was Unable to Measure Pollutants Due to Matrix Problems" of EPA Guidance on Evaluation, Resolution and Documentation of Analytical Problems Associated with Compliance Monitoring [EPA Publication 821-B-93-001 June 1993]. All costs associated with the proof of matrix interferences, including any third party review of the analytical data and supporting documentation, shall be the responsibility of the Permittee. This shall also include the costs for any additional procedures, analyses or data review of samples collected by WSACC to determine compliance with the permit limits issued herein. K. Signatory Requirements for Industrial Monitoring Reports: All self-monitoring and re-sampling data submitted for compliance to WSACC shall include the certification statement below and shall be signed by the person on-site at the facility who is authorized to represent the company in an official capacity concerning matters that involve WSACC. I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations. 11 Permit No. 1030 Part II PART II: GENERAL CONDITIONS 1. Representative Sampling: Samples and measurements taken as required herein shall be representative of the volume and nature of the monitored discharge. All samples shall be taken at the monitoring points specified in this permit and, unless otherwise specified, before the effluent joins or is diluted by any other wastestream, body of water, or substance. Removal or addition of any substances (other than those required for preservation of the sample per approved methods) is not allowed. Monitoring points shall not be changed without notification to and approval by,the permit issuing authority. 2. Reporting: a. Monitoring results obtained by the Permittee shall be summarized and reported on the forms specified by WSACC, postmarked no later than the twentieth day of the month following the month in which the samples were taken. The chain of custody forms shall accompany all reports.If no discharge occurs during the reporting period(herein defined as each calendar month) in which a sampling event was to have occurred, a form with the phrase "no discharge" shall be submitted. Copies of these and all other reports required herein shall be submitted to WSACC and shall be sent to the following address: Attention: EHS Compliance Manager Water&Sewer Authority of Cabarrus County 6400 Breezy Lane Concord,N.C. 28025 b. If the monitoring performed by the Permittee indicates a violation, the Permittee shall notify WSACC within 24 hours of becoming aware of the violation(s). The Permittee shall also repeat the sampling and analysis and submit the results of the repeat analysis to WSACC within thirty(30)days after becoming aware of the violation. c. If no self-monitoring is required by this IUP, and the sampling performed by WSACC indicates a violation,WSACC shall repeat the sampling and analysis and receive the results of the repeat analysis within 30 days after becoming aware of the violation. 3. Test procedures: Test procedures for the analysis of pollutants shall be performed in accordance with the techniques prescribed in 40 CFR part 136 and amendments thereto unless specified otherwise in the monitoring conditions of this permit. 4. Additional Monitoring by Permittee: If the Permittee monitors any pollutant at the location(s) designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring shall be submitted to WSACC. WSACC may require more frequent monitoring or the monitoring of other pollutants not required in this permit by written notification. 12 Permit No. 1030 Part II 5. Recording Results: For each measurement or sample taken pursuant to the requirements of this permit, the Permittee and/or WSACC shall record the following infoiuuation: a. laboratory reports shall include the following information: 1. exact place,time, date of sampling; 2. dates the analyses were performed; 3. person(s)who performed the analyses; 4. analytical techniques or methods used; and 5. results of all required analyses. b. chain of custodies shall contain the following information: 1. sampling location(s); 2. date(s) and time(s)sample taken; 3. sample type: composite(time,flow,hand) or grab; 4. container type; 5. type of preservative used, if any; 6. sample iced upon receipt; 7. parameters to be run from that particular bottle; 8. individual(s)who performed the sampling and/or field measurements; and 9. samples relinquished/received by who and when(date&time) 6. Duty to Comply: The Permittee must comply with all conditions of this permit. Any permit noncompliance constitutes a violation of WSACC Sewer Use Ordinance and is grounds for possible enforcement action. 7. Duty to Mitigate-Prevention of Adverse Impact: The Permittee shall take all reasonable steps to prevent or minimize any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health, the sewer system,wastewater treatment plant,receiving waters, or the environment. 8. Facilities Operation,Bypass: The Permittee shall at all times maintain in good working order and operate as efficiently as possible, all control facilities or systems installed or used by the Permittee to achieve compliance with the terms and conditions of this peiniit. Bypass of treatment facilities is prohibited except when approved in advance by WSACC.Bypass approval shall be given only when such bypass is in compliance with 40 CFR 403.17. 9. Removed Substances: Solids, sludges, filter backwash or other pollutants removed in the course of treatment or control of wastewaters shall be disposed of in an approved manner such as to prevent any pollutants from such materials from entering the POTW. The Permittee is responsible for assuring its compliance with any requirements regarding the generation, treatment, storage, and/or disposal of "Hazardous Waste" as defined under the Federal Resource Conservation and Recovery Act. 13 Permit No. 1030 Part II 10. Upset Conditions: An "upset" means an exceptional incident in which there is an unintentional and temporary noncompliance with the effluent limitations of this permit because of factors beyond the reasonable control of the Permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed or inadequate treatment facilities, lack of preventative maintenance,or careless or improper operations. An upset may constitute an affirmative defense for action brought for the noncompliance. The Permittee has the burden of proof to provide evidence and demonstrate that none of the specifically listed above was responsible for the noncompliance. 11. Right of Entry: The Pennnittee shall allow the staff of the State of North Carolina Department of Environmental Quality (NCDEQ), Division of Water Quality, the Regional Administrator of the Environmental Protection Agency, WSACC and/or their authorized representatives, upon the presentation of credentials: a. To enter upon the Permittee's premises where a real or potential discharge is located or in which records are required to be kept under the terms and conditions of this permit; and b. At reasonable times to have access to and copy of records required to be kept under the terms and conditions of this permit; to inspect any monitoring method required in this permit; and to sample any discharge of pollutants. 12. Availability of Records and Reports: The Permittee shall retain records of all monitoring information, including all calibration and maintenance records as well as copies of reports and information used to complete the application for this permit for at least three years or longer if requested in writing by WSACC.All records that pertain to matters that are subject to any type of enforcement action shall be retained and preserved by the Permittee until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired. Except for data determined to be confidential under WSACC's Sewer Use Ordinance, all reports prepared in accordance with the terms of this permit shall be available for public inspection at the offices of WSACC. As required by the Sewer Use Ordinance, effluent data shall not be considered confidential. 13. Duty to Provide Information: The Permittee shall furnish to WSACC, within a reasonable time, any information which WSACC or DEQ may request to determine whether cause exists for modifying, revoking and reissuing, or terminating the permit or to determine compliance with this permit. The Peuiiittee shall also furnish,upon request, copies of records required to be kept by this permit. 14 Permit No. 1030 Part II 14. Signatory Requirements: All reports or information submitted pursuant to the requirements of this permit must be signed and certified by the Authorized Representative as defined under the Sewer Use Ordinance. If the designation of an Authorized Representative is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, or overall responsibility for environmental matters for the company, a new authorization satisfying the requirements of this section must be submitted to WSACC prior to or together with any reports to be signed by an authorized representative. 15. Toxic Pollutants: If a toxic effluent standard or prohibition (including any schedule of compliance specified in such effluent standard or prohibition) is established under Section 307(a) of the Federal Clean Water Act for a toxic pollutant which is present in the discharge and such standard or prohibition is more stringent than any limitation for such pollutant in this permit, this permit may be revised or modified in accordance with the toxic effluent standard or prohibition and the Permittee so notified. 16. Civil and Criminal Liability: Nothing in this permit shall be construed to relieve the Permittee from civil or criminal penalties for noncompliance. 17. Federal, State and/or Local Laws: Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the Permittee from any responsibilities, liabilities or penalties established pursuant to any applicable Federal and/or State laws or regulations or WSACC's Sewer Use Ordinance. 18. Penalties: The Sewer Use Ordinance of WSACC provides that any person who violates a permit condition is subject to a civil penalty not to exceed $25,000 dollars per day of such violation for as long as the violation(s)continues. Under state law, (NCGS 143-215.6B), under certain circumstances it is a crime to violate terms, conditions, or requirements of pretreatment permits. It is a crime to knowingly make any false statement, representation, or certification in any record or other document submitted or required to be maintained under this permit, including monitoring reports or reports of compliance or noncompliance. These crimes are enforced at the prosecutorial discretion of the local District Attorney. 19. Need to Halt or Reduce not a Defense: It shall not be a defense for a Permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity to maintain compliance with the conditions of the permit. 20. Transferability: This permit shall not be reassigned or transferred or sold to a new owner, new user, different premises, or a new or changed operation without approval of WSACC. 15 Permit No. 1030 Part II 21. Property Rights: This permit does not convey any property rights in either real or personal property, or any exclusive privileges,nor does it authorize any injury to private property or any invasion of personal rights,nor any infringement of Federal, State or local laws or regulations. 22. Severability: The provisions of this permit are severable and, if any provision of this permit or the application of any provision of this peinnit to any circumstance is held invalid,the application of such provision to other circumstances and the remainder of this permit shall not be affected thereby. 23. Permit Modification,Revocation, or Teinnination: This permit may be modified, revoked and reissued or terminated with cause in accordance to the requirements of WSACC Sewer Use Ordinance and North Carolina General Statutes or implementing regulations. 24. Reapplication for Permit Renewal: The Permittee is responsible for filing an application for reissuance of this permit at least 180 days prior to its expiration date. 25. Dilution Prohibition: The Permittee shall not increase the use of potable or process water or in any other way attempt to dilute the discharge as a partial or complete substitute for adequate treatment to achieve compliance with the limitations contained in this permit. 26. Reports of Changed Conditions: The Permittee shall give notice to WSACC of any planned significant changes to the Permittee's operations or system which might alter the nature, quality, or volume of its wastewater at least 180 days before the change. The Permittee shall not begin the changes until receiving written approval from WSACC. Also, see Part II (30) below for additional reporting requirements for spill/slug issues. Significant changes may include but are not limited to: (a) increases or decreases to production; (b) increases in discharge of previously reported pollutants; (c) discharge of pollutants not previously reported to WSACC; (d) new or changed product lines; (e) new or changed manufacturing processes and/or chemicals;or (f) new or changed customers. 27. Construction: No construction of pretreatment facilities or additions thereto shall begin until Final Plans and Specifications have been received by WSACC and written approval and an Authorization to Construct have been issued. 16 Permit No. 1030 Part II 28. Categorical Standard Reopener: This pelinit shall be modified, or alternatively,revoked and reissued to comply with any applicable effluent standard or limitation issued or approved under Sections 302(b)(2)(C) and (D), 304(b)(2), and 307(a)(2) of the Clean Water Act,if the effluent standard or limitation so issued or approved: a. Contains different conditions or is otherwise more stringent than any effluent limitation in this permit; or b. Controls any pollutant not limited in this permit. The pennit as modified or reissued under this paragraph shall also contain any other requirements of the Act then applicable. 29. General Prohibitive Standards: The Permittee shall comply with the general prohibitive discharge standards in 40 CFR 403.5 (a) and(b)of the Federal pretreatment regulations. 30. Reports of Potential Problems: The Permittee shall provide protection from accidental and slug discharges of prohibited materials and other substances regulated by this permit. The Permittee shall also notify WSACC immediately of any changes at its facility affecting the potential for spills and other accidental discharge, discharge of a non-routine, episodic nature, a non-customary batch discharge, or a slug load as defined in the Sewer Use Ordinance. Additionally, the Permittee shall notify by telephone WSACC immediately of all discharges that could cause problems to the POTW including any slug loadings as defined in the Sewer Use Ordinance. If the Permittee experiences such a discharge, they shall contact WSACC immediately at (704) 788-4164 upon the first awareness of the commencement of the discharge. If calling after 4pm to report such a discharge, the Permittee shall contact the emergency number listed on the answering service to report incident to WSACC personnel.Notification shall include location of the discharge, type of waste, concentration and volume if known and corrective actions taken by the Permittee. The Pennittee thereof shall file a written follow-up report within five (5) days, unless waived by WSACC. The report shall describe the cause of the discharge and measures taken to prevent similar future occurrences. Such written notification shall not relieve the Permittee from any liability,which may be incurred as a result of the discharge. 31. Excessive Scum and Foam: Any materials which may cause excessive amounts of scum and foam that may interfere with the operation of the treatment plant or cause undue labor in connection with its operation, cause a violation of the NPDES peiniit,or cause toxicity is prohibited. 32. Biodegradable Substances: All substances shall be biodegradable to the extent that it does not cause interference with or pass through of the treatment plant or noncompliance with the POTW permit in accordance with the design criteria of the treatment plant. 17 Permit No. 1030 Part II 33. Concentration Limitation: The Peumittee shall not discharge any concentration of pollutant which has an adverse impact on the wastewater treatment plant facilities or operation. 34. Industrial Surcharges and Schedule of Payments: a. Industrial sewer surcharges will be assessed and billed monthly in accordance with the limitations in and provisions adopted pursuant to Section 3.3 of WSACC Code (Sewer Use Ordinance) or as amended and shall be due as specified on the bill. The effluent limitations set forth in this pretreatment permit do not void any appropriate user charges (surcharges) adopted in accordance with Section 3.3. b. Failure to pay all surcharges, fees, fines, and late fees in a timely manner may cause WSACC to initiate action to revoke the industrial user pretreatment permit. c. Any discharge by the Permittee after revocation of the permit will be subject to a fine of $25,000 per day for as long as the discharge continues without a valid permit. 18 Permit No. 1030 Part ill PART III. SPECIAL CONDITIONS 1. Completion of Wastewater Survey and Permit Application: The Peu nittee was responsible for filing complete and accurate information for issuance of this renewed permit. Said information consisted of a wastewater survey and peiinit application dated 11/28/17. Should the Permittee determine that said information was incomplete and/or inaccurate in any manner, the Peiniittee shall notify WSACC immediately in writing. Such notice shall identify the information, which was incomplete and/or inaccurate and shall include the new complete and accurate infoiination as well as an explanation of the impact of the new complete and accurate information on the existing permit. 2. Slug/Spill Control Measures: In addition to the requirements in Part II (30), the Permittee shall complete installation and/or commence implementation, operation, and/or maintenance of the following specific protection Measures, Activities, Plans, Etc. (Items without specific completion dates, or marked as "Continuous"must be performed for the entire duration of the permit.) Required Completion/ Implementation Description of Measure,Activity, Plan, etc. Date Implement WSACC approved Heritage-Crystal Clean Spill Continuous and Discharge Reporting Plan The Permittee shall provide updates to WSACC as required by Part II (30) of this IUP. Modifications to the measures shall be approved by WSACC prior to installation/implementation. If a measure fails, WSACC shall be notified within 24 hours. 3. Communication: The Permittee is responsible for communicating all requirements and conditions of this peminit to all applicable persons. 4. Alkyl Phenol Ethoxylates (APEs): The discharge of compounds containing alkyl phenol ethoxylates (APEs) shall be prohibited, due to the inhibiting and toxic effect of APEs on the biological treatment at the wastewater treatment plant. Linear alcohol ethoxylates, a more readily biodegradable surfactant,may be substituted for APEs. 19 . Permit No. 1016 Part III 5. Peinjit Reopener: The permit shall be reopened and modified or, alternatively,revoked and reissued to comply with any applicable effluent standard or limitation for the control of any pollutant shown through headworks analysis to contribute to interference, inhibition, pass through and/or toxicity at the POTW. Similarly, permit modification or reissuance shall be made for any pollutant that is otherwise limited by or appears on the POTW's NPDES discharge permit and/or is limited by 503 sludge regulations. The permit as modified or reissued under this paragraph may also contain any other requirements of State or Federal pretreat nent regulations then applicable. In the event monitoring and analysis confirm the need for additional pretreatment process(es) to reduce the concentration(s) of a pollutant or a class of pollutants, this permit shall be modified to include specific compliance schedule(s) for installation and operation of those process(es) and compliance with pollutant limits. 6. Resources Conservation and Recovery Act(RCRA): The Resources Conservation and Recovery Act was established to control the generation, storage and disposal of hazardous wastes. Any facility that generates, stores, handles, or disposes of hazardous wastes shall meet RCRA requirements. Questions or infoiination should be directed to the NCDEQ, Division of Solid Waste Management,Hazardous Waste Branch, (919) -733-2178. 7. Hazardous Waste: The Peiniittee shall not discharge any hazardous waste into the POTW. 8. Non-regulated Wastestream(s): The Permittee shall not introduce into the regulated wastestream any dilution, domestic and/or non-process wastewater, prior to the sampling point identified in Part I, E. of this permit for Pipe 01. 9. Maintenance of Pretreatment Tanks and Solids Disposal: The Permittee shall clean and maintain the pretreatment tanks periodically. Any solids removed from the pretreatment tanks shall not be disposed of into the sanitary sewer system. Documentation of such cleaning shall be maintained by the Permittee for a minimum of three years and be available for review. 20
