No Effect (Rhus michauxii) PT = Proposed Threatened E = Endangered BG PA Biological Conclusions Atlantic Pigtoe: As noted above, this species is found in high-quality rivers and large creeks with sand and gravel substrate. They prefer fast -flowing, well -oxygenated waters and occur downstream of riffles. The stream located within the project boundaries is a second -order perennial stream. Substrate is a mix of sand, silt, gravel and bedrock. According to the 2006 National Land cover Database, the watershed draining to this stream is 58.6% developed, and has 23.6% impervious surface. Development includes primarily office and institutional buildings, parking lots and roads. The development of the watershed has likely had an effect on both water quality and quantity in the stream, resulting in unsuitable conditions for the Atlantic Pigtoe. The project is expected to have No Effect on this species. Dwarf Wedgemussel: As noted above, this species is found in hydrologically stable areas. The perennial stream located within the project boundaries is hydrologically unstable, with eroding banks and an excessive sediment load, and is located within a moderately -developed watershed. The project is expected to have No Effect on this species. Bald Eagle: The Bald Eagle was removed from the endangered species list in 2007 because their populations recovered sufficiently. Bald Eagles are protected under the federal Band and Golden Eagle Protection Act (BGPA). Bald Eagles live near estuaries, large lakes, reservoirs, rivers, and some seacoasts. They typically nest and roost in the tops of large mature trees. A small (64 acres) pond is located immediately to the north of the project area. The pond is surrounded by middle aged (e.g. 30-50 year) pine and hardwood trees. Due to the size of the pond and the lack of ideal roosting sites, it is unlikely that Bald Eagles utilize the pond. More suitable roosting and nesting habitat is present approximately eight miles to the west of the project area (Jordan Lake), which sustains a breeding population of eagles. The project is expected to have No Effect on this species. Red -Cockaded Woodpecker: This species has historical occurrences in southern Wake County. This species inhabits mature pine forests. Wooded areas within the project site consist of mixed forest comprised of young to mid—aged pines and hardwoods. The project is expected to have No Effect on this species. Michaux's Sumac: Michaux's Sumac grows in sandy or rocky open woods in association with basic soils. The plant survives best in areas where some type of disturbance has provided an open area. The wooded areas on the project site consist of middle-aged pines and hardwoods forming a closed canopy. In addition, the Soil Survey for Wake County shows soils on the site are mapped as Chewacla and Mayodan soils. Both of these soils types are strongly acid. Review of mapping data from the NC Natural Heritage Program indicated the closest population of Michaux's Sumac identified near the site is approximately 3.5 miles east, in William B. Umstead State Park.
