REGAN Secretary LINDA CULPEPPER Director Mr. Robert Williamson, Plant Manager American Zinc Products, LLC 484 Hicks Grove Road Mooresboro, North Carolina 28114 Dear Mr. Williamson: NORTH CAROLINA Environmental Quality April 18, 2019 Subject: Final NPDES Permit Permit NCO089109 American Zinc Products, LLC Rutherford County Grade II PCWPCS Division personnel have reviewed and approved your application for a renewal of the subject permit. Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). No major changes were made to the draft permit sent to you on January 29, 2019. The final permit maintains the following significant changes identified in the letter sent on January 29, 2019: • The flow limit was increased to 0.98 MGD • The requirement for fish tissue monitoring was added to the permit to address a comment from the Regional Office. • The requirement for pollutant scan was added to the permit to address a comment from the Regional Office. • The limits for Total Cadmium were recalculated (reduced) based on the new flow estimate and the recent update to the North Carolina water quality standards. A cadmium limit compliance schedule was added to the permit. • The limits for Total Chromium, Total Lead, and Total Fluoride were removed from the permit based on the results of the Reasonable Potential Analysis. • Quarterly monitoring for Hexavalent Chromium was added to the permit based on the review of the effluent data. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or any other Federal, State, or Local governmental regulations.
