The stream feature along both peripheries of the property are perennial stream features and subject to the Neuse Buffer Rule. This letter is being directed to you to request the granting of a minor variance from the Neuse Riparian Buffer Rule and allow the driveway to remain with minimal impact to the riparian buffer. This submittal is required for DWQ approval of the project. As per the site visit and based upon our conversation, the~following is submitted: The only access to the property is across th U~` o Beaverdam Creek. _.~~' The 401 Pre Construction Notification request for a Nation~Wide 14 Permit for the stream crossing has been submitted as an "after the fact" application for an impact to the stream of forty (40) linear feet. As the driveway is in plat ALL f the concrete in Zone 1 will be removed and a minor variance request is attac ed to allow the impervious within Zone 2 to remain. To that end the stormwater generated by the garage and driveway will be collected and treated in a rain garden located adjacent to the stream. In addition, payment to EEP for 1018 square feet of Zone 2 impact is proposed as mitigation for the disturbed area of Zone 1 ($1465.92). To compensate for the unauthorized impact to Zone 1, (tree removal from the unpermitted stream crossing) a minimum of 16 native trees will be planted in conjunction with a large number of shrubbery. This revegetation will be conducted at the front of the house along the stream. The fill located to the north of the stream crossing will be removed and the four quadrant of the stream at the driveway will be stabilized.
