REGAN ��r��y This memorandum pertains to the Nationwide permit (404/401) application for the Richardson Road extension project which was recently submitted by the Town of Apex. The applicant proposes to encroach upon the Little Beaver Creek conservation easement held since 2002 by the State of North Carolina. As the DEQ Stewardship Program Coordinator I am responsible for the stewardship and enforcement of conservation easements acquired by the Division of Mitigation Services. Beginning in late 2016 I have participated in numerous easement avoidance and minimization discussions with the Town of Apex and other interested parties. The proposed easement release area (figure attached) has been determined to be acceptable contingent upon Interagency Review Team (IRT) approval and a real property settlement agreement between the State and the land owner. Upon closing of the settlement agreement the proposed easement release area will be released for right-of-way for the Richardson Road extension project.
